tion, you have transmitted, pursuant to resolution WHA33.16of 20May 1980,a
request for the Court'sadvisoryopinion on twoquestions and, citing Article 103
of the Rules of Court, have informed the Court that the request necessitatesan
urgent answer.
The text of your letter has been drawn to the attention of the Court and will
immediately be notified to Statesin accordance with Article 66of the Statute of
the Court.

French of the resolution in question, the Agreement of 25 March 1951between
the World Health Organization and Egypt, andthe co1lectionof Basic Docu-

Having taken note also that you haveappointed Mr. Claude-Henri Vignesto

however, liketo draw the attention of the Court to the fact that theserecordsare
still provisional and that the speakers have until the beginning of July to revise
them. To date no changes havebeen receivedby the Organization's responsible
unit. With regard to my own intervention, 1 have already made the clerical
changes which were required and this text can be considered as the final one
which will be printed in the.officia1records of the Organization.

enumerated under Section II of the list of documents), has only reached me
today. It wasentirely unknown to mewhen 1referred to the exampleof Unesco

letter enclosed only the short 4-Article Agreement but not the now received
Agreement which, in Article 15,contains a form of revision and termination

15. THE ACTING LEGAL AIWISER TO 'THEDEPARTMENT OF STATE OF THE UNITED
STATES OF AMERICA TO THE DEPUTY-REGISTRAR

In theadvisory proceedings respectingquestionssubmitted to theCourtby the
World HealthOrganization, theconstruction ofahost agreementbetween Egypt
and the WHO is at issue. That agreement isbased in part on the text of the
Headquarters Agreement of 1946between thelnternational Labour Organisa-
tion and Switzerland,which contains a denunciation clause substantially iden-
tical to the provision at issuein the current advisory proceedings. Accordingly,
interpretation of the ILO-Swiss agreement is pertinent to these proceedings.
That interpretation, in theviewoftheUnitedStates,requiresconsideration ofthe
travaux prepumroires, which are contained in a largely unpublished file - an
"informal procès-verbaldes négociations" - kept by the International Labour
Office. The United States plans to cite portions of these documents in its
statement to the Court in these procecdings.
In addition, the United States believesthat the textoan agreement between
the IL0 and Turkey concerning theILO's Manpower Field Officein Turkey.
which is apparently unpublished, is relevant to the Court's consideration of
this case. This document will also be cited in the statement of the United
States.
Accordingly, theUnited States respectfullyrequests that the Court, pursuant
to its Statute and Rules- in particular Rules 57and 69- invite thelntcrnational
Labour Office to furnish to the Court the followingdocuments :

In accordance with Article 65, paragraph 2, of the Statute of the Couand
Article 104of the Rules of Court, the World Health Organization has supplied
the Court withadossierofdocuments considered likelyto throwlightupon these
questions. In certainofthese documents, mention is made of an Agreement of
1I March 1946between the SwissFederal Council and the International Labour
Organisation concerning the legal status of the Organisation in Switzerland,
which, it also appears from the dossier, may have served asa model for the
Headquarters Agreement concluded in 1948-49between WHO and the Swiss
Government ; it further appears that some provisions of this WHO Agreement
may in turn have served asa model for provisions incorporated in other agree-
ments concluded subsequentlyby the WHO, suchas the Agreement betweenthe
WHO and Egypt of 25March 1951, nowbefore the Court.
Having consulted the President, in order that the Court, when it meets to
consider thiscase,may have available to it al1material which might possibly
be found to throw light on the legal questions laid before it for advisory
opinion, 1should appreciate it if you would be so good as to fonvard to the
Registry any documentation available to your Organisation having a bearing
on the negotiation or drafting of the revision, termination or denunciation
