between Yugoslavia and France, and 1 cal1 on the distinguished agent of France to make his
submissions.
M. ABRAHAM : Monsieur le président, Madame,Messieurs les juges, j'ai écouté
attentivement les observations en répliqueprésentce matin parl'Agentet les Conseils de la
Républiquefédéralede Yougoslavie.
Je n'yai aperçu aucun argument,je n'yai décaucun élémenq tui fût de naturenfirmer
ou à contredire si peu que ce soit les conclusions quej'ai eu l'honneurde présenter au nomde la
Républiquefrançaise àl'audience de lundi après-midi. -
J'yaidonc trouvéla confirmation, par déf,u bien-fondéde l'argumentationque laFrance
a soumise àla Cour.
Toutparticulièrement,j'aiéfrappé,etla Courne manquerapas d'êtfrappée,par le silence
total de'Etatrequérant sur le point centraldela plaidoirie française,qui a égalementété au centre
des observationsde laplupart des défendeurs,voir l'absencemanifesteen I'espèce.del'élément
intentionnel,du critère subjectifde la définition du génocidelontédélibérée deétruireun
groupe humain en tant que tel.
Sanscet élément intentionnell,a notionde génocideseraitdépourvuede sens, puisqu'elle se
confondraitavec l'usagede la force provoquant la perte de vies humaines et, en conséquence,la

conventionde 1948 serait privéed'objet.
Or, ilest hautementsignificatifquelaPartieadversen'ait,cematinencore,mpas allégué
- non seulement pas démontré, maisencore,j'y insiste, pas all-guqu'ilexisterait une telle
volontédélibérée dlea part des défendeursde détruireun groupehumain en tant que tel.
Et l'oncomprend pourquoi:l'audacedu requérant,qui l'aconduàbien des démonstrations
hasardeuses,ne va pasjusqu'à lui permettre de proférer unetion si manifestement absurde,
et qui eût ét,e sa part, dans le présent contexte, particulièremenitndécente. -7-
Je trouve donc dans les dernières observationsde la République fédéraldee Yougoslavie
l'aveu- par le silence - que le litige se trouve hors du champ d'applicationde la convention
de 1948.
Je ne puis donc quepersister dans les conclusionsquej'ai respectueusementsoumises lundi
à la Cour.
Je demande à la Cour, au nom de la République fiançaise, debien vouloir prononcer la
radiation du rôle général e la requêteformée par la Républiqufeédéralede Yougoslavie.

Mr. ABRAHAM: Mr. President, Members of theCourt, 1 have listened carefully to the
remarks made in reply this moming by the Agent and Counsel of the Federal Republic of
Yugoslavia.
1could see in them no argument, no element, which mightinvalidateor gainsay, however
slightly, the submissionswhich1had the honourto make on behalf of the French Republic in the
hearing on Monday afternoon. #
1 thus found in them confirmation,by default, of the meritsof the arguments whichFrance
presented to the Court.
1was struck in particular -asthe Court will have certainlybeen - by the total silenceof
the applicant Stateon the central issueofthe French pleadings,which was alsoat the centre ofthe
observations of most ofthe Respondents,namely the manifestabsence in this case of the element
of intent, ofthe subjectivecriterion ofthedefinitionof genocide: the deliberateintentionto destroy
a group ofhuman beings as such.
Withoutthat elementof intent,thenotionof genocidewouldhave nomeaning,sinceitwould
become identicalwith the use of force causingloss ofmanlife,and the 1948Convention would

therefore be devoid of purpose.
It is highly significant that again this morning, the otherPart yid not even seek to
allege - not only not demonstrate, but, 1 would stress, not even seek to allege - that the
Respondents have any such deliberate intentionof destroyinga group of human beings as such.
And we know why: the Applicant'saudacity, which has led it to venture a number of
dubious arguments, is not so great as to allow it to put forward such a manifestly absurd
assertion- one which, coming fiom the Applicant, wouldhavebeen particularly unseemlyin the
present context. -3-
1 therefore find in the latest remarks of the Federal Republic of Yugoslavia the tacit
confessionthat the dispute liesoutside the sphere of application of the 1948 Convention.
1 can therefore do no more than reiteratethe submissionswhich 1 had the honourto present
to the Court on Monday.
On behalf ofthe French Republic, 1requestthe Courtto orderthatthe Application submitted
by the Federal Republic of Yugoslavia be removed from the General List.
