La qualification denon exclusivement préliminaire attribuàel'ex-
ception demootness des Etats-Unis et le renvoi de son examen au fond
signifient notre avis qu'il ne suffit pas d'invoquer les dispositions du
chapitreVI1 de la Charte pour mettre fin de manière automatique et
immédiate à tout débatjudiciaire au sujet des décisionsdu Conseil de
sécurité. orsque la Cour en arrivera au fond elleaurae prononcerà

cet égard.

- We are amongst those who fully endorse both the reasons and the
operative part of the present Judgment.
To characterizeasnot exclusivelypreliminary the United States objec-
tion of mootness, and to postpone consideration of it to the merits stage,.
mean in Our view that it is not sufficient to invoke the provisions of
Chapter VI1of the Charter so as to bring to an end ipsofacto and with
immediate effectal1judicial argument on the Security Council's deci-
sions. The Court willhave to decidethat point when it reaches the merits

of the case.
