the President of the International Coiirt of Justice had9 December 1992
as the time-limit within which the Iriternational Civil Aviation Organization
(ICAO) may submit to the Court its cibservationsin writing, should the ICAO
Council wish todo so.

The Conventionon International CiviA lviation (Chicago.1944,
Doc 7300/6)has vested the ICAO Council with importantnctionsfor the
settlementof disputes relatingo the Chicago Conventionand Annexes.
Chapter XVIII(Disputesanddefault)of theConvention (Article84 to 88) deals
vith the settlement of disagreemenatnsd Article84 States that "If sny
disagreementbetveen two or morecontracringStates relatingto the
interpretationor applicationof this Conventionand itsAnnexescannotbe
settledby negotiation,it shall,on the applicationof any State concernein
thedisagreementb ,e decidedby theCouncil."A decisionrenderedby theCouncil
in a disputesubmittedunderArticle84 of the Conventioins appealableby the
partieseitharto an ad hoc arbitraltribunalor to theICJ. Furthemore,the
functionsto be assumedby the CouncilunderChapterXVIIEare governed by the
Rulesfor the Settlementof Differenceapprovedby theCouncilon 9 April 1957
and amendedon 10 November1975 (Doc7782/2).
According to the records of the International CiviAviation
Organizationtherehave beenonly three cases consideredby the ICAO Council
under ChapterXVIII of the Chicago Convention: dispubteetween India and
Pakistan (1952), dispute between the United Kingdom and Spain (1969),
disagreementand complaintby PakistanageinstIndia(1971).
A matterwhich couldbe submittedto theCouncilunderChapter XVIII
may alsobe referredto the CouncilunderArticles 54 and55 of the Convention
which doesnot involveproceedings underArticle 84.The Convention does not
envisagechatdecisionsand rec&rmendationosf theCouncilrakenotherwisethan

3. A Report of the fact-findinginvestigation institutied accordance
with thedecisionreferredto inparagraph2 above,waaconsideredby theCouncil
at the 12th. 13th and 14th Meetingof its 125thSessionon 5 and 7December
1988. Duringthe 12th Meeting,theDelegation of theCovernmentof the Islamic
Republic of Iran requested that theattentionof the Council and its

As a result of fts deliberationa.the Council,on 7 December1988. tookthe

4. On 13, 15 and 17 March1989.theCouncilconsideredthe Report of the
investigation team. As a resultof its deliberations, tChoeunciladopted, on
17 Harch1989,a resolution, thteext ciwhichisattached hereto (AttachentC).
The repuest Eroa the Goverment of the IslamicRepublic of Iran
submittedto theExtraordinary Session oftheCouncil heldon 13 and14 July 1988
didnotmake anyreferencetoArticle114 oftheConvention on InternationalCivil
Aviation. Consequentlythe request.was not consideredunder the procedure
outlinedin Chapter XVIIIof that Convention ainn accoidancewith theRulesfor

Civil Aviation, in particularArticles54 and 55. AERIAL INCIDENT
1) The Council duly considered the request by the Ialamic Republic of
Iran concerning the shooting dom, on 3 July 1988, of Iran Air
Airbus A300 on flight II1655;
the Council expreased profound regret over the loss of 290 lives;

3) the Council expreeaed its deepeat aympathy and condolences to the
Govermuent of the Islamic Republic of Iran and to the bereaved
families of the victims of thia tragic event;
4) the Council deplored the use of veapona againet a civil aircraft;
5) the Council reaffirmed the fundamental principle that States nnist
refrain frw resorting to the use of veapons against civil aircraft;
it also appealed to al1 States vhich have not yet done so to ratify,
as soon as possible, the Protocol introducing Article 3 hie into the
Convention on International Civil Aviation; it al60 strongly urged
al1 States to refrain from any action which might jeopardise the
safety of civil aviation in the area;
6) the Council directed the Secretary General to institute an imediate
fact-finding investigation to determine al1 relevant facta and
technicel aspects of the chain of eventa relating to the flight and
deatniction of the aircraft;
7) the Council urged al1 parties concerned to co-operate fully in the
inveat igat ion;
8) the President of the Council and the Secretary General should preaent
a full report to the Council as earIy aa posaible during the
125th Session of the Council in September 1988;
9) the Council directed the Preaident of the Council and the Secretary
General:
(a) to continue their efforts with al1 States concerned for the
earliest possible establishment of suitable arrangements for the
proper CO-ordination of civil flight operations and military
activities vithin the area so as to fully aafeguard the safety of
civil air navigation;
(b) to take al1 necessary measures, in CO-operation with the Statea
concerned, to improve the routing arrangements in the area so as
to facilitate aafe operation of civil air traffic;
(cl to undertake immediately al1 necessary studies for the
improvement of the Standards and Recommended Practices to prevent
the recurrence of such a tragic incident;
(d) the President of the Council and the Secretary General should
report to the'council on the implwentation of (a), (b} and (c}
above as soon as possible. OBSERVATIONSOF ICAO
DECISION OF THE COUNCILOP THE INTEUNA'rIONAL CIVIL AVIATION ORGANIZATION(ICAO)
On the basis of the sumary of! the President of the Council, the Council of
ICAO, at the 14th Meeting (Closed) of the 125th Session on 7 December 1988,
took the following decision:
THE COUNCIL:
1. Recalled its deciaion of 14 July 1988 adopted at its Extraordinary
Session concerning the shooting dom, on 3 July 1988, of Iran Air
Airbus A300 on flight IR655;
2. Received the report of the fact-finding investigation instiruted by
the Secretary General pursuant to that decision of the ICAO Council;
3. Recognized with appreciation thet al1 parties concerned cooperated
fully in thia investigation;
4. Expressed agai~ its profound regret over the 106s of 290 lives and
its deep sympathy and condolences to the Government of the Islamic
Republic of Iran and to the bereaved families of the victims of thid
tragic event;
5. Urged al1 States to take al1 necessary action for the safety of
navigation of civil aircraft, particularly by assuring effective
CO-ordination of civil and military actieitiea;
6. Reaffirmed again the fundamental principle of general international
law that States must refrain from resorting to the use of weapons
against civil aircraft;
7. Appealed urgently to al1 States which have not yet done so to ratify,
as soon as possible, the Protocol introducing Article 3 bi. into the
Convent ion on Internat ional Civil Aviation;
8. Instructed the Air Navigation Commission to study the safety
recmendations contained in the report of the fact-finding
investigation and to report to the 126th Session of the Council on
any measures it considers neceesary so as to prevent the recurrence
of a similar tragic event;
9. Directed the Air Navigation Commission tri examine, upon their
completion, the results of the studies undertaken under
paragraph 9(c) of the Council decision of 14 July 1988;
10. Decided that C-WPf8708no longer has a restricted character; and
II. Decided to include the Report of investigation as required in the
Council deciaion of 14July 1988 in the Work Programme of the 126th

Expressing appreciation for the full CO-operation exteaded to the fact-finding
mission by the authorities of al1 States concerned;
Recalling that the 25th Session (Extraordinary) of the Asaembly in 1984
unanimously recognized the duty of Statea to refrain frw the use of
weapona against civil sircraft in flight;
Reaffirming its policy to condemn the use af weapons against civil
aircraft in flight without prejudice to the provisions of the Charter of
the United Nations;
Deeply deplores the tragic incident which occurred as a consequence of events
and errors in identification of the aircraft which resulted in the
accidental destruction of an Iran Air airliner and the loea of 290 lives;
Expresses again its profound sympathy and condolences to the Government of the
Islamic Republic of Iran and to the bereaved families;
Appeals again urgently to al1 Contracting States vhich have not yet done so to
ratify, as soon as possible, the Protocol introducing Article 3 b& into
the Convention on International Civil Aviation;

soient prises le plus t6t possible des dispositions en vue d'assurer la
coordination voulue entre les vols civils et les activités militaires dans

aérienne civile;

intéress6s, pour améliorer les dispositions relatives aux it in6rairen dans

Sur la base du rlamd du Président du Conseil. à la quatorzihue aéance
(huis clos) de la 125he eeesion, le 7 décembre 1988, le Conseil de I'OACI
a pris la decision suivante :
LE CONSEIL:
1. A rappelé la décision quail avait adoptée le 14 juillet 1988 lors d'une
session extraordinaire consacrée B la question de l'Airbus A300 daIran Air
effectuant le vol IE655 et abattu le 3 juillet 1988;
A reçu le rapport de l'enquête instituée par le Secrétaire général en

3. A reconnu avec satisfaction que toutes les parties intéressées ont coopéré
pleinement l'enquête;

nécessaires pour éviter qu'une pareille traggdie ne se reproduise;
9. A chargé la Commission de navigation aérienne d'examiner les rgsultats des
études entreprises en application du paragraphe 9, alinka cl de la
décision du Conseil du 14 juillet 1988, dès que ces études auront été
achevéen;
10. A dlcidé que la note C-WP/8708 n'est plus un document b diffusion
restreinte;
11. A décidé d'inscrire le rapport d'enquête demandg dans ea dgciaion du

d'erreurs lots de l'identification de l'avion, qui ont abouti $ la
destruction accidentelle d'un svion de ligne d'Iran Air et B la perte de
290 vies humaines;
Exprime iInouveau ses plua iincère# condoleances au Gouvernement de la
République islamique d'Iran et aux familles endeuill&es;
Lance A nouveau un appel urgent 2 tous ïea Etats contractante qui ne l'ont pas
encore fait pour qu'ils ratifientdéi que possible le ProtocoLe ajoutant
I'articIe 3 & B la Convention relative I'Aviatioo civile
internat ionale;
Prend note du rapport de l'enquête instituée par le Secrétaire général et fait
siennes les concLusiona de la Cornmisaion de navigation aérienne au aujet
den recommandations relatives 3 la sécurité qui y figurent;
Prie instormneat les États de prendre toutes le8mesures néceaiaires pour
préserver la aécurité de la navigation aérienne, particulièrement en
assurant une coordinat ion efficace des activités civiles .et des activités
militaires ainsi que l'identificstion précise des aéronefs civils.
