Enquiries have ~iow beeii made in New Yorlc and T am informed that
the Tripartite Statement riras transmitted to thc United Nations Secre-
tariat by the United Kingdom Permanent Delegation orzJune 22 T~ST
together with tlie Wadiington Agreement. The Tripartitc Statement was
not however published by the Secretariat on the ground that it was
(quote) "not registerable" (unquote). Assume this was because thc Tri-
partite Statement was considcred to be in the nature of a unilatcral
declaration of intention on thc part of the Three Governments 'and
therefore as notconstituting an international agreement in thc technical
sense 01 tlie tcrm. It nevertheless appears that the United Kingdom
Gor~crnment took the necessary steps to effect the registration of the
Tripartite Statement liad this instrument becn regarded by the Secre-
tariat as registerable- FITZMAURIÇE.

Governmcnt in the Monetary Gold Case.
When I made my coilcluding speech before the Court on Friday,
May 14, 1 "as in fact aware tllat ail approach to the Foreign Office was
likely to he made by the ltalia~~Embassy in London, though 1 did not
kno~vwliether it had in fact taken place.
What 1 told tlie Court was nevertheless correct because, although this
approacl.1 has heeil macle, the positionisthat Her Majesty's Government
has not respondeci to the approach in the sense of opening with the
Italiail Government any negotiations for a settlernent of this case and,
as 1 told the Court, no such t~egotiations are in fact in progess.
No doubt yoii will talw steps to bring these observations to tlzc notice
of the Court.

of the United Kingdom to the United Nations transmitted the same
Agreement for registration. Thc docurnentatiqn subrnitted by the United
Kingdnm contained in addition to,the text of the dgrcernent itsclfthe
text of an accoiipanying statcrnent wkich (was not provided by the
United States of America. Through. an, oversight, no action was takcn
by the Secretaiiat on the said statement and the Pertnanent Rcpresen-
tativc 01 the United Kingdom was informedl by a Iettcr No. L15G 102 f
6rluzg of 5 July 1951 that the Agreement ~RC Ieen rcgistered by the
United States of Arncricaon 14 June 19j~.il5a result, wlien the Agree-

Aux tcrmes de l'article35, paragraphe 3, de so~ Statut, la Cour fixe
la contribution aux fraisque doit supporter un Ltat qui est partie en
cause mais qui ne contribue pas autrement aux dépensesde la Cour.

La situation viséedans cet article est cellede l'Italie, qua introduit par
requêtel'affaire de I'ormonétaire.
En application de cet article, vu d'une part la pratique de la Cour, et
d'autre part les circonstances de l'esphce, compte tenu des di.penses
causées par l'examen de l'affaire, Cour a fixêle montant de la contri-
bution de I'ltalieà 4.500 dollars dcs Etats-unis.
En vous notifiant ce qui prkct5cle,je vouprie de bien vouloir y donner
la suiterequisc. J'ajoute que la somme en question devrait etre vers& à
New-York, au Bureau des finznces clu Secrétariat des Nations Unies,
