Mr.President,Membersofthe Court,it is an honourformeonce againto findmyself before
you, representingtheRepublicof Carneroonintheterritorial dispute betndNigeria.
1.1am to speakto you this moming aboutLake Chad. But first 1will present to you the
legal instrumentswhich delimitthe boundaryin the sector fiom LakeChad to the "fairly
prominentpointedpeak"knownasMountKombon.
Thatsectionoftheboundaryis characterizedbytwo features:
(1) Itis delimitedby international instrumentsvalidityisnot disputedbytheParties;
(2) It has been defined within the fiamework of international organizations,either directly or
undertheir close supervision. Bothbeltandbraces.
2. In other words, this is a boundary delirnitedwith care, surrounded by a plethora of
international guarantees. If there is one boundary which shouldpose no problem, at least in
pnnciple and as far as the relevant instruments are concemed,it is this And yet this
conventionalboundaryis challengedbyNigeria.
3. Let us retracethe historyof this boundary,startingfiomthe tripointin Lake Chad. Point
of convergence ofthe temtorial ambitionsof the German,Britishand Frenchcolonialempires, the
tripointis the result of aseriesof agreementssignedbeforetheFirst WorldWarby Germanywith
Great Britain and France.Youwill finddetailsof thesenegotiationsandagreementsin ourwritten
19 pleadings,to which1wouldrespectfullyreferthe court'. Thattripointwasmoreprecisely defined
and confirrnedin 1919by France and the Unitedingdomin the Milner-Simon Declarationof

longitude eastof Greenwich".
4. Fromthe tripointin LakeChadto the "fairlyprominent pointedpeak" (theblack line that
you seeonthe map)referredto inparagraph 60 ofthe Thomson-MarchandDeclaration ank dnown
by its commonname of MountKombon,the lineof the boundarywas initiallynegotiatedduring
the First World War by GeorgesPicot and CharlesStrachey. The result was a line, the
Picot-Stracheyline, whichserved asa basisforthe negotiationsat the Peace Conferencebetween
the respectiveColonialMinisters ofthe two powers: LordMilner for the United Kingdomand
Henry Simon for France. The Milner-Simon Declarationfixed the boundary between the two
mandates; itwas signedon 10July 191 9.
5. This Declarationdefined the territorialareas of the mandates entrusted to France and
Great Britain respectively.t is cited in Article1 of the 1922 mandateagreementsfor the two
administering powers; itstext is annexed toeach of the two mandates. The 1946trusteeship
agreements confirmedthe boundary resultinfiomthe Milner-Simon Declaration.
6. The Declaration of 10July 1919 is a fundamental element of the temtorial title
transmitted atthe time of Nigeria's andarneroon'srespective independence. It has remained
unchallengedby the Parties,subjectto Nigeria'srecent stanceon thedelimitationin LakeChad,
whichwewill cometo in a moment. Thereis,moreover,no issuebetweenthe Partiesinregardto
thisposition.1wouldaskthe Cour otakecarefulnote ofthispoint.
7.Doubtless,thedelimitationisnot aperfectone. Thediplomatswhonegotiated it hadlittle
knowledgeof the terrain. They usedthe GermanMoiselmap datingfrombefore the FirstWorld
War. Theywere awareof its imperfections, asArticles2 and 4 of the Milner-Simon Declaration
show2. Moreover, Article 1 of thetwo mandatesprovidesthat the delimitationmay be slightly
modified,either in theinterests ofthe peopleor as a result of inaccuracyin the0,000Moisel
map annexedto the ~eclaration~. Whichdemonstratesthat the Partieswere well aware of the
precariousnatureofthedata onthebasis ofwhichtheboundaryhadbeendelimited.

PaulMarchand,Governor of Cameroon, implemented this provisionof Article 1of themandates,
namely that concerning asubsequentdelimitation. On 29 December 1929and 31 January1930, <t
they produced a provisional delimitationthat was more precise. The Thomson-Marchand
Declarationis annexedto the Exchangeof Notes betweenArthur Henderson, Foreign Secretary,
andthe FrenchAmbassadordeFleuriau,dated9 January1931. That agreementwas approvedand
publishedby bothparties4.
9. Mr. President,youwill notethatthe threedatesof 1929,1930and 1931 correspondto the
three phases of the adoption of a simpleinternational instrument designated sometimeb sy one,
sometimesby anotherofthesedates,accordingtowhetherit is desiredto placethe emphasisrather
onthe delimitationline or onthe legalnature ofthe international obligation.Moreover,this isnot
amatterat issuebetweenus. 1wouldaskthe Courtto take carehl note of this.
10. Soon after the Thomson-MarchandDeclaration, the two Parties established ajoint
commission,in accordancewith the provisionsof Article 2 of the Declaration of 10July 1919.
Thatjoint commissionbeganits workinthe southernsector,that is,startingfiom the sea. Its work
wasinterruptedbythe SecondWorldWarandwasneverrecommencedafter1945.
11. The 1919delimitation isnotperfect, theParties arewellaware ofthis. Thatof 1930is
more precise, though still not perfect. Itwas prepared in relianceon themeans and knowledge
availableat the time. Itis nonethelessbindingbetweenthe Parties,over the entire lengthof the
boundarythusdelimited.
12.ThisCourthas hadoccasiontorule onimperfectordefectivedelimitations. Itisindeed a
ûuism that if a territorial disputeis broughtbefore you,it is becausethe agreed delimitation was
inadequate to resolve the dispute. Yet you have never considered that imperfections in the
2 1 delimitationoperation affectedthe validityof the internationalobligation. In the TempleofPreah
Vihear case, younoted: "There are boundarytreatieswhich dono more than refer to a watershed
line,or to a crestline, andwhich makeno provisionfor any delimitationin additi~n."~And you
did notregardtheerrorthereasvitiatingconsent.

13.Cameroon asksyoutodayto rulethat therewas a conventional delimitationfoundedon
the internationalagreementsof 1919and 1931in the southem sectorof the boundaryming fiom
the tripointto Mount Kombon. Evenif imperfect,thatconventionaldelimitationis bindingonthe
Parties. Cameroonasks you to recognize its tenitonal title, its nght to rely on a conventional
delimitationas establishedby lawfully concludedinternational agreements.
14.Mr. President,why does Cameroonask somethingof you which appearsself-evident?
Becausethat self-evidenceisnotacceptedbyNigeria. Our opponentsdonot challengetherelevant
legal instruments,at least "in principle". "In principle"?Whatdoes that mean? That Nigeria
reserves the right tochallengetheoundarysettlementwhen this suits it. Thus, Nigeriatakesthe
view thatthe treatiesare applicablein principle,but not in the LakeChad sector. Andthatthey
2 2 must be rewritteninthe sectorrunningfiomthe mouthofthe Ebejito MountKombon. Nigeriais
even proposing its own version, in the form of amendrnents to the Thomson-Marchand

16.That does not mean, Mr.President,that boundary treatiesare irnrnutable,that they are
not subjectto clarification,or, whereappropriate,to revision. Moreover,the Thomson-Marchand
line has already undergone subsequent modification i,narticularat thetime of thetwo countries'
accession to independenceand of the attachmentof the southempart of British Cameroonto the
Republic of Cameroon,which had the effect that the Thomson-Marchandline to the south of
MountKombonwasabandoned, beingreplacedbythe old Anglo-Gemanboundaryof 1913.
17.But such territorial modificationsof boundary agreementscan only be the hit of a
mutualdesireto that effect. The ViennaConventionon the Lawof Treaties,whichisauthoritative
in this field, codified the procedures for the arnendrnent oftreaties by agreement betweenthe
parties.
18.A treaty maybe interpretedor clarifiedby a subsequent agreement(Art.31.3(a)), or by
any subsequent practicein the applicationof the treaty which establishesthe agreementof the
parties regarding its interpretation(Art.31.3(b)), or by any relevant rules of internationallaw
applicableinthe relations between theparties(Art.31.3 (c)).Thenurnberof such casesis limited.
19.It is for Nigeriato produceevidenceof such clarificationor modificationof a territorial
settlementagreedin 1931. Nigeriadoesnot providea scintillaof evidence in this regard,eitherin
the LakeChadsectororinthat ofthelandboundaryproper,fiomthe Ebejito MountKombon.
(a) Thelakeboundary
Mr.President,MembersoftheCourt,1now tur to thelakeboundary.
1.General
20. In the Lake Chad sectorthe differencebetween the Parties is fundamental. It relatesto
the very existenceofa conventional settlement.However,before definingthe terms ofthe dispute
in thisregion, 1 shouldgive a quicksummaryof the geographic,hydrographie, institutionaland
politicaldevelopmentsinthe Lake Chadbasin. Haveno fear,1shallbebrief. 21. When,on 10July 1919,Lord Milnerand Henry Simon settledthe delimitationof the
boundary between the two temtories to be administeredby France and the United Kingdom
respectively,Lake Chadwas one ofthe largestinland lakesin A£iica. Its surfacearea was then
about22,772km2accordingto thesurveysbytheLCBC(theLake ChadBasincommission)'. The
life of theriparian people was organized aroundthis natural resource, ofparticular importance
becauseoftheabundanceof fish.
22. Asfiom the 1960sandforvariousreasons,ofwhich1will spareyou thedetails,theLake
started to dry up, shrinking away to such an extent that in 1995 its surface was estimated at
1,744km2,less than one-tenthof its original area. The local inhabitantsnaturally followedthe
changes in the Lake, the fishermenin order to continuetheir work andthe fmers to exploitthe
land thusexposed,the alluvialsoi1of which isparticularlyfertile. This wasespeciallytrue of the
Nigerian inhabitants, nationals of by far the most populous State and also of the State most
seriouslyaffectedby theretreat of the Lake watersby severaldozenkilometres,since today, as a
result of that retreat, Nigeria no longer even has a shorelineon Lake Chad. As demographic
pressure made itself felt,riparian inhabitantsbuilt new villages in the 1970s on land that had
previouslybeen under water. Youwill findan accountofthis processin, inter alia, the Nigerian
pleadings,whereit is describedindetailg.
23. In former times, Mr. President,Nigeria woulddoubtless have pleaded a fundamental
change of circumstances in order to fiee itself of its treaty obligations. However, current
international lawis absolutelyclearon the point:the rebussic stantibus principledoesnot operate
in matters ofterritory. As the Viema Conventionon the Law of TreatiesStatesvery clearlyin
Article62.2 (a):
"A fundamentalchangeof circumstancesmaynot be invokedas a ground for
terminatingor withdrawingfiom a treaty betweentwoor more Statesand oneor more
international organizationifthe treatyestablishesaboundary."
24.And,in the GabCikovo-NagymaroP sroject caseyouyourselvesstated:
"The negativeand conditionalwordingof Article62 of the ViennaConvention
on the Law of Treaties is a clear indication moreoverthat the stability of treaty

25. In my view you were right to stress the importanceof stability in treaty relations. If

been considerable. Indeed, 1am not sure that Nigeria is not trying, by a roundabout route,to
achievethe same ends, narnely to reintroduce therebus sicstantibp urinciple intothe present
proceedings. 1seem tosensea hiddenagendahere, as our Anglo-saxonftiendswould Say - an
argumentthat daresnot speakitsname.
26. In 1964,concurrentlywiththesehydrographic and socialchangesin thearea,theriparian
States created an international organization, theLake Chad Basin Commission,for the joint
managementofthe resourcesof the Lake. You consideredtheinstitutionalandlegalnatureofthat
institutionduring the proceedingson Nigeria's preliminary objections,which relieves me of the
necessity of labouringthe point11. It provided an importantframework for CO-operation.The
LCBCwas entrustedwithvarioustasksaffectingtheeconomyand securityin the region,but also,
asfrom 1983,with demarcationof the boundaryunderconditionsto which1willreturn.
27. Initiallythe settlementof theinhabitantson landmadeaccessibleby the dryingup of the
Lakecaused no insurmountableproblem. Cameroon,the temtorial sovereign authority, exercised
itspowersunderthe conditions describedin ourpleadingsas effectivelyaspossible consistentwith
the nature of a region remote from the major centresof decision-making and difficultof access.
The Cameroonian authorities maderegular administrative tours, designatingtraditional chiefs,
conductingcensuses of the population, levying taxes, organizingelectionsl', setting up polling
stations,conductingvaccination campaigns, regulating publim c arkets, distributingprovisionsin
theeventof shortage,regulating fishing,maintainingpublicorderand administeringjustice. Japan
made no mistake in choosing its partner when it embarked upon amode1 programme of

28. Thepolitical situation worsenedas fiom the mid 1980sfollowing aseriesof incidents
between Cameroonand Nigeria. Tension increased sharply in February1987, when Nigeria
launched a large-scalemilitary operation and annexed the principal localities in the sector,
expelling theCameroonianauthoritiesand settingup a Nigerianadministration. Cameroonwas
outraged bythisshow of force,butdidnot raisethe issueintermsof national sovereigntybecause
at the sametimethe LakeChadBasinCommission was continuing withdemarcation workin the
Lake,a dutyconferredon it by CameroonandNigeria,partiesamongothersto the agreement,and
on the basis of treaties indisputably recognizingthe sovereignty of Cameroon over the said
localities. It was not until the year 1994,Mr.President,that we saw the first claim ofNigerian
sovereigntyover Darak,which led Cameroon to file the Applicationadditional to the initial
Applicationwiththe Court wherebyyou wereseised ofthisaspectof thedisputebetweenthe two
States.
26 29.ThedifferenceintheParties' positionsis fundamental.It tumsontheveryexistenceof a
conventionalterritorialsettlementinLakeChad.
30. As far as Cameroon is concemed, the boundary is delimited in Lake Chad by
international instruments.Thetripointwas fixed evenbeforetheFirst WorldWar by the operation
of variousinternational agreements.Thistripointwas defined bythe Milner-Simon Agreemeno t f
10July 1919 and confirmedby the Thomson-Marchand Agreementof 31January 1930. The
boundarylinewas specifiedin the Agreementof 10July 1919and restatedon 31January1930in
identicalterms: [projecttext]
"The frontierwill startomthe meeting-pointof the three old British, French
andGerman fiontierssituatedinLakeChadin latitude13"05'N andin approximately
latitude14'05'E ofGreenwich.Thencethefiontierwill bedeterminedas follows:

31.Mr.President,1have three comments onthis wording.

Lord Milnerand HenrySimonin thissector".
32. As delimited by the Milner-SimonAgreement,the boundary demarcationtook place
within the framework of the LCBC on the basis of the instrumentscited. Thus IGN France
International,which wasresponsiblefor the work,placed two major beacons,one at the tripoint
[projectphoto], the other at the bipoint [project photo], and 13intermediate beacons. You will
note, Mr.President,that theseare not flimsy orburiedstructures,butsubstantial pillarsvisibleat a
distance eventhough onemaybe mistakenfor another. The recordsandexpertreportspreparedat
thistimeweresigned byNigerian and Camerooniannational expertasndcornrnissioner~'~.
33. Thisboundary is confirrnedby al1the maps available. Letme refer first to the two
officialmapsannexed totheMilner-Simonand Thomson-Marchand~~reements'~. 1mayadd that
al1the maps thatshow a boundarytrace the characteristic straight linefiom the tripoint to the
mouthof theEbeji. Nigeriaitselfreadilyacceptsthis,as is shownby maps Nos.50,5 1,52 and 53
in the atlas annexed to its Counter-Mernorial,illustrating the boundary delimited by the
Milner-Simonand Thomson-Marchand~~reernents". The Partiesare thereforein full agreement
onthis point: the two Agreementsdiddelimit theboundary in LakeChadin 1919and 1930. 1beg
theCourtto takecarefulnoteof this.

There is a conventional delimitation. Cameroon requesttshat this conventionalsettlement in
Lake Chadbe upheldandapplied.
35. Nigeria's position is exactly the opposite of Carneroon's. If 1 have understood it
properly,in Nigeria'sview there is no conventionaldelimitation- or no longer a conventional
delimitation- in Lake Chad. There is no international treaty- or there is no longer such a
treaty- applicablein this sector. Nigeriawill doubtlessgive its views in detail on this subject.
The territorial title putorward by Nigeria in this sector rests on occupation, prescription,
acquiescence, estoppel. The disagreement betweetnheParties is fundamental. The Courtindeed
notedthis in its Judgrnentonthepreliminaryobjections:
"Nigeriadoesnotindicatewhetherornot itagreeswithCameroononthe course
of the boundary or on its legal basis, though clearlyitoes differ with Carneroon
aboutDarak and adjacent i~lands."'~
2 8 36.It is apparenton reading Nigeria's subsequentleadingsthatin the LakeChadsectorthe
disagreementextendsboth tothe legalbasisand to thecourse of the boundary. 1ask youto take
carefulnoteofthis.
37. Before continuing,Mr. President, Members of the Court, allow meto express my
perplexity whenconfiontedwithwhat1willcal1Nigeria'sdanceofthe sevenveils.
38. Let us refer again to the calendar. The Milner-Simon Agreementwas signed on
10July 1919. On23 and 24 March 1999,80years later,GeneralAbacha,the President ofNigeria,
presiding overthe VIIIthSurnrnitof Headsof StateandGovernmentof the LCBCin Abuja,had a
resolution adopted approvingthe technical demarcation documentprepared on the basis of the
1919Milner-SimonAgreement and congratulatedthe cornmissioners,the national experts,the
executivesecretaryandIGNFranceontheir work. President Abacha askedforthe documentto be
signedatthe next LCBCsurnmitat the latest20.Thus,75years afteradoptionofthe Milner-Simon
Agreement,the NigerianHeadof State officiallyconfirmsthe validityof that agreement,and this
on theoccasionof demarcationonthe ground.

to Lake Chad,andthisalmostby chance,in aroundaboutwaythroughdiplomaticcorrespondence.
By Letter of Protest dated 11April 1994~'(Note of 11Apnl), Cameroon's Foreign Minister
protestedagainst theillegaloccupationof thelocalityof KontchabyNigeria. InreplytheNigerian
Embassyin Yaoundéconfirmedthat Kontchaclearly belongedto Cameroon,andadded in passing
thatDarak,whichis not in the samesectorasKontchaat all, "has alwaysbeen partand parcel"of
Wulgodistrict,in ~i~eria~~.Thiswas how Cameroon became aware of Nigerianclaims to Darak
and possibly to Lake Chad. As you know, its reaction was to submit an Application on
6 June 1994additionalto the initialApplicationon 29 March1994,whereby ithadseisedthe Court
of the Bakassi dispute,in orderto extendthe seisin of the Courtto the landboundaryandto Lake
Chad.
40.However,this is merelythe beginning. Thusthecorrespondencereferredonly toDarak.
If 1 am not mistaken,we had to wait for Nigeria's Counter-Memorialto be filed, in May 1999,
80years after the Milner-Simon Agreement,to have notice of the list of villages claimed by
~i~eria~~.
41. This is not quite the end. SinceNigeria stubbomlyrefusedto specifj the boundaryline
that it claimed,Carneroonwas compelled toraisethe matterin itsReply. Citing Vattel,we asked
for "the limits oftemtories" to be marked "clearly andprecisely'"4.Nigeria finallyconsentedto
producea map asa Rejoinderwhichyou willsee now lprojectmap],showing"Nigeria'sClaimin
Lake Chad";this is how, in January2001,82 years afterthe Milner-SimonAgreementif 1 am not
mistaken, Nigena finally disclosed the extent of its appetite. Thismap, as you see, shows
"Nigeria'sboundarywith ~ameroon"~~.Youwill note that in Nigeria'smap thetripoint is shifted
some 25km eastwards. Nigeria adds, doubtless for the benefit ofthe other Lake Chad riparian

43. According to Nigeria and its written pleadings, the LCBC found that there was no
treaiy-baseddelimitationin LakeChad, therebyjustifying territorial acquisitionby other means,
suchasoccupationor acquisitiveprescription.
44. Mr.President,1shall repeat- ad nauseam,if youwill forgiveme - that Article1 of
the Milner-Simon Declaration givesthe geographical CO-ordinateo sf the starting point (the
tripoint),situatesthe endpointon the shore of the lake at the mouth of the Ebeji and states that a
straightlinejoinsthese two points. The Partiesdo not disputethe validity of the Milner-Simon
Declaration; whatis at issueis itsapplicabilityto LakeChad.
45.Nigeria's reasoning, whicisnot easyto follow,canbe reconstructedintothreetheses:
1. The conventional instruments of delimitation concluded before the States obtained
independencemustbeconfirmedafterwards.
2. TheLCBCfoundthattherewas noconventionaldelimitation.
3. Nigeria's occupation ofthe villageson the lake was thereforecanied out in conformiiywith

agreements require confirmation cannot be accepted. It contravenes the rule laid down in
Article15 of the 1978ViennaConventionon successionin respectof treaties. Itconflictswiththe
principleof utipossidetisjuris, whichwasadoptedbythe OrganizationofAfricanUnity inCairo
on 28July 1964andwhose full applicabilityto the Afîicancontinenthas beenrepeatedlyaffïrmed
in yourjurisprudence29. As your Chamberstated in the case concerning the Frontier Dispute
(Burkina Faso/RepublicofMali):
"[This principle]is a generalprinciple,whichis logically connectedwith the
phenomenon of the obtaining of independence, whereverit occurs.
Its obvious
purpose is to prevent the independence and stability of new States being
endar~~ered."~~
48. Obviously,the utipossidetisprincipledoesnot fieeze theboundary. New Statesare fiee
to modifythe boundaryby wayof agreement,in accordancewiththe rules codifiedin the Vienna
Conventionon the Law of Treaties. But requiring confirmationof boundarytreaties concluded
priorto independencewould amountto turningourbackson 50yearsof practiceandjurisprudence
conceminginternationallawinAfiica.

jurisdiction, to rule on the temtorial disputenow involving Cameroonand Nigeria
beforethe Court, a dispute which moreoveridnot asyetexistin 1983."~'
AccordinglyNigeria'sargument mustberejected. Asa result ofthe demarcation work,the LCBC
memberStatesunanimously - 1repeat,unanimously- and repeatedly confirrnedthe validity of
the delimitation instrument, otably theMilner-Simonand Thomson-Marchand Declarations.In
effect,the LCBCspecifiedthe referenceinstrumentsforthis demarcationoperation.
(aa) Specifcationofthe reference instruments
51. Following incidents betweenCameroonand Nigeria, an extraordinarymeeting ofthe
Commissiontookplace in Lagos fiom21 to 23 July 1983~~.Twosub-commissionswerethen set
up and they met from 12 to 16November 1984. Agreement was readily reached betweenthe
experts to adopt "as working documents. .. dealing with the delimitation of boundaries in
LakeChad"variousbilateralconventionsandagreements concludedbetween Germany,France and
the United Kingdom between 1906 and 1931, including interalia- and 1 quote fiom the
sub-commissionreport of 17November1984:

the delimitation instrumentsthus listed. The list of those international agreementswas drawnup
withtheparticipationand approvalof Nigeria's experts.
52.At no timeduring themany LCBCmeetingsheldin theten years between1984andthe
seisinofthe Courtin 1994wasthatlist ofagreementsever questioned or disputed.
(bb)Location ofthe mouthofthe Ebeji
53. As you willrecall, this isthe secondpointof reference, withthe straightline connecting
the two. It raised aproblemfortheParties. Duringa meetingof expertsfrom2to 5March 1988in
N'Djamena, Nigeriaand Carneroonnoted their disagreementon this point. On 1and 2 August
1988,the national comrnissionersmeeting in Maiduguriaskedthe LCBC ExecutiveSecretaryto
conveneameetingofnationalexpertswitha viewto makingrecommendationsasto the locationof
the bipoint defined by the mouth of the Ebeji. The matter was settled a few weeks later in
N'Djamena. The thirty-sixthsessionof the LCBCapprovedthe proposednew CO-ordinatei sn its
resoiutionNo. 234.
54.Mr. President,1shallnotat thispointcomment onthe substantiveissue ofthe locationof
the mouthof the Ebeji;that is a problem to whichwe shallreturn shortly. 1 do howeverwishto
draw the Court's attention to the scope of the Parties' dispute beforethe LCBC in 1988. Both
Parties readily acceptedthe delimitation producedby the Milner-Simonand Thomson-Marchand
Declarationsin Lake Chad, whichwere logical elementsof the overall approach. Clearly, they
offereddifferent interpretationsofthe term"mouth of the Ebeji", which theyhad the rightto do.
AndbothParties tookup the LCBCproposai,acceptingthe midpointsuggestedfirstby theexperts
andthenby the Commission.

55.The demarcationoperation was carried out between 1988 and 1990 by IGN France
International. Aswe have seen,it resultedin the installation oftwoprincipalbeaconsatbothends
of the border in Lakehad and 13 intermediate beacons. By 12February 1990,al1the beacons
were inplace withthe requisitedegreeofprecision,i.e., to the nearest centimetre. The document
was signed by the nationalexperts, includingexperts fiom Cameroonand Nigeria, and by the
Executive Secretaryof the LCBC, on 14February 1990 in jarnen ne na ^or.technical reasons,
final approval of the demarcationoperationon theound was postponed until24 July 1992and
the final reportofthe missionwas signedbyal1the expertson28July in N'Djamena. Thereport
wassubmittedtothe VIIIthSummitof Headsof StateandGovernmentoftheLCBC,heldinAbuja
fiom 23 to 24March 1994. The Surnmitreviewedthe report and, "after a short discussion,the
Headsof Stateapproveditand congratulatedthosewhohad donethew01-k"~~.
56.For 13years, Nigeria CO-operatedin the work of demarcationof the fiontier in the

LakeChad area, without expressing the slightest rese~ation of principle with regard to the
instrumentsof delimitationusedby the LCBC.
57.Nigeria'srefusal,fiom1996 onwards,to rati@the resultof this workin no wayimpugns
the validity of the previous instruments of delimitation dafiom 1919 and 1931. It is a
unilateral attitudeadoptedby one memberState of the LCBC, and not a collectivedecision,still
less an agreement betweenthe two parties toset asidethe delimitation previously between
them. Its refusal is not based on any valid reason for modiqing or terminating treaties. It
highlights how farNigeria has drawnback fiom the demarcation operationcanied out by the
LCBC,as, of course,it wasperfectlyentitledto do. It hasno effecton theprevious delimitation.
(c)Subsequentpractice, recognition, cquiescence
58.The conduct of the Parties, and of Nigeria in particular, confirmedthe conventional
delimitation in therea around Lake Chad. From 1919 onwards,the constant position ofthe
Britishadministration,uringits Mandatefiom 1919 onwards,then its trusteeshipaft1945,was
to recognizetheconventionaloundaryinLakeChad,to acquiescein its course. Thatpositionwas

59. Such an instanceof recognitionoccurredin particularin the context ofthe work of the
Lake Chad Basin Commission. At a technical level, speaking through its experts and
commissioners,thenat a politicallevelthroughits ministers,Nigeria reiteratedatthehighestlevel,
that of Head of State, meeting afier meeting and surnmitafter summit, its acquiescencein the
delimitationestablishedby treatyin 1919andconfirmedin 1930.
60. Until 1987, the conduct of the Nigerian authorities on the ground confirmed their
acceptanceof the conventionalline, despitea smallnwnber of incidents,which didnot, however,
challenge the course of the fiontier. From 1987 onwards, it is true that the invasion of the
LakeChad area by Nigerian armed forces emphasized adivergence betweenthe attitude of the
local authoritieson the ground and that of the federalGovernent at the highest level, in the
context ofits repeated acquiesence withinthe LCBC. However the jurisprudenceof this Court
givespriorityto thewillof the authoritiesrepresentingtheStateinternati~nall~~~.
61.Then thereis the roleplayedby mapsinthis case,on whichouropponentshave hadlittle
to Say. Therearetwooficial maps. Moisel'smapwas appendedtotheMilner-SimonDeclaration
of 1919(show Moisel'smap), here it is with the conventionalboundaryclearly indicated. The
boundarybetweenthetwomandates,representedas an overprint,isshowing its ageand the colours
are no longer clearlyvisible. The same appliesto the map appendedto the Thomson-Marchand
Declaration (show Thomson-Marchand'smap), which is on a smaller scale. Yet there is no
ambiguityin the lineof the boundary, whichyoucan seeat the top ofthe map. Thejurisprudence
of the Courtattributesindisputable evidentiaryvalue to officia1maps,since they form an integral
part oftheinstrumentum,thus sealingthe agreementoftheParties-ontheboundary delimitation.
62. Moreover, the administering power, the United Kingdom, then Nigeria afier

administeringpoweritself underthe supervision of thinternationalorganization.

BeagleChannelcase:

TheArbitralTribunalintheLagunadelDesiertocasemadea similarfinding4'.
65. What is the effectof this ensembleof concordantattitudes adoptedby the British,then
the Nigerian authonties: action on the ground, legal instruments,published maps, positions
adopted duringthe workoftheLCBC?
66. The jurisprudenceof the Courtprimarilytakes accountof such conduct onthe basisof
Article31,paragraph3 (b), of the ViennaConvention,since it demonstratesthe agreementof the
partiesonthe courseofthe boundary,as is thecaseherein regardto Lake ~had~~.This appliesin
particulartoof the positions adoptedby the Nigerianauthoritiesduringthe workofthe LCBC. As
we know,Nigeriaultimatelydidnotrati@the result ofthe demarcationoperation andis therefore
not bound byit. Yet itsconductovera period of 13yearshas to be seenas subsequentpracticein
the applicationof the delimitation agreementof 1919 and1931. Its conductconfirmsthat there
was, betweenthe partiesto those agreements,an identity of viewsonthe existence and thecourse
oftheboundary .

culminatingin the armed attack of 1987,did not challenge its sovereignty over thearea, since
Nigeriawas at the same time participatingactivelyin an international operationto demarcatethe
areawhichconfirmedtheconventionalline,andhence Camerooniansovereignty. Howeve srerious
theincidentswere,Cameroonhadnoreasonto believethat theychallengeditssovereigntyoverthe
disputed villages. The Courtmoreover observed,in its Judgrnenton the preliminary objections,
that "not every boundq incident implies a challenge to the b~undary'*~. At a tense time,
Carneroon wasentitled to believe that Nigeria was nonetheless not challenging its territorial
sovereignty. Cameroonthereforerefiained fromtaking al1the measures to which it wouldhave
beenentitledin light of the seriousnessof the attackin ordertopreserveitsterritorialsovereignty.
And,it il1behovesNigena today,undersuch conditions,to reproachCameroonforitspassivityand
for having waiteduntil 1994to react to a claimofsovereigntyoverDarak.
69. Inanyevent,thecircumstancessurroundingthe demarcationoperations conducted bythe
LCBCexcludeany argument basedon Cameroon'spurportedconsentto Nigeria'sterritorialclaim,
sincethe latter was co-operatingin an operationof demarcationbased on a delimitationwhich
clearlyrecognizedCameroon'sterritorialtitle to thevillagesconcerned.
70. Afortiori, the same holds true of the alleged processof acquisitive prescription. The
occupationof Darak andthe neighbouringvillageswas in nowaypeaceful. Moreover,the animus
dominandi, à titre de souverain44,was notably lacking since,at the sametime, Nigeria's experts
and commissionerswere taking part in a demarcationoperation,contradictingtheir military and
administrativeoccupationof thevillages.

73. However,there isonecase1wouldstress, namelythe occupation of thefisheriestraining
station built with the participation of andded by the Japanese Agency for International
Co-operation atKatti ~ime~~.This exemplaryproduct of CO-operation between Carneroonand
Japan was confiscatedby the Nigerian authoritiesevenbefore the Japanese Co-operation Agency
wasableto installthe necessary equipment.
74. Cameroonmut therefore now addressthe consequencesof this unlawfuloccupationin
terms of international responsibility and seek reparationfiom Nigeria for the injury done to
Cameroon. Professors Corten andThouveninwillput ourcaselaterthis week. So1shallnotdwell
onithere.
75. The eflectivité1havejust referredto are beyond anydoubt eflectivitéscontralegem.
They cannotbe taken into accountfor purposesof establishinga territorialtitle. The Chamberof
your Court clearly explainedthis point in the FrontierDispute case (BurkinaFaso/Republicof
Mali):
"Wherethe act doesnot correspondto the law, wherethe territory whichis the
subject of the dispute is effectively administeredby a State other than the one
possessingthe legaltitle, preference shouldbe given totheholderof thetitle.'*6

3. The courseofthe lakeboundaryandthequestionofthe mouthofthe Ebeji
78. Mr. President1now cometo the question ofthemouth ofthe Ebeji. Asyou haveseen,
the courseofthe conventional linein Lake Chadraisesnootherparticularproblem. Thetripointis
fixed by the treaties concluded prior to 1914. It is defined by the Milner-Simon and
Thomson-Marchand Declarations as "13"05' latitudenorth, approxirnately14'05'longitudeeast
ofGreenwich". Nigeriahas madegreatplayoutof theuseof the adverb"approximately~*7 , hich
is explainedby thefactthatthe frontierliesialake, andby the stateofthe geodesic techniques of
the tirne. The LCBC and IGN France experts have since added precision: 13'05' Oû"0001
latitudeNand 14"04'59'9999 longitude E. Nigeriahasthenproceededto denigratethe excessive
precisionof the figurethus obtained4*.Comenow, ouropponentsmustdecide! They cannotboth
complain ofthe approximate natureof the statementof six months ago and then of the extreme
precisionof its subsequentdetermination..
79. From the tripoint,the boundaryfollowsa straightline as far as the mouth of the Ebeji.
Weknowthatthe straight-linetechniqueis comrnonlyusedfor lakeboundaries.

(a) Theauthoritativeinterpretationofthe1919and1931Declarations
81. Carneroonconsidersthat there hasbeen anauthoritative interpretationof the 1919and
1930Declarations. But what formdoes thehydrographicproblemtake? The Ebeji or El Beid-
both namesare used- rises in Cameroon,south of Maltam. It runs north and flows into Lake
Chad northof Fotokol. It constitutesthe boundarybetweenthe two Statesoverthe greaterpart of
its course. Like manyrivers in the region,the Ebeji floodsduringthe rainy seasonand driesup
duringthe dry season. A few kilometresfromthe formershore of Lake Chad, which-if1may
remindyou - has substantiallyrecededsince1919,the Ebejidividesinto twobranches, a western
branch runningnorth and an eastem branchrunning firstto the east andthen to the north, as you
can seefromthis aerial photographtaken fromthe NigerianRejoinder [slideofmap]. Herearethe

82. The Parties disagreeon which is the principalchannel of the Ebeji andhence on the
locationofitsmouth. Cameroon claims apointsituatedonthewesternbranch; Nigeria claimsone
situatedonthe eastem branch. Atthe LCBCsession from1to 2 August1988,the commissioners
asked the national experts tokeprecise recommendationson the choice of the bipoint. The
experts determined an intermediate point,whose CO-ordinateswere longitude 14"12'11"E,

latitude2"32' 17"4 v9. In theirreport,theexpertsstated: "Thesevaluesare consideredto bethe
49~emorialof Cameroon,Vol.VI,AM. MC286. most probable geographicalCO-ordinates of the mouth of the river Ebeji (El Beid), as it was in
1931." Theexpertsobservedthat thescaleselectedfor the mapannexedto the 1931Report istoo
small, and that the map used is a photocopy and not the original map. They nevertheless
recommendedthat these values be adopted. At the thirty-sixthsessionof the LCBCin Maroua
fiom 30November to 1December 1988, the commissioners approved the experts'
recommendation. In tum, the eighthsurnmitof Headsof Stateand Government at Abujain 1994
approvedthe technicaldocumenton demarcationSO and requestedeachmember Stateto adopt the
documentinaccordancewithits ownlaws.
83. Ithouldbe notedthat thepoint chosenby the nationalLCBCexpertsis a medianpoint
between thepoints claimedby each ofthe Parties. AsNigeriahas rightly observed, thispointoes
not, Mr. President, correspondto thepresentgeographicalmouthof the ~beji''. It is not situated
on either of the two channels of the river. The point indicated on the map annexed to the
Thomson-Marchand Declarationhas been transferredto a contemporarymap. This intermediate
pointmayberegarded asthefmit ofa compromiseintendedtobringthenationalexpertsofthetwo
Parties into agreement. Butthe experts' reportsays nothingabout this. It merely states that the
recommended CO-ordinate"sare consideredto be the most probablegeographicalCO-ordinatesof
themouthofthe riverEbeji,as it wasin 193lWs2.
84. Obviously,theboundarydoesnot stop atthis point, whichiswherethe bipointboundary
marker was placed. Inorderto completethe courseofthe boundary linethus obtained,the straight
linehas to be extendedto its point of intersectionwith the eastemchannelof the Ebeji,then the
courseoftheriverhasto be followedupto wherethe two channelsmeet,orratherbifurcate.
4 2 85. The boundarylines advocatedby the two Parties,and the line proposedby the experts
and endorsed by the LCBC Heads of State and Govemment atAbuja, al1 vary slightly. As
indicated, theangle changesby just a few minutes [slide projection]. The adoptionof one line
ratherthan the other- you see the three lines with the bipoint in the middle- does not

86.Cameroonacceptsthedecisiontakenwithin theframeworkofthe LCBC. It regardsthat
decision, as approved by the Heads of State and Government at Abuja, as an authoritative
interpretationof the agreementsof 1919 and 1931 concerningthe location ofthe mouth of the
Ebeji. It wason that basis thatthe workof demarcationwascarriedout. To callin questionthat
decision,in our view,is to call in questional1the work carriedout at great expenseby the LCBC.
Cameroon considersitselfbound,particularly vis-à-visthe other memberStates ofthe LCBC, by
the Abujadecision. Nigeria'sfailureto ratifythe decisiondoesnot, in Cameroon'sopinion,affect
that agreementinterpretingthe delimitationof 1919-1931,sinceit concems onlythedemarcation.
@) Determinationofthe mainchanneloftheEbeji
87. 1turn now, Mr.President,to the determinationofthe mainchannel of the Ebeji in case
you arenot yet convincedby my arguments. For,Nigeriadeniesthe existenceof anauthoritative
interpretation settlingthe issueby agreementbetweenthe Parties. 1personallydonot believethat
it is in Nigeria'serestto reopen the issue.Butthey neednoadvicefromme! Cameroon accepts
that thedefinitionofthemouthoftheEbejiisa questionthatcanbe raised. The Courtis entitledto
hold, asNigeriaasks,that the mouthof the Ebejimust be thetrue geographicalmouthand notthe
result ofaninterpretationofuncertain authorityarrivedat subsequently.
88. If you decidethat it is necessaryto determinethe geographicalmouth of the Ebejiin
order to giveeffectto the intention ofthe authorsof the 1919Declaration,then you will haveto
determinewhichis the main channelof the Ebeji, choosing betweenthe western branchand the
eastembranchof theriver. Our opponentsagreeon the termsofthis choice andarguein favourof
the easternbranch:

"But the north-east channelis the longer of the two possible channels,has a
well definedcourse,and leads toa moresubstantialoutfall inthe area marked'Pond'
on figs.7.1 and7.2 whereasthe north-westchannelpeters

recent case law, Mr. President, Members of the Court, seems to me to be clear. It leads
unhesitatinglyto the decisionthat themain channelof the Ebejiis in fact the western channel, the
very one recornmendedby Cameroonto the LCBC. This is the thrust of the argument - and 1
wouldstressthat itis a subsidiaryone- that itnowfalls tometo present.
90. Tothatend, 1shallrely primarilyonthe Judgmentyourenderedon 15December1999in
theKasikili/Sedudu Islandcase. 1notethat Nigeriaremainsstrangelyunawareof this Judgment,
eventhough in its Rejoinder,whichis howeverdatedJanuary2001, a goodyear later,it cites the
1966Rio Palena ArbitralAward (AndesFrontiercase)54. However, theEbeji displays features
closer to those of the Chobe, a similar Africanriver in a semi-desert area, than to the Rio
ElCuentroorthe RioPalena.
91 In the Kasikili/SeduduIslandcase, you noted that it was necessary to rely on al1the
applicable criteria in order to identify the main channel (para.30 of the Judgment). In your
Judgrnent,you foundthatthere were - as therearehere - compellingreasons forassumingthat
the situationhad seenno radical changeover the previoushundredyears(para. 31). Youwent on
to explaininparagraph37that:
"The Courtisof the opinionthat thedeterminationof the mainchannelmustbe
made accordingto the low water baseline and not the floodline ... The evidence
shows thatwhen theriver is in flood, theIslandis submergedby floodwater and the
entireregiontakesonthe appearanceof anenormouslal~e."~~
These sarnefeaturesare found in the case of the Ebeji and the Lake Chadarea, which dry up in
periodsof droughtandarefloodedduringtherainyseason.
4 4 92. Youthen, intheKasikili/Sedudu Islandcase, proceededto considerthe followingcriteria
for determiningthemain channel. Those criteria,the ones you exarnined,are: depth(para.32);
width (para.33); flow (para.34); configurationof the channel bed (para.39); navigability
(para.40). And thesecriteria,1wouldrepeat, aretobe appliedduringthelow-waterperiod.
93. Thecriteriaadoptedby Nigeriaon thebasisof theRioPalenadecisionare notthe sarne. .
Nigeria citesthe respective length of the two channels; this is acriterion which you did not

the eastern channel,no "outfall",substantialor otherwise. Thereiszeroj7ow. This at a timewhen
theremust bewaterinthewesternchannel.
95. Mr. President,distinguished Members othe Court, theapplicationof the Court'scriteria
to theinstantcase,duringthe low-waterseasonas isproper,leavesno roomfor doubt. Nor isthere
any needfor anexpertreport,for somethingthat is soblindinglyobvious.
96. Inorderto assesstheposition,itisnecessaryto considerthepoint of bifurcationbetween
thetwochannels. Nigeria'sRejoinderplacesthispointat latitude12"31'45N'~. Let usaccept this
location,which is fine by us. We see that here the westernchannelis the main channel. The
easternchannel is merelyan overflowoutlet and is, moreover,dry duringthe low-waterseason,
whereasthere is water in the main channel. Its function is to drain off water during the flood
season,in accordancewiththe basicprinciplesof hydrologyillustratedon the screen in the sketch
beforeyou [projectdrawing].The westernchannel runs downtowardsthe Lake,while theeastem
channelservesasanoverflowoutletintherainyseason.
97. The longitudinalsectionmeasurements forthe two channels, whichyou cannowproject

the western channel,278.97m for the eastern channel. In otherords,in plain language,the bed
of the western channelthus lies some 1.5m lowerthan that of theeastern channelat the pointof

of bifurcationwhic1took,whereyou see clearlythat thepersonsare in theeastern channe-bed
the main channel according to our fiiends-and wallcingtowards the western channel in the
background- the main channel- whichis still filledwith water.s our visit enabledus to
confirmdevisu somethingwhichwouldindeedappearto be self-evident.
99. Mr.President,distinguishedMembersof the Court,al1the criteriaconvergeto indicate
the western channelas the main channel of the Ebeji, thus making the mouth of the western
channelthegeographicalmouthofthe Ebeji.
100. If you so decide, it will be necessary to identiQ more precisely, for demarcation

purposes, themouth of the western channelso as to establish a boundarymarker there. Your
decision will have the effect of awarding Carneroon sovereigntyover the eastem bank of the
westemchanneloftheEbeji,throughoutitslength.
101.Mr. President,letmesumup ourarguments concerningthe LakeChadsector:
(i) The delimitationin the Lakeadarea is based on theprovisions of the Milner-Simon
Declarationof 19July 1919andthe Thomson-MarchandDeclaration of 31January1930.
(ii) The boundary runs fiom the point indicatedby the CO-ordin13'05 N latitudeand
14'05E longitude.
(iii) Theboundary follows astraightlinefiom thispointup tothemouthofthe Ebeji. (iv) Themouthof the Ebeji islocated atlongitude 14'12'11.7"Eand latitude 12'13'17.4"N,a

Républiquedu Cameroun. Aprèsl'exposéde mon collègue, M. Cot, sur le secteur le plus
septentrional de lafrontièrecommune [projectionde la carteil me revient de vous expliquerla
position du Cameroun au sujet du régimejuridique qui a servi à tracer la frontière depuis
l'embouchure de la rivière Ebeji jusqu'au «pic proéminent))connu sous le nom de«montKombon)). Ce segment s'étend sur prèsde 1200kilomètres. Dansla mesureoù les deux
secteurs ont étédélimitépsar les mêmesinstruments et, de cefait, ont toujours étconsidérés
commeune unité juridique -notamment dans l'étudede frontières internationalesno92 réalisée
par le départementd'Etataméricain-, il est probablementplus exact de dire du secteurdontje
vais vous parler que c'est le deuxième sous-sected'une frontièreunique relevant d'un seul et
même régime.
2. Monsieur le président,il n'est pas dans mon intentionaujourd'huide reprendreou de
commentertous les argumentsdéjàexposéspar les deux Partiesdans leursdiversesécritures.Je
vais exposercinq pointspou. commencer,je préciseraiune foisde plus l'essencedelapositiondu
Camerounau sujetdu secteurde la frontière allant de l'embouchuree larivièreEbejiau sommet
appelé «montKombon)). Ensuite,je démontreraiqu'il existeun différend fondamentae lntre les
deux Parties concernantle régimejuridique applicableàce segment dela ligne frontalière. En
troisième lieu,je vous montrerai comment leNigéria est en train de chercher à modifier
progressivement la naturede l'affaireportéedevantla Courpar le Cameroun,etje mepencherai
brièvementsur lesmotifsqui sous-tendent vraisemblablemensta démarche.Je passeraiensuiteau
quatrièmepoint de monexposé, consistantà examinerla natureet la portéede certainesdifficultés
qui tiennent au régime conventionnel. Enfinm,a cinquième partie consisteraà démontrerque la
Cour ne devrait pas accepterle tracé propospar le Nigériadans sa duplique, carune telle ligne

II. La demande du Cameroun concernant le segment de frontière entre le lac Tchad et le
sommet appelé«mont Kombon))
3. Pour le premierpoint de monexposé,je peux être assezbref: dujour où il asoumis sa
requêteadditionnelle à la Cour, le 6juin 1994, jusqu'à aujourd'hui ême,le Cameroun s'est
toujourslimité trèexpressément àuneseule etunique demande :que la Courconfirmela validité
et l'applicabilitéconstante des instruments juridiques délimitant lafrontière, et que cette
confirmation fasse autorit. elle est la positiondu Cameroun concernantle segmentde frontière
qui va de l'embouchure dela rivièreEbejiau sommetappelé((montKombon)). La Courconnaît
bien la raison de cette demande :en raison de la poussée«démographique»observée dans différents secteurs dela frontièrecommune établie par ladéclarationThomson-Marchand, des
fonctionnairesnigériansont éprouvé le besoin de faire des incursions occasionnellesen temtoire
camerounais, voire d'installer des structures administratives nigérianes sur le sol
camerounais- deux sortes d'agissements qui reflètent la positionp , our le moins ambivalente,
adoptéepar leNigéria à l'égard durégime juridique existant.
4. Prenons un exemple :ainsi que l'a déjàsoulignéhier mon collègueM. Pellet, il est
extrêmementtrompeur de la part du Nigéria detenter d'isoler de son contexte l'expression
((préciser définitivement))tilisée auparagraphe 17J de la requête additionnelledu Cameroun,
pour affirmerque ce dernier «ne demande apparemmentplus))tout ce qu'il demandait dans sa
requêteinitiales8.Le Camerounn'a renoncé à aucune demande. Il se contente-comme il l'a
toujours fait- de prier respectueusementla Cour de dire que la déclaration Thomson-Marchand
délimitebel etbien la frontièreet constituela basejuridique de sadémarcationfuture.
III. Le différendopposantles Parties au sujet de la frontièreétabliepar la déclaration
Thomson-Marchand
5. A partir de là, il est aiséde définirla nature et la portéedu différendqui opposeles deux
Parties ausujetdu régimejuridique établipar la déclaration Thomson-Marchand.Je vaisarticuler
cette deuxièmepartie de mon exposéautour de trois mots clés : indivisibilité,intangibilitéet
immuabilité.
6. Commençonsparl'indivisibilité : Monsieurleprésident,le Camerounsouligneune fois de
plus que la stabilité du régime fiontalier tout entier est menacéedès lors que la validitéet
l'applicabilitéd'un seul de ses élémentssont remises en question. C'est-à-dire que, si la Cour

concluait que la déclaration Thomson-Marchandne peut pas êtreconsidéréecomme la base
juridique du tracé dela frontière dans le lac Tchad, comme le prétendle Nigéria, comment
pourrait-ellene pas statuerdans le mêmesens pour le prolongementde cettefrontièrevers le sud ?
Selon nous,le simple fait queles Partiesne soientpas d'accordsur le tracéde la lignefrontalière
dans le lac Tchad, pour des motifs qui ont des effets du moins en partie- sur l'ensembledu
régimejuridique, confirme qu'un différendles opposeégalementau sujet de la frontièreentre lelac
58VoirDN,par.6.17et6.18. et le «mont Kombon~ :le Cameroun estime que le régimejuridique est indivisible, alorsque le
Nigéria,à l'évidence,pense lecontraire.
7. Passons maintenant à l'intangibilité.ans sa duplique,le Nigériaaffirme -je cite le
paragraphe 6.16- que «[s]'il avait déclaaccepter une délimitationde frontièrequ'il savaitou
croyaitsincèrementnon valable,inexacte,impréciseou dépourvued'effet, leNigéria auraitinduit
la Cou en erreur)). Ce qui me semble particulièrementgrave ici, c'est quele Nigériaveut vous
faire croire que la délimitation de frontière que nous examinons est «non valable)), voire
((dépourvued'effet)). Mêmesi l'on supposeque cette affirmation hâtive ne vise que certaines
partiesde la fiontière-dont la grandemajoritése trouvent dans le secteur quinous intéresse
elle n'en reste pas moins extrêmement alarmante aux yeux du Cameroun.Car elle confirme sans
doute possible que le différend qui opposeles Parties va bien au-delà de l'interprétation de
certainesdispositionsdu régime fiontalier. Le différendtouche au cŒurmême de ce régime : son
existencejuridique en soi. Le Cameroun considèreque le régimejuridique qui déterminesa
frontièrecommuneavec leNigériaest intangible,maisleNigériane partagepascepoint devue.
8. Passons enfin à l'immuabilité. Le Nigéna, lorsqu'il examinedans sa duplique les
dispositions relatives au tracéde la frontière,ne se contente pas d'interpréter la déclaration
Thomson-Marchand. Il entreprendplutôt,comme le professeurPellet l'a déjàsoulignéhier, de la
récrire! A travers les lignes frontalièreset les coordonnéesqui figurent sur l'atlas annexéà sa
pièce,leNigénas'efforcede matérialiser les nombreuses altérationsqu'ilaimeraitvoir apporterau
texte du traité. Je ne tiens pas entrer maintenantdans les détails,mais je me permets de vous
donnersimplementun exemple éloquent [projection de la carte21. Aux termesdu paragraphe 14
de la déclaration Thomson-Marchand,la fiontière en direction du sud doit suivre «une rivière
passant dans le voisinage du village de Limanti (Limani), jusqu'à un confluent situé à
environ2 kilomètres au nord-ouest de ce village)). C'est là une indication précise qui fait
simplement appel à vérificationsur le terrain. Les éléments topographiques visés dans cette
disposition sont facilement repérablesur la carte projetée. Pourtant,au paragraphe 7.30 de sa i

duplique,le Nigériademande à la Cour de réécrirecette disposition, en disant littéralement:ue
«le paragraphe 14 devrait êtreainsi rédigé)). Je me demande sincèrement pourquoicette
disposition devraitdire autre chose que ce qu'elle dit déjà. Le Nigériarépondlui-même à cettequestiondans sa duplique. Je cite : «[u]nefrontièresuivantce parcours concordeavec la position
adoptéepar les gens de l'endroit))et ((Tarmoaet Narki sont l'un et l'autre des villages nigérians
bien établisayant une population nombreuse»59. Ainsi, l'intention du Nigéria n'est pas de
démarquerla ligne établiepar le traité,mais d'en tracerune entièrementdifférente,qui serait
prétendumentconforme à la situationethnique ou démographiquelocale, et ce, mêmesi une telle
ligne est totalement incompatibleavec le texte du traité le paragraphe 14prévoitque la frontière
doit suivre unerivière,mais iln'y a aucunerivièrelà où le Nigériaveut vous fairecroirequ'il yen
a une. Et pour vous le faire croire, il a purement et simplement inventéun cours d'eau sur le
croquis 7.3 de sa duplique. Cela apparaît avec évidencesur la carte no23 de son atlas,
manifestementtiréede celle qui est projetéeici :la rivièreen question est invisible sur cette carte,
qui reproduit lesréalitéstopographiquesdu terrain. Quant aupoint de confluence mentionnédans
cettemêmedispositionqui esticienjeu, il se trouveenréalité au nord-ouesd teNarki, cequi place
ce village entemtoire camerounais [finde la projection]. Monsieurle président,c'est précisément
cette érosion larvédeu régimeconventionnelétabli, àlaquelle selivre systématiquemenl teNigéria,
qui inquiète profondémentle Cameroun et le conduit à demander une confirmation de la ligne
frontalière. Le Cameroun, de son côté, est fermement convaincu que la déclaration
Thomson-Marchand constitueune base solide à partir de laquelletout problèmede démarcation
susceptiblede seposer peut, etdoit, être résolu.
9.Monsieurle président,Madameet Messieursles Membresde la Cour,le Nigéria aaffirmé
reconnaître «en principe)) la validité dela déclaration Thomson-Marchand,mais il ne reste
assurément pas grand-chose de cette reconnaissance. Ainsi que je l'ai démontré,tout
fractionnementdu régimejuridique risquede compromettrelesdispositionsrelatives à la frontière
terrestre au sud dulac Tchad. Nous avons également démontrqé ue ce risque n'étaitni distant, ni
improbable;au contraire, il s'estdéjàmatérialisé dans lesdéclarationsdu Nigéria,qui reproche au
traitéd'êtredépourvude «validité»ou ((d'effectivité)( )quel que soit le sens qu'il donne à ces
termes !). Enfin, le fait que le Nigéria récrit des passages essentielsde la déclaration
5DN, par.7.28et 7.29. Thomson-Marchandconcordeparfaitementavec le manquede respectmanifestedont il faitpreuve
à l'égarddu traitéqui est la sourcedurégimefrontalier.
10.Je me permets de résumer. J'ai voulumettreen évidencedeux choses. Premièrement, il

est nécessaireque la Cour confirme sans tarder, avec toute l'autorité judiciairedont elle est
investie, la validité et l'applicabilité du régime frontalier consacré par la déclaration
Thomson-Marchandde 1930, en ce qui concerne non seulement la frontièrecommune dans le
lac Tchad, mais égalementla longue ligne frontalière qui part dulac en direction du sud.
Deuxièmement, cettenécessité «en soi))-si je puis me permettre de reprendre une expressionsi
chère ànos adversaires- esttotalement indépendantedes questionsrelativeàl'interprétationdu

IV. LeNigéria cherche à transformerl'affaire qul eeCameroun a soumise
11. J'aborde maintenant le troisièmepoint de mon exposé. La demande duCamerounest
trèssimple à présenteretà expliquer, mais1,0ne peutpas en dire autant de la positionréelle du
Nigéria. Celui-cicherche, en se bornantune acceptation«deprincipe))de la frontièredéfiniepar
la déclarationThomson-Marchand, àtransformer totalement l'instanceintroduitepar la requêtedu
Cameroun. Cela consiste notammenta) à obscurcirlademandedu Cameroun, quiest baséesur la
ligne conventionnelle établie par la déclarationThomson-Marchand, le Nigériavoulant nous
entraîner dans un long débat sur lesracéscartographiques;b)à ((passeroutre))aux dispositions
conventionnellesqui sont doncaffaibliespour faire valoirune pratique ultérieure;ransformer
notre affaire de délimitationen une affaire de démarcation. Ceapproche ressort clairement du
troisièmealinéadu paragraphe 6.6 de la duplique, dans lequel le Nigéria recense-jcite- les
«trois raisons principales expliquantle caractèrepeu satisfaisantde ces lignes de délimitation..
a) «les cartes officielles mêmesdu Cameroun indiquent une frontière qui ne correspond
manifestement paspar endroitsavec cellequi est délimitdans les instruments..; b) «lestermes
de cesinstrumentsne reflètentpas lespratiques établiesdepuis longtempsni les accordslocaux..
c) «cesinstrumentsdécriventen maints endroits la frontièreterrestre en des termes quisontsource
de difficultésdèslors qu'on tentede les appliquersurleterrain)). 12.Je dois avouer que cette argumentationme laisse perplex:à supposermêmel'espace
d'un instant que ces allégationssoient fondées,il est difficile de comprendre commentelles
pourraient avoirune quelconque incidence sur la requête du Cameroq uni demandeàla Courde
confirmer la ligne conventionnelleétabliepar la déclaration Thomson-Marchandc,omme cela
ressortdesconclusionsparfaitementclairesénoncées au paragraphe 13.01de la réplique.
13. L'élémenqtui est peut-êtrele plus frappant dans l'argumentationdu Nigéria, c'est la

façon dontilutilise lespreuves cartographiques. CommeM. Cot et d'autresconseilsdu Cameroun
le démontreronp tar la suite, les preuves tirécartesjouent assurémenutn rôle dans la présente
affaire, comme c'est le cas dans pratiquement toutes lesaffaires relatives à des différends
frontaliers,et lajurisprudencejudiciaireou arbitrale enlamatièreest fort riche. Maistel n'estpas
le casdansle contexte qui nousintéresse.Nousn'avonspas nonplusl'intention dedemander à la
Cour d'approuver la ligne figuranstur lescartesprésentéepsar le Cameroun, et,de même,ous ne
pensonspas que les lignes figurantsur les cartesdu Nigériaou sur toute autrecaràl'exception
de cellesqui fontpartieintégrantedurèglement conventionnellui-mêmea ,ienten quelque sortele
pouvoir de ((passer outre)) au régimeconventionnelqui définit le tracéde la frontière. Par
conséquent,le Cameroun estimeque l'examendes cartes auquelle Nigériaveutnous inciter n'est
ni nécessaire,ni suffisant. S'il s'avéraitue certaines des représentationscartographiques du
Cameroun ne concordent pas avec l'une quelconquedes dispositions conventionnelles qui
déterminentle tracéde la frontière,nous pouvons assurer la Cour que le Camerounn'hésiterait
pas àles mettreen conformitéd, anslesplusbrefsdélais, avelaréalitprescritepar le droit. Mais,
Monsieur le président,nous estimons qu'ilva de soi, qu'il est tout bonnementlogique, quedes
représentations cartographiquesqui ne fontpas partie intégrantedu traitélui-mêmene puissent
constituer, contrairementà ce que le Nigériasemble prétendre,l'une «des raisons principales
expliquant le caractère peu satisfaisant de ces lignes de délimitati~n))~é ~tablies dans la
déclaration Thomson-Marchand.
14.De surcroît,en deuxièmelieu,le Camerouns'élève vivementcontrel'argument tendant à
dire quela délimitationde frontièreréaliearun traitépeutparfoisêtre remplacé oeu supplantée
DN, aliné3,par.6.6.parune prétenduepratiqueultérieure. C'est précisément l'érosion la dvéregime conventionnel
pardes mouvementsde populationqui préoccupe au plus hautpoint ledemandeur dans laprésente
affaire. J'aidéjà évoqué l'exemple de Narki, et je pourrais en citer bien d'autres encorLe
Nigéria cherchepar lààdemander àlaCourd'approuveretdecautionneruneoccupation illicitede
temtoire camerounais, contrairementau principe solide qui s'énonceex iniuria non oritur. Je
voudraisenoutrefaireobserverque leNigérian'afourniaucunepreuve à l'appui de sesprétendues
((pratiquesétablies depuislongtemps)),encore moins de ses prétendus((accords locaux)). Le
Gouvernement du Camerounn'a connaissance d'aucunaccord de la sorte que ses autorités
compétentesauraient conclu, et je ne pense pas qu'il failleprécisàrla Cou que les autorités
locales,commec'est lecas dans pratiquement tousles Etats du monde, n'ont absolumentpas le
pouvoirde céderune quelconqueparcelledutemtoire de leurEtat àun Etatvoisin.
15.Troisième élémen e, dernierlieu:il estévidentquele Nigériaveut changerd'enjeuet
transformerune affaire de délimitationen une affaire de démarcation. Comme mon collègue,
M.Pellet, adéjàparléhier decette volontémanifestede transformerradicalement l'affaije peux
me borner à donner deux exemplesqui illustrent ces tactiquesnigérianes etqui concernentla
régionfrontalière enjeu:la questionlitigieuseportant sur l'endroit oùsont situées lesanciennes
bornesfrontièresanglo-allemandeno6, 7 et 8,entrela rivièreHesso etle mont Wamni,correspond
à l'évidenceà un problèmede démarcationet non de délimitation. Cela vaut égalementpourles
longssegmentsde la frontièrequisuiventla ligne departagedeseaux. L'utilisationtrèscourante,
dans les instrumentsjuridiques, de laligne de partagedes eaux comme critèrede délimitatioa
toujours été acceptée comm sueffisant délimiterles frontières,tandis que la localisationprécise,
surle terrain, deladite lignehydrographiquea systématiquement tconsidéréceomme relevantde
ladémarcation. Le Cameround aéjàlonguementparlé de cesquestionscomme d'un grand nombre
dequestionssimilairessoulevéep sarleNigéria danssespiècesécrites.
16.Nousnous permettonsdenousdemanderce quia conduitleNigéria às'écarteràcepoint
desquestionsessentiellesposéespar la requêtedu Cameroun,et à vouloirainsi démantelers,inon
réduireà néant, lerégimeconventionnel existant. La réponseest probablement fortsimple : le
Nigériaveut vous empêcher d'examiner leq suestions qui sont au cŒur de l'affaire que le
Cameroun vous a soumise :tout d'abord,le fait qu'il existeuntraitédélimitantla frontière,quila délimitesur toute sa longueur,depuis letripoint situédans le lac Tchadjusqu'au mont Kombon;
ensuitel'absencede fondementsjuridiquesautorisantàcontester lavaliditéde ce traitéen tout ou
en partieet, enfin, le faitqueledittraitédélimite totalemenlte secteurde la frontièrequiest enjeu.
Etant donné qu'enfin de comptec'est au demandeur de définirl'objet de l'affaire, leCameroun
espère,etest d'ailleursconvaincu,queleNigéria ne parviendaasà égarerlaCour.
V. Regardonsdeplus prèslafrontiére elle-même
17. Permettez-moi d'étudie r présentde plus près, dans cette quatrième partiede mon
exposé,la situation de la frontière elle-mêm. ommele Cameroun l'adéjàexpliqué de façon
détailléepar écritet avec la plaidoirie de M.Cot ce matin, le tracéactuel,jusqu'au sud et au
5 4 sommetgénéralement appellé e mont Kombon, procèdedes dispositionsde ce qu'il est convenu
d'appeler ladéclarationThomson-Marchandde 1930. Cet instrument juridique estquant à lui
fondésur ce qu'on appelle la déclaration Milner-Simon de 191e9t en préciseles termes. Cette
déclaration Milner-Simon,à son tour, faisaitsuità une précédente délimitation opéréàetitre
provisoire, lalignePicot-Stracheyde 1916. Cettesuccessionde traitéstémoignede l'actionmenée
en communpour concrétiserprogressivement la ligne frontière,action qui a eu pour résultat,au
débutdes années trente,de définiren substance la frontière en question, commle'écrivait
M. Henderson àM.Fleuriaudanssa lettredu9janvier 19316'.
18. Ce que la formule signifiait dans la pratique, c'est que les Parties reconnaissaient
pleinement l'uneet l'autre que la situation juridique,en 1931, autorisaitrmaisla création
d'une commissionfrontalièrechargée de démarque sur leterrainla ligne frontièredécritedans la
déclaration Thomson-Marchand. C'est égalemle anptositionqu'adoptele Cameroun. LaFrance et
la Grande-Bretagneétaientbienconscientesque les équipeschargéesdu travailde démarcationse
heurteraientàcertaines difficultéslorsqu'ellestraceraient laligne sur le terrain. Mais ce qui est
crucial aujourd'hui, en particulier aux fins de l'espèce,c'est que, avec l'acceptation de la
déclarationThomson-Marchand l,snégociations sulretracéde lafrontièreen étaient arriàéun
stade ou les Parties estimaientl'une et l'autreque la questionne faisait plus appel au règlement
politique, et pouvait êtreconfiée désormaisà des organestechniques tels que la commission
6'MC,annexe157. frontalière. Le Cameroun est, une fois encore, totalement d'accord avec cette analyse des
décideurs d'autrefois.
19. Dans ce contexte, j'évoquerai simplement les recommandationq sue le directeur du
service cartographiquedu Nigéria a formuléed sans sa lettre du8 juillet 1931 en proposant de
procéder,àpartir des instrumentsjuridiques existants,dontla déclaration Thomson-Marchand,ux
opérationsde levé suivantes
«a) latitudes astronomiques et longitudes radioà des points précis le long dela
frontièreà des intervallesd10 à 15milles;
b) élaboration d'une carte topographique couvrant une bande d'une largeur
de 3 millesde part et d'autrede lafrontièàel'échelled'unpoucepour un mille,
avec courbesde niveau à 50pieds d'intervalle;
c) démarcationde la ligne frontière proprementditeà l'aide debornes de cimentà
des intervalles ne dépassant pas un demi-mille.Le levéde cette ligne pourrait
êtreeffectuésoit par boussole topographiqueà prismes et mètre à ruban, soià
l'aide detachéomètres;

Ce qui ressort clairementde ce ((programme)),c'est que l'on estimaitsuffisantde se fonder sur la
déclaration Thomson-Marchand pour exécutecres travaux purement techniques. Le protocole
no11 du 18mai 1940signépar les commissairesfrançaisetbritanniqueconcernantla ((démarcation
de la fiontière entreles zones du Cameroun placées, respectivement,ous mandat britanniqueet
sous mandat français»63le confirmetrèsnettement:enprocédant aulevéet à la démarcationd'une
partiedela fiontièrequin'est plus pertinente aujourd'hui, la commissionn'avtullementressenti
le besoin de réécrireles dispositions de la déclaration Thomson-Marchand oude s'en écarter
sensiblement. Monsieur le président,Madame et Messieurs les Membres de la Cour, si la
démarcationsur cette base mêmen'a manifestement suscitéaucun problèmemajeur en ce qui
concerne le segment méridional de la frontièreq,ui traverse un terrain assezaccidenté,jene vois

réellementpas pourquoi il en irait autrementdans les régions frontalièresseptentnonales. Il est
donc difficile de croireque la déclaration Thomson-Marchandne constituepas une base valable
des fins de démarcation.C'estpourtant ce dontleNigériaveut vouspersuader.

frontière qui nous intéresse ncadre pas avec la réalitétout d'abord, la frontièrene pose aucun
problèmesur la grande majoritéde sa longueur; ensuite,lorsque le Nigéria prétend que de telles
difficultés existent, celles-ci portentsouvent sur de prétendues inexactitudesdes représentations
cartographiques plutôtque sur de véritablesdifférendsconcernantla délimitation entant quetelle;
et enfin, desdifficultésexistentbien, eneffet,danspetitnombre d'endroits, mais ellesportent à
l'évidencesur desquestionsde démarcationplutôt que dedélimitation.
21. [Projection de la carte 1.] Les caractéristiques topographiques qui déterminen lt
segment de la frontière situé le plus au nord sont tout d'abord, un réseauhydrographique
(rivièresEl Beijd,alia et Dorma),puis une vaste plaine composée principalementde marécages.
Ces zones frontalières,qui s'étirent del'embouchurede la rivièreEbeji, à l'endroit précisépar
M. Cot ce matin, jusqu'au point situé 11"15'approximativement(soit une distance de plus d'un
degré delatitude nord) ne posent aucun problème de délimitation.C'est une démarcation sur le
terrain qui s'imposedans ce secteur, en particulier dansles zones non fluviales. LeCamerounest
convaincu que cette opération n'engendreraaucune difficultéimportante. Aprèsavoir relié les
deuxréseauxhydrographiques, lafrontièresuitencoreunefois le coursd'unerivière, entre11' 15'
et 11"environ. Je préciseque toutes les coordonnéesquej'indique ici sont trèsapproximatives.
5 6 Un autreréseauhydrographique(formépar les rivièresTsikakiri,MayoTiel, BénouéF ,aro et enfin
Mayo Hesso) détermine ensuitela ligne frontière entre0'2' et 9' 5''c'est-à-dire sur une distance
correspondantpresque àun degré de latitude.Si nous considérons enoutre les énormessegments
construitsà partir de la ligne de partage des eaux ou de lignes droites reliant des sommets, en
particulierentre 10"58' et 11"29''puis entre 8"56' et 8'39', et, enfin, vers le bas, entre le point
situé à 7" 48' et lesommet que constitue le ((mont Kombon)) situé à 6' 30', nous allons
nécessairement direpour conclure que,vu lanature desélémentr setenus pour la délimitatide la
frontière,la démarcationne peut susciter de difficultésqu'en très peu d'endroits. [Fin de la

22.Monsieurle président,MadameetMessieurslesMembres dela Cour, unefois deplus, le
Cameroun,je le répète, ne nie pas l'existenced'un différend- au contraire. Toutefois,commeje l'ai expliqué plushaut, ce différend,tout d'abord,ne concernepas la délimitationde la frontière
mais l'applicabilité etl'applicationmêmesdurégime juridique en tant quetel.
23. Quant aux allégations selon lesquelles les cartes camerounaises donneraient une
représentation inexactde la lignefrontière,jene souhaitepas formulerd'observationsà cet égard.
Mêmesi elles étaient exactes-, ce que le Camerounnie fermement- cela ne pourrait pas avoir
d'effet sur le régimede la frontièredéfinidans la déclaration Thomson-Marchandc;es allégations
sontdonctotalementdénuées dp eertinenceenl'espèce.
24. Mais alors comments'expliquent,enfinde compte,les prétenduesambiguïtésrelatives à
la démarcationde la frontière? La principale difficultéque nous rencontrons est l'identification,
sur le terrain, de certainesformationsdécritesdans la déclaration Thomson-Marchand. Citone sn
simplement quelques exemples :quelle est exactement la rivière Kohum dont il est fait étatà
l'article 19de la déclarati?nQuelest le chenalde la rivièreKirawaqu'ilfautretenir, et d'ailleurs
cetterivièrese divise-t-elle effectivementen plusieurschenaux Quel estl'emplacementprécisde
la rivière coulantprèsde Limani? La localisationd'une ligne de partage des eaux demande des
travaux intensifs de recherche hydrologique et autre sur le terrain; mais il s'agit là encore
clairement- j'insiste:clairement- d'une question de démarcation, démarcatioq nui ne saurait
d'ailleurs êtrremplacéepar la simpleindicationsur une carted'une ligne purement hypothétique,
comme le fait le Nigéria. Le traitéfaità deux reprises étatde bornes frontières. Si quelques
décennies- et mêmeprès d'un siècle - plus tard il est difficile de reconstituer l'emplacement
précisde ces bornes sur le terrain, cela ne peut êtreimputéau traitéde délimitation. Et ce n'est
certainement pas la faute de la déclaration Thomson-Marchand si,depuis, des rivières se sont
asséchéesd ,es villagesse sont déplacés,es routesont étabandonnées,et ainsi desuite. Detelles
difficultéslocalesne peuvent querendreincertainleprocessusde démarcation.
5 7 25. Le Camerounne prétendpas que la déclaration Thomson-Marchand soiu tn instrument
de délimitationparfait, dépourvud'ambiguïtée sttoujoursadaptéaux normescontemporaines. Elle
ne l'est certainementpas. Mais, comptetenu de lanature deszones frontalières, des circonstances ,
de sa rédaction,des intérêts propreàschaque puissance colonialedans la régionconcernéepar le
tracé dela ligne, cette déclaration peutêtreconsidéréecomme répondantaux critères techniques
moyens des traitésadoptés à l'époquepour assurerdes délimitations comparables dans des cadres géographiquessimilaires. Certains choix, tel celui fait de renvàyl'article 2à,la description
donnéepar Moisel (à l'échellede 11300000)de la ligne «erronée»de partage des eaux, doivent
être considéréc somme malheureux. En outre, certaines erreurs topographiques mineures
entachent, pour des zones reculées,la définitionde la ligne frontière. Néanmoins, aucun de ces
défauts mineursn'exige une revision du traité. Il conviendrait plutôt de combler au mieux
certaineslacuneset de supprimercertaines incertitudes,tâchequi pourrait facilementêtreconfiée
une commission de délimitation. Il n'appartient certainement pas au Nigériade proposer
unilatéralementà la Cour une ligne qui (s'agissant,par exemple, de la «ligne departage des eaux
de Moisel)))ne trouve aucun fondementdansl'instnimentjuridique. Les efforts communstendant
à régler les difficultés d'interprétationde certaines dispositions de la déclaration
Thomson-Marchand pourraient certes échouer,et l'une ou l'autre question devrait alors être
renvoyée devant laCour afin que celle-ci la tranche définitivement. Le Cameroest favorableà
unetelle solution.
26. La question de la lignefrontièredansla régiondeTipsan/Konchaayantpris une certaine
importance dans l'affaire, ellemérite quel'on s'y attarde. Il est vrai que la description de la
fiontière faite aux paragraphes40à 42 de la déclaration Thomson-Marchandest parfaitement
claire. Ce qui l'est moins toutefois,c'est l'identification surle terrain des formations citées dans
ces dispositions. Desmembresde notre équipejuridique (y compris moi-même) ont eu l'occasion
de visiter la régionen mars2001. [Projectionde la carteno3.1 Nous y avons trouvéune localité
camerounaise assez grande, Koncha, et un lit de rivière asséché, que ist probablement la
rivière Tipsan. Nous avons par contre été incapablede trouver et d'identifier aveccertitude la
route allant de Barà Fort-Lamy,qui n'est probablementplusaujourd'hui qu'unepiste quasiment
invisible. Lors d'un survolen hélicoptère,nous avons, ensuite, identifiéun poste d'immigration
nigérian. Nous n'avons néanmoins paspu observer, depuisl'hélicoptère,d'établissementhumain
véritableàproximitéde ce poste d'immigration - sans mêmeparler d'un village qui mériteraitle
nomde Tipsan. De fait,commecela apparaît clairementsurla photographie aérienne qui constitue
le document no29 dans le dossier qui vous a été remisc,e poste d'immigration est unbâtiment

plutôt isolé.La carte nigériane projetdevantvous le confirme, puisqu'ellene représenteaucun
établissement humaindans la zone en question. Nous avons ensuite emprunté, avecun véhicule tout-temain,l'une des nombreuses pistes partant deKonchaen direction dunord, traverséun lit de
rivière asséché eltà, tout prèsde cette rivière,nous sommes enfinrrivésà un endroit que les
villageois appellent unanimement Tipsan. Ce village se repère facilement sur la carte qui est
projetée. Les pâturagesse trouvent des deux côtésdu cours d'eau; la limite exacte,ouest, n'a
jamais étédéfinie surleterrain. Il en va de mêmpour leshabitants de Koncha :depuisdes temps
immémoriaux,leur bétailpaît tranquillementdesdeux côtés dela rivièreet les ressourcesagricoles
sont exploitéespar la population decette localité, qui setrouve dans une zone qui a toujours été
considéréecomme faisant partie intégrantede 1'Emiratde Koncha. Ce n'est qu'au débutdes
années quatre-vingt-dixque la question de la démarcationdans la régions'est posée,lorsque le
Nigéria aérigé unposted'immigration àcet endroitet a,par là même,étendu pour lapremièrefois
son autoritéétatiquebienà l'ouest. Le Cameroun accepteles formations auxquelles renvoiela
déclaration Thomson-Marchand commebase d'une future démarcationde la frontière. [Fin de la

27. Permettez-moi de résumer brièvementmon quatrième point: la déclaration
Thomson-Marchand fournitune basejuridique suffisantepourla démarcationde la ligne frontière.
Le Camerounne nie pas qu'au cours de cette opérationcertaines difficultés puissentsurgir dans
l'application sur le terrain de la ligne prévuepar la déclaration. Toutefois, ces difficultés
relèveraientde la ((démarcation),tnon de la ((délimitati),e la frontière.
VI. Laligne revendiquéepar le Nigériaestinacceptable
28.Monsieur leprésident,je termineraien exposantles raisons pour lesquellesle Cameroun
estime totalement inacceptable la ligne frontière demandear leNigériadans sa duplique. Le
Nigéria,dans la version qu'il donne de la ligne Thomson-Marchand a) représente,par une ligne
rouge enpointillé,surlesfeuillesde l'atlasjointa duplique,ce qu'ilconsidèreêtrele tracéexact
de la frontière;)ajouteà certains endroits des coordonnéesobtenues par GPS pour concrétiser
plus encore la ligne frontièrealléguée;et, enfin, c)réécritpartiellement les dispositions de la
déclarationde façonàdistillercequ'ilconsidèreêtreleursensvéritableouraisonnable.
59 29. Le Nigéria,en oppositiontotalà sonattitudegénéraleconsistantà affirmerque la ligne
frontièreserait tout saufdéfinitivementfixéepar ladéclaration Thomson-Marchandt,enteprésent de donner l'impression qu'une démarcation n'es mtêmepas nécessaire,parce que, grâce à une
inspection du terrain effectupar les membres de son équipe juridique, il a réussàétablirune
lignelimpide, qu'il demandeà la Courd'approuver. Le Camerounestimepour sa part que la Cour
devraits'abstenir de lefaire,pour plusieursraisons.
30. Tout d'abord,lareprésentation cartographiqude la ligne frontièrequedonnele Nigéria
ne constitue pas seulement une interprétation partialeet hautement discutable de certaines
dispositions de la déclaration Thomson-Marchand- elle est mêmeparfois en contradiction
flagranteavec lestermes de celle-ci. J'en donneraiun exemplele paragraphe29 de la déclaration
décritainsi le tracéde la frontièreuiselle est définiepar le cours duMayo Tiel...jusqu'à son
confluentavec leFaro)). Si l'on regardede plus prèsle confluentde ces deux rivières,on constate
quelatopographie esttotalement dépourvued'ambiguïté ce, que montre bien,par exemple, la carte
nigérianereproduite entant que documentno30 dansle dossier. Il n'est donc guère surprenantque
toutes les cartes disponibles représentta frontière comme passant dansles environs immédiats
de lalocaliténigérianede Bilachi [projectionde la carteno4 dl. J'ai projeté l'extraitpertinent de
lacarteno 10de l'atlas du Cameroun;voustrouverez d'autres élémend tse preuve cartographiques,
d'origine camerounaiseet nigériane,dans les documents no31,32 et 34 du dossier qui se trouve
devantvous. En contradiction flagranteavec cela, la ligne que le Nigériarevendiqueprésentau
moyende cartes reproduitesdans l'atlasjointà sa duplique [projection dela carteno4 el s'écarte
manifestementde cette formation topographique évidente, puisqula frontièrequ'elletrace suun
confluentorientalde la MayoTiel qui coule du sud au nord, et ne sejetàel'évidence pasdans la
rivièreFaro.

frontièrequi ont étabordéslors des précédentes interventiostà ceux qui le seront plus tard, le
segment dont nous allonsà présentdiscuter trouve sa sourceet son fondementjuridique non pas
dans un instrument international, mais dansun texte de droit interne, l'ordonnance britannique
du2 août 1946 adoptéeen conseil. Ce texte décriten détail laligne admise depuis longtemps
commeséparantle Camerounseptentrionalet le Camerounméridional. Parla suite,cette lignefut
reconnue sur le plan internationalcomme constituant l'un des élémendu cadre territorial dans
lequel se déroulèrent,en 1959 et 1961, les plébiscites supervisés par l'organisation des
NationsUnies. Depuis lors, elle marque la frontière entre leNigéria,auquel fut rattachéle
Camerounseptentrional,et le Cameroun,auquelfutrattachéle Camerounméridional.
2. Le Nigériajoue ici un doublejeu. Il admet, tout comme il le fait pour les autres textes
pertinents, que cette ordonnanceadoptéeen conseil délimite lafrontière«en principe))et «en tant
que telle»-une formulation précisément employé pour brouiller les pistes (voir par exemple
DN, p. 285 et 292): le Nigériachercheà nous faire oublier cette reconnaissancede principe en invoquant ce qui constitue selon lui une séried'imprécisionset d'ambiguïtésmineures dans les
textes de base. Il se dit par exempleprêta ce que la Cour accepte ces instruments((sousréserve
qu'ils fassent l'objetdes interprétations, éclaircissementest modifications qui sontjustifiésselon
lui» (DN, p. 313). Il conclut que l'acceptation de la délimitation, notamment celleétabliepar
l'ordonnance,est ((subordonnéeà la nécessité d'interpréterdte préciserces textes))(DN, p. 401)
dans certains secteurs. Ces «insuffisances relevéesdans les textes applicables))suscitent «de

sérieusesdifficultés), it-il (DN, p. 317). Tels sont les moyenspar lesquelsle Nigériachercheen
réalitéfragiliserlerégime de la frontièeans cetterégion.
3. Nous avonsà cet égardplusieurs observationsa formuler. Premièrement,la ligneséparant
la partie septentrionalede la partie méridionaledu Cameroun britanniquefut fixée très tôtpar la
puissancemandataire pourdesraisonsde commodité administrativep ,uisréaffirmée au momentde
la signature de l'accord de tutelle. Deuxièmement,cette ligne fut confirméepar la Commission
permanente des Mandats de la Société des Nations, puis par le Conseil de tutelle del'ONU.
Troisièmement,la mise en Œuvre dela décision àl'origine de cette ligne fut suivie de prèspar la
Commissionpermanente des Mandatset le Conseilde tutelle, les organes de contrôle compétents
pour les questions concernant respectivement les mandats et les tutelles..Quatrièmement,la
pratique de la Commission et du Conseil montre que chaque modification apportéea la ligne
séparantle Cameroun septentrionaldu Cameroun méridional futsoigneusement examinée à la
lumièredes explications fournies. Cinquièmement,l'ONU approuva la partition du Cameroun
britannique en Camerounseptentrionalet en Camerounméridionalsur labasede la ligne internede
lapériode précédant l'indépendancS ei.xièmement,l'ONU et les Etats particulièrementoncernés
reconnurent cette ligne comme constituant la frontière internationale entre le Nigéria et le
Cameroun dans le secteur en question à compter de l'indépendance. Enfin, à l'instar de ceux
concernantles autres segmentsde la frontière,lesdifférendsqui opposentlespartiesne revêtentici
qu'un caractère mineurou local. Ils se rapportenta la difficultéde démarquer surle terrain,à
certainsendroitsprécis, unelignede délimitation préalablement convenueet, rien deplus. s 1.La délimitation convenueet sesconséquences
4. Comme il a été relevél,e Nigériaprétendreconnaître la validité dutexte invoqué parle
Cameroun, en l'occurrence l'ordonnance de 1946 adoptéeen conseil, «en tant que tel» et «en
principe)). Qu'est-ce que cela veut dire ? Il semble qu'il n'y ait entre les parties aucune
contestationquant au texte établissantet définissant la frontiIl n'existe aucun videjuridique
qu'ily aurait lieu de combleà l'aide d'effectivités, colonisu post-coloniales,ou de l'équité.
Nous sommesd'accord sur l'essentielde la délimitation il resàeen tirer certaines conséquences.
Comme la Cour l'a fait remarquer en l'affaire duDiférend territorial (Jamahiriyaarabe
libyenne/Tchad)(C.I.J. Recueil 1994, p. 22)' «[r]econnaître une frontière, c'est avant tout
((accepten)cette frontière, c'est-à-diretirer les conséquencesjuridiques de son existence, la

respecter et renoncer la contester pourl'avenin). Une fois convenue, lafrontièreainsidélimitée
s'impose, faute de quoi«le principe fondamental de la stabilitédes frontières,dont la Cour a
soulignéà maintesreprises l'importance»(ibid.,p. 37) n'auraitaucun sens(voir égalementl'affaire
du TempledePréahVihéarC , .I.J. Recueil1962,p. 34).
5. Tout en acceptantla délimitation figurantdans l'ordonnance-«en principe))et «en tant
que telle)),si j'ose dire-,le Nigériafait étatd'«incertitudes techniques)) et souligne que la
frontièreest l'origineune limite interrégionaou interne. Il fait observerque des frontièresdece
type sont rarement établiesavec le soin qui doit caractériser ladélimitationd'une frontière
internationale (CMN, p. 547-548). Cela est en soi assez discutable. Le Nigéria ditque les
frontières intérieuressont de moindre importance (CMN, p. 548). Il s'agit là encore d'une
généralisationâtive. La ligne préciseséparantles comtésduLancashireet du Yorkshire n'a peut-
être pasune importance extraordinaire, mais peut-onen dire de même,par exemple,de la ligne
séparantlesEtats de NewYork et duNew Jersey ?
6. Lorsqu'uneligneséparedeuxrégimesadministratifsdistincts,tels que ceux envigueur au
Nigériadans la régiondu Nord et la régionde l'Est, on ne sauraià priori la considérercomme
négligeable. Mais nous pouvons aller encore plus loin. La ligne séparant le Cameroun
septentrionaldu Camerounméridionalfut établiedès 1923etnotifiée àla Commissionpermanente
des Mandats, l'organe decontrôle compétent dela Sociétédes Nations (MC, p. 189 et, MC,
annexe 136). Elle fut discutée plusieurs reprisestant au seinde cet organe(MC, p. 194et suiv.) qu'ausein du Conseilde tutellede l'ONU(MC,p. 233et suiv.). Elle constitua égalemenlt'un des
éléments du cadretemtorial dans lequel se déroulèrenltes plébiscitessupervisésparl'ONU. Les
frontières intérieuresont donc une réelleportéeet ne sauraient êtrepurement et simplement
écartées d'emblée s, rtout lorsqu'un systèmeinternational de contrôle est en place. Maisne
s'arrêtentaslestentativesduNigériavisant àébranlerla ligne de délimitation.
7. Le Nigériafait ensuite valoir que, lorsqu'une frontièreinitialement déliàititre de
ligne interne devient une frontière internationale«sans qu'aucune délimitation particulière
supplémentairen'aitlieu, ses imperfectionsaux fins d'une utilisationinternationale commenàent
se faire jour» (CMN, p. 548, les italiques sont d'origine). Il est certes ingénieux d'essayer de
minimiser ainsilavaliditéetle statut d'uneligne de délimitation internationalereconnue.Mais des
subtilités defaçadecomme celle-là deviennentbien souvent des absurditésaprèsun examenplus
poussé. Ce que le Nigériaessaie en réalitéde faire, c'est de jeter le voile sur la distinction

fondamentale et déterminanteentre une frontière convenue et les difficultésposéespar sa
démarcationsurle terrain, puis d'érigerces difficultéslocales en problèmesremettant en question
lavalidité dela lignede délimitationelle-même.
8. Lorsqu'existe un instrument de délimitation,ce qui n'est pas contestéen l'espèce,ses
dispositionssont contraignanteset seuleslespartiespeuvent,parconsentementmutuel,y déroger,
condition bien entendu que l'existence de ce consentement soit établie. Celui-ci ne saurait être
invoqué àpartir d'éléments dpereuve fragilesou inexistants. Leconsentementpeut semanifestàr
travers la pratique ultérieuredes parties, ainsi qu'ilressort clairement,par exemple,de lasentence
arbitrale rendue en l'affaire de Tuba (International Law Reports, vol. 80, p. 244). Toutefois, la
pratique doit être clai, ien établie,incontestéeet d'une durée significative.Une telle possibilité
ne peut qu'êtreexceptionnelleet, commepour toute exception dérogeantà une règlejuridique, la
chargede la preuveincombe àla partie quiprétends'écarterde larègle; s'acquitterde cettecharge
n'estpas chosefacile.

2. L'établissement de laligne
9. Dèslespremierstempsdu mandatsur la partiedu Kamerunallemandse trouvant à l'ouest
de la ligne décritedans la déclarationMilner-Simonde 1919,les autoritésbritanniques estimèrent que la meilleure façon d'administrerla régionconcernée seraitde le faire conjointement avec le
Nigéria. Un rapport présentéau Parlement [MC, annexe 1261 environ deux mois avant,
le22juillet 1922,que le Conseil dela SociétdesNations n'approuvele mandat évoqued'ailleurs
cette approche. S'agissant de la frontière entrele Cameroun septentrional et le Cameroun
méridional,le rapport précisesimplementqu'elleest «bordée[...] au nord, vers 7"de latitude,par
la province nigérianede Muri et le reste de la sphère britannique aujourd'hui rattachéà la
province nigériane deYola))[traductiondu Grefle]. La Commissionpermanente des mandats de
la SociétdesNationsprit actede cerapporten séanceau moisdejuillet 1923(MC,annexe 132).
3. Définitionetconfirmationde lafrontière
10. Une fois le mandat approuvé par la Société des Nationsl,es dispositions
constitutionnelles nécessaires furent arrêtéesr la British Cameroons Order in Council du
26juin 1923(Ordonnanceadoptéeen conseil relative auCamerounbritannique). Lesordonnances
en conseil, Monsieurle président,sont des décretspris par la Couronne, c'est-à-dire avanttout par
6 5 le gouvernement, sur la recommandationdu Conseil privé(Privy Council). Elles relèvent des
pouvoirs législatifs résidueldse la Couronne,en particulier dansle domainedes affairesétrangères
et des territoires dépendants(voir par exemple De Smith et Brazier, Constitutional and
AdministrativeLaw, 1989,p. 153et suiv.).
11. Cette ordonnancede 1923 disposait queles parties du Camerounbritanniques'étendant
au nord de la ligne frontière décritedans l'annexe seraient administrées, sous réservd ees
dispositions du mandat, ((comme si elles faisaient partie des provinces septentrionales du
protectorat [duigéria]))t,andis que les contrées s'étendant audde cette ligne frontière seraient
administrées «commesi ellesfaisaientpartie des provinces méridionales du protectorat)). La limite
entre les deux parties du Cameroun britannique étaitdécritedans l'annexe (MC, annexe 130).
Nous reviendrons ultérieurement surla question des relations entrele Cameroun britanniqueet le
Nigériaà cet égard.[Findela projectionno1.]
12. La frontièreentre le Cameroun septentrionalet le Cameroun méridionalétaitprécisée
dans laNigeria (Protectorate andCameroons)Order in Council,1946 (Ordonnanceadoptéeen
conseil relative au Nigéria(protectorat et Cameroun)). Le paragraphe 1 del'article6 de ce texte énonçaitque les parties du Cameroun britannique setrouvant au nordet au sud de la lignedécrite
en annexede l'ordonnance devraient, sous réserve dsispositionsdu mandat ou de tout accordde
tutelle appelé êtreapprouvé dansun proche avenir par l'organisation des NationsUnies, être
administrées((respectivement en tant que parties intégrantesdes provinces septentrionales et
méridionalesduprotectorat [duNigéria])(MC, annexe181).
13. La ligne séparantle Cameroun septentrionaldu Camerounméridionalétaitdécrite,au
surplus, de manière relativement détailléed,ans la deuxième annexe de l'ordonnance. Les
membres de la Cour la trouveront reproduite dans le dossier d'audienceet peuvent égalementse
reporterà la présenteprojection [projectionno21. Aussi est-il inutile de donner lecture de ce
document, pour important qu'ilsoit. Cette ordonnance constituel'assise juridique dela frontière
camerouno-nigérianedans le secteur correspondant. Elle est donc fondamentaleet déterminante.
La frontière quiest définie conserveun caractèreobligatoire pour les parties intérsant que
celles-ci n'auront pas officiellement modifié cettedélimitationd'un commun accord. [Fin de la

14. La ligne frontièreofficiellement définiedans cette ordonnance de1946 est réaffinnée
dans la Northern Region, WesternRegion and Eastern Region (Definitionof Boundaries)
Proclamation,1954(Proclamation de1954sur la régiondu Nord, la régionde l'Ouest et larégion
de l'Est, portant définition des frontières, annexe 1, troisième partie (secteurN-O))
(MC,annexe202). La ligne de cetteproclamationcorrespondtrèsexactementau tracédéfinidans
l'ordonnance de1946. Cette délimitation est également confirmédens la Nigeria(Constitution)
Order in Council,1954 (Ordonnance adoptéeen conseil relative à la Constitution du Nigéria)
(MC, annexe201), la 1960Northern Cameroon(s AdministrationO) rderin Council(Ordonnance
adoptéeen conseilrelativeàl'administration du Cameroun septentrional(MC, annexe222)'et la
6 6 SouthernCameroons (Constitution O)rderinCouncil(Ordonnanceadoptéeen conseil relative a la
constitutiondu Camerounméridional)(MC,annexe 223).
15.Le 13décembre 1946, l'Assemblée générd as NationsUnies approuve les accords de L
tutelle pour les temtoires du Cameroun respectivementplacéssous administration britanniqueet
fiançaise (MC, annexe 182).Il importede soulignerque le Camerounbritannique et le Cameroun
fiançaisvoient leurstatut detemtoires sousmandat devenir statutdeterritoiressoustutelle46dans le cadre territorialexistant, lequelest en effet réaffirmé, comme l'atlts rapports des
missions de visite conduites par les Nations Unies en 1950 (MC, annexe196) et en 1958
(MC,annexe220).
16. Un examen poussé dela pratique révèleque toute modification qu'il étaitproposé
d'apporterà la ligne frontière séparale Cameroun septentrional du Cameroun méridiona éltait
notifiéeà la Commission permanentedes mandats de la Société desNations, qui en débattait.
Ainsi, le rapport britannique de 1924 fait expressément référencee qu'il présentecommeun
ajustement administratifd'ordremineur concernant la frontière enle nord et le sud, motivépar
des affinitéstribales-la zone de Kaka-Ntem, qui formait l'extrême pointe méridionale du
Camerounseptentrional,ayantété transféréeà la province duCameroun (quideviendrapar la suite
le Cameroun méridional). D'autres ajustementsterritoriauxconcernantdes régionsdu Cameroun
septentrional sontégalement portés à la connaissance de la Commission (MC, annexe 137).
Celle-ciapprouva les dispositions administratives générales pripar les autoritésbritanniques
dans le rapport de sa cinquième session. En 1926, le district de Kentu, qui faisait partie du
Cameroun méridional, est rattachéau Cameroun septentrional pour des raisons expresses
d'affinités tribales et d'opportunité administrative- liée en particulier à des questions
d'accès- et une fois encore, ce changemetst signifiàla Commission (MC,annexe 164).
17. Il est égalementinstructif d'étudierle sort réservéà la proposition qui fut faite de
transférerdu Cameroun septentrional au Cameroun méridional une petitepartie du temtoire
administrédepuis la province de la Bénouéet peuplée deMbembe. La questionest examinéeau
ColonialOffice en 1958, où l'on fait observer que toute suggestion de modificane manquera
pas de compliquer le plébisciteet pourra même aggraver lesdifficultés aux Nationsunies
(MC,annexe208). Il est recommandéde soulever ce point auprèsde la mission de visite des
NationsUnies, qui propose quant à elle qu'il soit procédéà un réexamen deces questions
(MC,annexe220).
18.La questionest examinéeplus avantau seindu Colonial Office(MC,annexe211)et elle
est soulevéedevant la Quatrième Commission des Nations Unies quand celle-ci se réunit
en février1959. Dehauts responsablesdu Cameroun septentrionalet du Cameroun méridional qui
fontpartiede la délégatiobnritanniquesontalors d'avis qu'aucune modificatin'est requiseàcestade (MC, annexe220). La question est évoquéeencore une fois par le représentantdu
Royaume-Unidevant la QuatrièmeCommission,le 5 décembre1959,quandil analyseles résultats
duplébiscite organiséau Camerounseptentrional(MC, annexe219).
19. En somme, la question aura fait l'objet de maints débatsmais ne recevra pas d'autre
.
suite. Autrement dit, la frontière entrele Cameroun septentrional et le Camerounméridionalest
réaffirméetelle qu'elle existe. Qui plus est, cet épisode,ainsi que la légère modificde la
frontièreprécédemmené t voquéeq,ui fut opéréedans l'entre-deux-guerres, révèeue mêmedes
changements mineurs du tracéde la frontièreentre les deux parties du Cameroun britannique
étaientexhaustivementdébattuset notifiésauxorganismes internationaux compétents.Dèslors, il
paraît évident que cettefrontière nepouvait fairel'objet de la moindre modificationsans que cela
s'accompagnedes démarchesvoulues.
20. C'est en gardant ce fait présenà l'esprit que nous examinerons à présentl'un des
argumentsduNigéria,qui affirmeque dansles environsdesvillages de Bang, Lipet Yang, laligne
frontièreaurait étémodifiée par une «décision»eM. JefEey (vers 1941))(DN, annexe 171). Le
Nigéria a produitle procès-verbald'une réuniotenue à Yang le 13août 1953qui y fait allusion.
Cela appelle deux brefs commentaires. En premierlieu, les Parties n'ont verséau dossier aucun
autre document à ce sujet. Le Nigéria a certesprésentéune note en date du 9 novembre1958
adresséeau responsable de districtà Nkamse par le fonctionnaire itinérant de Gembu. Mais
celle-ci ne fait référencequ'à «l'accord du Il août 1953))(DN, annexe 170) dont pas plus les
termes que l'existencemême ne sont attestés.Au cours de laréunionqui se tient deuxjours plus
tardà Yang, il n'est faitaucune mention d'unaccord du Il août. Au contraire, les participants
s'interrogent surce que pouvait recouvrir la délimitatio«de Jeffreys opérée(vers 1941)).En
secondlieu, qu'une tellemodificationde la frontièrene soitpas notifiée'autorité internationale
compétenten'aurait pas étéconforme à la pratique antérieureni, bien sàrcelle qui s'imposera
ultérieurement. En outre, les piècesde procédure écritesproduites par le Royaume-Uni dans
l'affaire du Cameroun septentrionalrenvoyaient à des modifications apportéesà la frontière D
pendant l'entre-deux-guerres,et l'on aurait pu s'attendre qu'il fût pris note du moindre des
changementsallégués,si tant est qu'il y eneut. Là aussi, il est étonnant qu'aucunetrace d'une
discussion ausein du Colonial Office n'ait été produite. ien n'étayela thèsedu Nigériaselonlaquellecet épisode témoignaidt'«unemodification apportéd'un communaccord àl'ordonnance
adoptéeen conseil)). Ç'eût étéune manière plutôt irrégulière d,'ailleurs totalement illicite, de
modifierlestermesd'unetelle ordonnance.
4. Leplébisciteet l'indépendance
21. Commenous l'exposerons ultérieuremenlte , processus qui a conduità l'indépendance
du Cameroun septentrionalet du Cameroun méridional s'estdéroulédans un cadre territorial
clairement défini. A l'issue d'unpremier plébiscite organisé au Camerousneptentrional, il est
décidéde surseoir à la décision. L'Organisation des Nation Usnies prévoitalors un nouveau
plébisciteà la fois au Cameroun septentrionalet au Camerounméridional,offrantàla population
le choixentre lerattachementauNigériaou au Cameroun.
22. Toutefois,ce quiimporte,auxfinsquinousoccupent,c'est deconstaterquela législation
britanniquerelativà la tenuede cesréférendums entérin lecadreterritorialexistantet, partant, la

également confirmép ear les NationsUnies. Ainsi, la description des circonscriptions électorales
établiesen vue du plébisciteau Camerounméridionalqui figure dans le rapport du commissaire
des NationsUnies aux plébiscites(MC, annexe224) correspond à celle qui est annexéeà la
Cameroons Plebiscite Order in Council, 1960 (Ordonnance adoptéeen conseil relative au
plébiscitedu Cameroun septentrional)(MC,annexe221)'laquellereprend,bien sûr, la délimitation
territoriale du Cameroun méridional comprenanlta ligne de 1946. Aprèsavoir pris acte, par sa
résolution1608du 21avril 1961, des résultats du plébisciteet par làmêmed , u cadreterritorial
dans lequel cette consultation aémenée -, l'Assembléegénérale des NationU s nies décidede
mettrefin àl'accordde tutelle. Et, commeje l'ai indiquéhierl,eNigériaa expressément souscti
cette décision dans le cadre d'un accord passéavec la Grande-Bretagne qui est daté du
29 mai 1961.
5. L'indépendanca e transformé lesdélimitationsintérieures enfrontièresinternationales
23. Quandil a acceptéque le Camerounseptentrionallui soit intégrél,e Nigéria s'estfondé
surlesfrontièresdu territoiretel qu'ilexistaitépoqueet tel qu'ilfaisaitl'objetde ladécision de
l'Assemblée générale. R Leyaume-Uninepouvait transmettreauNigéria (àla suite de ladécision desNationsUnies)plus que ce que représentaitréellemenlt Camerounseptentrionaltel qu'ilavait
lui-mêmedéfinice temtoire, et il n'en a pas ététransféré unesuperficie moindre non plus.
Autrementdit, le Camerounméridional aété transféréàla Républiquedu Camerountel qu'il avait

étédéfinidans l'ordonnancede 1946,ni plusni moins,y comprisla lignefrontièreleséparantde la .
partie septentrionale. Le Nigéria a donc hétée tout le temtoire du Cameroun septentrional,tel
qu'il existaitdéjàetavaitédéfini.
24. La transformation d'anciennes limites administratives internes en frontières
internationales lors de l'accession'indépendanceest bien entendu parfaitement conforme au
droit international. C'est ce qu'a affirmé la Cour dans l'affaire Burkina Faso/Mali
(C.I.J.Recueil1986, p. 565-566)' lorsqu'elle a souligàéquel point il importe de protéger la
stabilité etl'indépendancedes nouveaux Etats la suite du retraitde la puissance adrninistrante.
En outre, comme l'a montré leCameroundans son mémoire (p.423 et suiv.), l'exercice effectif
d'activités propresà un souverain dans cette région a confirméson titre conventionnel.
Naturellement, de telles activitésne sauraientfaire plus, puisque le rôle des effectivitésàe limite
corroborerun titre conventionnel. Elles sontnéanmoinsutiles en l'espècemême si ene servent
qu'àapporterune confirmation.
6. Lanaturede lalignede délimitation etles diff~cultéesn matièrededémarcation
25. La frontière internationale décritedans l'ordonnance de 1946 est un exemple très
classique de ce que font les accords de délimitation. Elly esten effet représentéepar des
éléments géographiques comm dees crêtesdemontagne,des fleuves,desrivières etdes routes. La
plupart des élémentssont nommés et assortis de renvois à la célèbrecarte Moisel. Cette
ordonnances'écartepar conséquenttrèspeu du type habituelde traité dedélimitation.Le fait que
la descriptionde certainsdes éléments topographiquesrésentedes ambiguïtésn'estpas non plus
inhabituel. En pareil cas, les problèmes d'intltcal sont réglpar les parties sur le terrainde
sorte que les ambiguïtéssont levées de manière consensuelle.Naturellement, ces difficultésde

définitionne sauraient être exagéréea su point de remettre en cause la base même dela
délimitation. 26.Lesprincipaux élémen tsprendre en compte sont toutd'abordlefaitque la délimitation
est reconnue aussi bien à l'échelon internationaqlue bilatéralet qu'elle a produit une ligne
frontalière;en deuxième lieu, cetligneconstitueun titre conventionnel qui nesauraitêtreannulé
ou contreditpar l'apportd'éléments ultérieu trlss que des effectivitésoudes cartes; en troisième
lieu, laprésencede certainesincertitudesou ambiguïtéssur leplan local n'estpas en contradiction
avec la notion de ligne de délimitation ayantorce obligatoire;et en quatrièmelieu, ce type de
difficultésdoit faire l'objetd'unesolution concertquisoiten outrecompatibleavec l'instrument
de délimitation.
'70 27.LeNigériaa soulevéunemultitudede pointslitigieuxqu'il prétend liés auq xuestionsde
délimitation. Le Camerounne souscrit aucunement à cette démarche,qui vise à regrouper
plusieurs prétenduesambiguïtéspour pouvoir remettre en cause la délimitationmêmede la
frontière.LeNigériaa fourniuneliste decesambiguïtésm , aisnombred'entreelles nerevêtent en
réalitéqu'une importanceminime-le cas de figure parfaitoù l'on fera appel au principe de
minimis. Je vous citerai brièvement deux exemples, portant chacusn ur une des extrémitéd se la
frontièredansce secteur.
28. L'annexe de l'ordonnance d1 e946,qui décrit la frontièren partantde l'ouestjusqu'à
l'est, commenceainsi :«De la borne64 del'anciennefrontièreanglo-allemande,la ligneremonte
la rivièreGamana...» [projectionno31. Cettedescription est problématique. Comm lesoulignele
Nigéria (DN,p. 366et suiv.),cepassageneprécisepas commentrelier la bornefrontièrea la ligne
médianede la rivièreGamana. Laborne frontière64 estsituéesur la rivenordde la rivière,tandis
que les autres bornes frontières pertinentes (6t 65) se trouvent sur sa rive sudIl est en effet
illogique quela lignetraversela rivièrepourrejoindresa rive nord et revienneensuitejusqu'à sa
ligne médianequ'elle vientde traverser. Surce point, le Camerounest très heureuxd'accepter
l'interprétatiodu Nigériaquidit que la lignedevraitpartir dupoint d'intersectionentreune ligne

Le paragraphe60 de la déclaration Thomson-Marchand de 1930 qui décriten détail la frontière
franco-britanniquefaitici référenceà«un pic assez proéminentqui est à l'azimut 17en se plaçant
sur un tumulus.. », tandis que le paragraphe61, le paragraphe suivant,précise leprocessus de
démarcationen ajoutant :«[d]e ce pic, dans lesmonts Hambere ouGesumi,qui est situé à l'estde
la source visible du Maio MFi ou Baban, la frontièrecontinue de suivre la ligne de partage des
eaux,visibledu tumulussur tout sonparcours.. .))
30. L'appellation«mont Kombon))n'estutiliséedansaucun des deux textes. Elle a toutefois
étéemployéepour désigner cepic dans les publicationsd'éminentsauteurs. Le Cameroun n'est
pas particulièrement attaché à cette terminologie, pas plus qu'à l'emploi de la formule
7 1 ((mont1660))utiliséepour la premièrefoisparleNigéria(CMN,vol. II,p. 514). Dans sa duplique,
le Nigériaaffirme à présentque le sommetappelé «montItang))pourrait correspondre à celui qui
est visédu paragraphe60, tout en admettant que sa situation ne correspond pas à ce que dit

31. Ce qui est important, c'est que les instruments de délimitationqui sont pertinentsà
savoir l'ordonnance de 1946 et la déclaration Thomson-Marchand, fournissent eux-mêma essez
d'indications pour qu'il soit possible d'élaborerun arrangement de démarcationqui permette
d'identifierle«pic proéminent))en question. Dansces conditions, iln'y a plus qu'àpasser par un
exercice de démarcationpur et simple pour traduire sur le terrain les descriptions relativement
longues figurantdansles instrumentsqui définissentla délimitation.
32.Monsieurleprésident,MadameetMessieurs les membresdela Cour, il estvrai quenous
avons parléde dificultés d'ordre local quisontminimes, et qui tiennenà une certaine confusion

quant à la traduction exacte sur le terrain des dispositionsretenues d'un commun accord en cequi

concerne la délimitation.Nous l'admettons.Il est possibleque le Cameroun ne sereprésentepas
de manière parfaitementexacte l'endroit précisoù doit être tracéela ligne pour chaque élément
naturel sans exception. En revanche, ce qui est parfaitement exact, c'est qu'il existe une
délimitationde frontière qui a fait l'objet d'un accord,qui fait l'objet d'une reconnaissanceinternationaleet du consentementduNigéria lui-mêmeI.l est inacceptableque ce derniertente de
mettre en doute une ligne de délimitation convenue d'un commun accoredn cherchantà mettre au
premierplan un grandnombre de questionsd'intérê t cal. Les difficultésde démarcation,s'ily en
a, doiventêtreréglées de manière efficaettrèsvite. Lesdifficultésdedélimitation n'existetas
en tant quetelles etnepeuventpasêtrefabriquéesdetoutespièces.
33.La ligne séparantle Camerounseptentrionaldu Cameroun méridional aété tracée par la
puissance administrante et acceptéepar les autoritésinternationales concernées. Cette ligne a
constituéla frontièreentre les deux entités qui ontexercé,conformémentaux instructions des
Nations Unies et sous leurs auspices, leurdroàtl'autodétermination.C'est cette ligne quià la
suite des plébiscites, aconstitué entre leCameroun et le Nigéria lafrontièrereconnue par les
Nations Unies. C'estla délimitation décidde'un communaccord.
