composed as above,

after deliberation,
having regard to Article 45 of the Statute of the Court,
having regard to Article 69 of the Rules of Court,

Makes the follouting Order.

Having regard to the Application, filed and registered in the
Registry of the Court on October 13th, 1949, by which the Govern-
ment of the French Republic, relying upon rhe Convention of
Montreux of May8th,1937regarding the abrogation of the Capitu-
lations ingypt, instituted proceedings against the Royal Egyp-
tian Government in the Case concerning the Protection of French
Nationals and Protectedersons in Egyp;
Having regard to the designation of RI. J. Rivii,re, French
Ambassador at The Hague, as Agent of the French Government,
and of Iskander Bey Elhhabi, Egyptian Minister at The Hague,
as Agent of the Egyptian Government,ubsequently rcplaced in
at The Haguec;ty by Mohamed Ali Sadek Bey, Egyptian Xiniçter
Whereas this Application, in accordance with Article 40, para-
graph 3, of the Statutof the Court, \vas communicatedthe PROTECTIO?; OF FREXCH XATIOXALS IS EC;YPT 60

Members of the United Nations through the Secretary-General
and to any other States entitled to appear before the Court ;
Whereas il was also notified, in accordance with -\rticle 63,
paragraph 1, of the Statute, to States other than those concerned
in the case, which are parties to the Convention of Montreux

regarding the abrogation of the Capitulations in Egypt ;
Whereas by letter dated February z~st, 1950, and registered in
the Registry on February 23rd, the Agent of the French Govern-
ment stated that the measures taken by the Egyptian Government
against the persons, property, rights and interests of French
nationals and protected persons having been withdrawn, the dispute
was virtually settled ; and consequently, that the Government of
the French Republic was not going on with the proceedings and
requested that its case be removed from the general list of the
Court, in accordance with Article 69 of the Rules of Court ;

Whereas the Egyptian Government had already taken a step
in the proceedings, and that, therefore, in accordance with Article69,
paragraph 2, of the Rules, it was necessary to fix a time-limit
within which this Government should state whether it opposed the
discontinuance of the proceedings by the French Government ;
Whereas by letter of March znd, 1950, the Registrar informed
the Agent of the Egyptian Government that the Court, in accord-
ance with Article 69, paragraph 2, of the Rules, had fixed in this
connexion a time-limit expiring on March zznd, Igjo, and that
if no objections were raised by that Government within this time-
limit, acquiescence would be presumed ;

Whereas no reply reached the Court within this time-limit ;

places on record the discontinuance by the French Government
of the proceedings instituted by the Application of October 13th,
1949 ;
and orders that the case shall be removed from ihe Court's list.

Done in French and English, the French text being authoritative,
at the Peace Palace, The Hague, this twenty-ninth day of March,
one thousand nine hundred and fifty, in three copies, one of which
will be placed in the archives ofthe Court and the others trans-

mitted to the French Government and to the Egyptian Govern-
ment respectively.

Having regard to the Application, filed and registered in the

Whereas this Application, in accordance with Article 40, para-

Considérant qu'elle a étéégalement notifiée, conformément à
l'article 63, paragraphe premier, du Statut, aux Etats, autres que
les États en cause, qui sont parties à la Convention de Blontreux
concernant l'abrogation des capitulations en Egj-pte ;

Considérant que, par lettre du 21 février 1950, enregistrée au
Greffe le23 février, l'agent du Gouvernement français a fait savoir
que, les mesures prises à l'encontre des personnes, biens, droits et
intérêts deressortissants et protégésfrançais ayant étélevéespar
le Gouvernement égyptien, le litige se trouvait virtuellement
aplani ; que, par conséquent, le Gouvernement de la République
française renonçait à poursuivre la procédure et demandait que
son action fût rayée du rôle de la Cour, conformément àl'article 69
du Règlement ;
Considérant que le Gouvernement égyptien avait déjà fait acte
de procédure et qu'en conséquence, conformément à l'article 69,
paragraphe 2, du Règlement, il était nécessaire de fixer un délai
dans lequel ce Gouvernement aurait à déclarer s'il s'opposait au

désistement du Gouvernement français ;
Considérant que, par lettre du 2 mars 1950,le Greffiera informé
l'agent du Gouvernement égyptien que la Cour, conformément
audit article69, paragraphe 2, du Règlement, avait fixé,à cet effet,
un délai expirant le 22 mars 1950 et que, faute par lui de faire
opposition dans ce délai,le désistement serait réputéacquis ;

Considérant qu'aucune réponse n'est parvenue à la Cour dans
le délai fixé ;

prend acte du désistementdu Gouvernement français del'instance
introduite par la requêtedu 13 octobre 1949 ;

ordonne. que l'affaire soit rayée du rôle de la Cour.

Fait en français et en anglais, le texte français faisant foi, au
Palais de la Paix, à La Haye, le vingt-neuf mars mil neuf cent
cinquante, en trois exemplaires, dont l'un restera déposé aux

archives de la Cour et dont les autres seront transmis respective-
ment au Gouvernement français et au Gouvernement égyptien.
