After deliberation,

Having regard to Article 48 of the Statute of the Court and -o Arti
cles 31, 44, 45, paragraph 2, 48 and 49 of the Rules of Court,

Having regard to the Application filed in the Registry of the Court onf
22 December 2011, whereby the Republic of Nicaragua instituted
proceedings against the Republic of Costa Rica “for violations of

Nicaraguan sovereignty and major environmental damages on its terri -
tory”, contending, in particular, that Costa Rica was carrying out mafjor

works along most of the border area between the two countries along the f
San Juan River, namely the construction of a road, with grave environ -
mental consequences,

Having regard to the Order of 23 January 2012, whereby the Court
fixed 19 December 2012 and 19 December 2013 as respective time-limits
for the filing of a Memorial by Nicaragua and a Counter-Memorial by
Costa Rica,

Having regard to the Memorial and Counter-Memorial filed by the
Parties within the time-limits thus fixed,

Having regard to the two Orders of 17 April 2013, whereby the Court
joined the proceedings in that case with those in the case concerning Cer ‑
tain Activities Carried Out by Nicaragua in the Border Area (Costa Rica▯ v.
Nicaragua), which had been instituted by Costa Rica against Nicaragua
on 18 November 2010 ;

Whereas, at a meeting held by the President of the Court with the rep -
resentatives of the Parties on 22 January 2014, pursuant to Article 31 of
the Rules of Court, the Agent of Nicaragua, citing the wealth of new

material produced by Costa Rica in its Counter-Memorial and the need
for his Government to consider this in depth, in particular by carrying f
out surveys on the ground, asked the Court to authorize the submission
of a Reply by the Applicant and a Rejoinder by the Respondent ; whereas

the Agent of Nicaragua proposed that his Government should be given a
period of approximately ten months in order to prepare its Reply ; and
whereas the Co-Agent of Costa Rica stated that the holding of a second
round of written pleadings was neither necessary nor desirable, since itf
would unduly delay the Court’s decision on the merits in the cases inf

question, and proposed that Nicaragua simply be given the possibility off
filing additional documents in response to the new material supplied bfy
Costa Rica, on the understanding that the latter would have the opportu -
nity to comment on them ;

Having regard to the need for Nicaragua to be able to make, in an
appropriate manner, such observations as it wishes on the new material
produced by Costa Rica, and to the need for the latter to be able to prefs -
ent its views on those observations in identical conditions,

Authorizes the submission of a Reply by the Republic of Nicaragua
and a Rejoinder by the Republic of Costa Rica ;
Fixes as follows the time-limits for the filing of those pleadings :

For the Reply of the Republic of Nicaragua, 4 August 2014 ;

For the Rejoinder of the Republic of Costa Rica, 2 February 2015; and

Reserves the subsequent procedure for further decision.

en faisant en particulier grief au Costa Rica de réaliser, sur la majfeure

partie de la frontière entre les deux pays, le long du fleuve San Juan, de
vastes travaux visant à construire une route et ayant de graves con -
séquences pour l’environnement,

Vu l’ordonnance en date du 23 janvier 2012, par laquelle la Cour a fixé
au 19 décembre 2012 et au 19 décembre 2013, respectivement, les dates
d’expiration des délais pour le dépôt d’un mémoire parf le Nicaragua et
d’un contre-mémoire par le Costa Rica,

Vu le mémoire et le contre-mémoire dûment déposés par les Parties
dans les délais ainsi fixés,

Vu les deux ordonnances en date du 17 avril 2013, par lesquelles la
Cour a joint les instances dans la présente affaire et dans celle rfelative à
Certaines activités menées par le Nicaragua dans la région frontalière
(Costa Rica c. Nicaragua), qui avait été introduite par le Costa Rica
contre le Nicaragua le 18 novembre 2010 ;

Considérant que, au cours d’une réunion que le président de fla Cour a
tenue avec les représentants des Parties le 22 janvier 2014, en application
de l’article 31 du Règlement, l’agent du Nicaragua, invoquant l’abon -

dance des nouveaux éléments de preuve fournis par le Costa Rica dans
son contre-mémoire et la nécessité pour son gouvernement de les exami -
ner en profondeur, notamment en menant des études sur le terrain, a pfrié
la Cour d’autoriser la présentation d’une réplique du demandeur et d’une

duplique du défendeur ; et que l’agent du Nicaragua a proposé qu’un
délai d’environ dix mois soit alloué à son gouvernement pourf la prépara -
tion de sa réplique; et considérant que le coagent du Costa Rica a indiqué
que la tenue d’un second tour de procédure écrite n’était ni nécessaire ni
souhaitable, au motif qu’elle retarderait indûment la décision fde la Cour

sur le fond des affaires en cause, et a proposé qu’il soit simplfement donné
au Nicaragua la possibilité de déposer des documents additionnels fen
réponse aux nouveaux éléments de preuve fournis par le Costa Rifca, étant
entendu que ce dernier aurait la possibilité de les commenter ;

Compte tenu de la nécessité, pour le Nicaragua, de pouvoir formulefr de
façon adéquate toutes observations qu’il souhaite sur les nouvefaux élé -
ments de preuve produits par le Costa Rica et, pour ce dernier, de pou -
voir faire valoir ses vues sur lesdites observations dans des conditionsf

identiques,

Autorise la présentation d’une réplique de la République du Nicaragufa
et d’une duplique de la République du Costa Rica ;
Fixe comme suit les dates d’expiration des délais pour le dépôt fde ces

pièces de procédure :
Pour la réplique de la République du Nicaragua, le 4 août 2014 ;

Pour la duplique de la République du Costa Rica, le 2 février 2015 ;
