1. 1 have the honour to refer to the proceedings comnced by the
Applicationfiled by New Zealandaeainst France on 9 May 1973 in the case cntitled
NuclearTestsCase (Uew Zeaiarid1Fratice).These proceedingsled to an Order of the
Coun on 22 June 1973 indicatinginterirnrneasures ofprotection and to a Judofnen*
-theCoun of 20 December 1974. KewZealandhas today fileNith the Coun, withinthe
frameworkof the proceedingsbe-n on 9 hlay 1973and in accordance with paragraph
63 of the 1974Judgrnent,a Reauest for an Exarninationof the Situation ansing out of a
proposed actionannouncedbyFrance which will.if camed out, affect the basis of the
1974Judgrnent.
2. As a matter of priority and urgency, NewZealand now additionally
requests the Coun in accordanieuitn .hicle 33 of the General Aa for the Pacific
Senlementof International Disputes,done ar Genevaon 26 September 1928,and Article41 of the Statute of the Courtto indicfurtheprovisionalmeanires to preserve its
righu,pcndingthefin dalcisionofthe CowtintheCase.
RIGHTS TO BE PROTEMD

that wouldbe adverselyaffectedbyentry into the marine environmentof radioactiq
materialin consequenceof the funher tests tcaniedout atMururoa or Fangataufa
Atolls, and (2) the right to the protection and benefit of a properly conductcd
environmentalimpactassessment,
4. Thegroundsonwhichthe funherinterirnmasures are soughtare:
. first that the proponucleartestsuilbreachthe rights referredto in
paragraph3; inpanicular,radioactivematerialmaybe introducedinto the
manne environmentwith ineparable consequences;the informationand
safeguards provided by an environmentalimpact assessment will be
completelydeniedto the Applicant;andthe denialof these rightscannot
be repairedby an) action by France,includingthe paymentof damages,
takenfier the event.

proposed nucleartestsaccordingto accepted internationltandardsand that,
unlessthe assessmentestablishesthar the tests will not give nse to radioactive
contaminationof the manneen~ironment.France refrain from conductingthe
tests;
(3) that FranceandKeu,Zealandensurethat noactionof anykind is taken
whichmightaggravateor exrendthe dispute submittedto the Coun or prejudice
the rightsof the otherPam inrespectof the carryingout of whateverdecisions
theCoun maygiveinthiscase
6. NewZealand is separately requesting the Presidentof the Court to
exercisehisowersundertheRuiespending theexercisebytheCoun ofitspowers.
