Gouvernwent du Nicaraguade la sentence arbitrale du 23 dScenbre1906
constitue la violation diun engagement international. et que le Gouverne-
ment du Nicaragua est tenu drex-2cuter cette seritence.

* Honduras institutcd proceedings against the Govemnent of Nicaragua.
.On Octobe-r ?th, 1Q94, Honduras and Nicaragua concluded a Treaty
for the denm-cation of the limits beir-reen 'chtwo couzSries, whichis
called,the Bonilla-C-amez Trea-Ly ,ArtTcle 5 of 1,-hichprovided that
certain points in dispute might, in certain circumstances be referred
to the decision of the Goverment of Spain. Accordingly, an
arbitration waç requssi;ed f rom The KiYig O? Spein in ~kt~bej-, 1904,2nd
the avrarà was nade on December23rd, 1906.
The Application recites that, trhen the tirne came to proceedto the
delimitati on, Micaragua contended that the arbitre1 2.wardwas a nullity;
that it bras not possibleto resolve the disputeby ctiplomatic means
or through the medis.%ion of frïendly nations and govements; and that,
in accordance with tl~ resolution adopted by the O~gmization of
Americm States on Jdy Tth, 1957, the Guuemsnts of Honduras and
Nicaragm conclud.ed an agreement at 1:iashingtonon July 21s't, 1957, by
virtue of which their dispute should be referred to the Lnterfiatjronal
Gomt of Justlce. The Application concludes by req~iestin. the Court to
ad&dge and declare that the failure 'o,-the Goverment of rilicara@a to
'givz effect to Lke arbitrai award made on Deceiiiber 23rd,1906, constitutes
' a brcnck af '-rifntemational obligatior! and khat the Gavement of
Nicaragua is underan obligation ta earry out the 2ward.
