Punuant to resolution WHA46.40adopted by the World Health Assembly
on 14May 1993,and in accordance with Article96,paragra2,of the Charter
of the United Nations, Article76ofthe Constitution ofthe WorldHealth Orga-
nization, and Article X, paragraph 2, of the Agreement between the United
Nations and the World Health Organization, 1have the honour ta lay bçfore
the International Court of Justice for its advisory opinion the following
question:
"ln view of the health and environmentalffects, would the use of
nuclear weapons by a State in war or other armednnict be a breach
of iü obligationsnder international law including the WHO Consti-
tution?"

Constïtution de l'Organisation mondialede la Santé etdu paragraphe 2 de
I'ariicleX de l'accordentre l'Organisationdes Nations Unieset l'Organisation
mondiale de la Santé,j'ai l'honneur de soumettrà la Cour internationale de
Justice, pour avisconsultatif, la question suivante:
«Compte tenu des effetsdes armes nucléairessur la santéet l'environne:
ment, leur utilisation par un Etat au cours d'une guerre ou d'un.autre
conflitarméconstituerait-elleune violationde sesobligationsau regarddu
droit international,compris la Constitution de l'OMS?»

The Forty-sixth World Health Assembly,
Bearing in mind the principles laid down in the WHO Constitution:
Noting the report of theirector-General on health and environmental
effectsof nuclear weaponsl;
Recalling resolutionsWHA34.38,WHA36.28and WHA40.24on the effects
of nuclear war on health and health services;
Recognizingthat it has been established that no health service in the world
can alleviate in anv sianificant way a situation resulting from the use of even
one singlenuc~earwe~~on~;
RecallingresolutionsWHA42.26on WHO'Scontribution Iotheinternational
efforts towards susminable devclopmcnt and WHA45.31which draws anen-
lion to the effectson health of enviÏonmental dearadation and recomizina the
short-and long-temi environmentalsequence<ofthe use of nuclearweaeons
that would affect human health for generations;
Recallingthat primary prevention isthe only appropriate meansto deal with
the health and environmental effectsof the use of nuclear weapons2;
Noting the concern of the world health community about the continued
threat to health and the environment from nuclearweapons;
Mindfulofthc roleof WHOasdefincd initsConstitution to an asthcdiren-
ing and coordinating authority on international hcalth work (Article 2 (a,): to
propose conventions, agreementi and regulations (Article 2 (k));to report on
administrative and social techniques affecting public health from preventive
and curative points of view(Artic(p))and to take al1necessary action to
attainthe objectives ofthe Organization (Article 2 (v)):
Realizingthat primary preventionof the health hazards of nuclear weapons
rcauires clarity about the status in international law of their use.and that over
thelast 48eaÏsmarked differencesof ooinion havebeenexvressedbv Member
Statesaboh the lawfulnessof the use Ofnuclear weapons;'

Rappelant la résolutionWHA42.26sur la contribution de I'OMSaux efforts
internationaux en faveur &un développement durable et la résolution

Notant la préoccupation des milieux de la santépartout dans le monde
devant la menace permanente que wnstituent les armes nucléairespour la
santéet I'environnëment :
Considérantoue le rôle de I'OMS telau'ilest définidans sa Constitution est
d'agir en tantq;'autorité directrice et &ordonnatrice, dans le domaine de la
santé,des travaux ayant un caractére international(article 20)): de proposer
des conventions.accords etrédements(article 2kn: de faireconnaîtrelestech-
niques adminiskives et socTaleswn&rnant 13higiènepublique et les soins
médicaux préventifset curatifs (article 2p)): et, d'une maniéregénérale,de
prendre toute mesure nécessairepour atteindre le but assignéàl'organisation
(article 2));
Consciente du fait que la préventionprimaire des risques pour la santé
constituésvar lesarmes nucléairessuvwse de vrécisercommentla auestion de
leurutilisaiion esrenvisagceau regarddu droit'internationalet cours des
quarante-huit derni6res annéesles Etaü Membres ont exprimé desvues très
divergentesquant à la licéide l'utilisationdes armes nucltaires:
1. Décide,conformément à I'article96.2 de la Chartedes Nations Unies, à
I'article 76de la Constitution de l'organisation mondiale de la SantàeI'ar-

2. Requesrs the Dirrnor-General to uansmil this rcsolulion to the Interna-
tional Court of Justice, accompanied by al1documents likely to throw light
upon the question, in accordance with Article 65 of the Statute of the Courf.ticle X de I'accord entre I'Orzanisation des Nations Unies et I'Or~anisation
mondiale de la Santéapprouvépar I'Assembltegtntrale des ~atiork Unies le
15novembre 1947dans sa rtsolution I24(lI), de demander àlaCour intematio-
nale de Justice de donner un avisconsultitif sur la question suivante:
