Guinea-Bissaubrinasa new case apainstSenenal
The following information is communicat tedthe Press bythe
Registryof the International Couro tf Justice:
On 12 March 1991,the Governmentof the Republicof Guinea-Bissau
filed in the Registryof the Courtan Application instituting proceedings
against the Republio cf Senegalin a dispute concerning the delimitation
of al1 the maritime territorie of thosetwo States.
In its Application, Guinea-Bissau recalls tb hat,n Application
dated 23 August 1989, it referredto the Courta dispute concerning the
existence and validity of the Arbitral Aw made on 31 July 1989 by the
Arbitration Tribunal formt ed determine the maritime bounda beytween
the two States(seePress CommuniquéNo. 89/17 of 24 August 1989).
Guinea-Bissau claimtshat the objectiveof the request laid before
the Arbitration Tribuna was the delimitationof the maritime territories
appertaining respectivel to one and the otherState,without excluding
from the jurisdictionof the Tribunal anyof the categories of territory
over which the contemporarLyaw of the Sea now permitsa coastalstate to
exercise rights, butthat it was obvious,when the resultof the
Arbitrationwas made kn.ownon 31 July 1989,that it was not such as to
make possiblea definitive delimitatio of al1 the maritimeareas over
which the Parties had right snd that,at the closeof the proceedings
pending before the Cour and whatever mightbe theiroutcorne, the
delimitationof al1 the maritime territories woul stillnot have been
effected.
While reservingth.eright to supplementand amend its submissions
duringthe subsequent proceedings, t Governmentof Guinea-Bissau asks
the Courtto adjudgeand declare:
the sea and ofal1 the relevant element of the case, including
the futuredecisionof theCourtin the case concerning the
Arbitral 'Awardo'f 31 July 1989,the line(markedon a map)
delimiting the wholoef the maritime territories appertaining
respectivelyto Gu.inea-Bissaaund Senegal."
