The International Court of Justice,

Composed as above,

After deliberation,
Having regard to Article 48 of the Statute of the Court and to Arti
cles 31, 44, 45, paragraph 1, 48 and 49 of the Rules of Court,

Having regard to the Application filed in the Registry of the Court on
22 december 2011, whereby the Republic of Nicaragua instituted pro -
ceedings against the Republic of Costa Rica “for violations of Nicar-f

guan sovereignty and major environmental damages on its territory”,
referring to “Costa Rica’s construction of a road running parallel . . . to
the southern bank of the [San Juan] river” and posing “[t]he most fimme
diate threat to the river and its environment” ;

Whereas on 22 december 2011 a certified copy of the Application was
transmitted to the Republic of Costa Rica ;

Whereas the Republic of Nicaragua has appointed H.E. mr. Carlos J.

Argüello gómez as Agent ; and whereas the Republic of Costa Rica has
appointed H.E. mr. Edgar Ugalde Alvarez as Agent and H.E. mr. Jorge
Urbina Ortega and mr. Sergio Ugalde as Co-Agents ;

Whereas, at a meeting held by the president of the Court with the rep -
resentatives of the parties on 19 January 2012, the latter expressed the
views of their respective governments regarding the time-limits that
were necessary to prepare the first round of written pleadings ; whereas
H.E. mr. Carlos J. Argüello gómez, Agent of Nicaragua, indicated that

his government would be in a position to file its memorial in the case at
the end of 2012; and whereas H.E. mr. Jorge Urbina Ortega, Co-Agent of
Costa Rica, expressed his government’s agreement to such a time-limit,
as long as Costa Rica was afforded an equivalent time-limit for the filing
of its Counter-memorial ;

Taking into account the agreement of the parties,

Fixes the following time-limits for the filing of the written pleadings :

19 december 2012 for the memorial of the Republic of Nicaragua ;
19 december 2013 for the Counter-memorial of the Republic of Costa

Rica ; and
Reserves the subsequent procedure for further decision.

sand and twelve, in three copies, one of which will be placed in the
archives of the Court and the others transmitted to the government of
the Republic of Nicaragua and the government of the Republic of Costa

La Cour internationale de Justice,

Ainsi composée,
Après délibéré en chambre du conseil,

Vu l’article 48 du Statut de la Cour et les articles 31, 44, 45, para
graphe 1, 48 et 49 de son Règlement,

Vu la requête enregistrée au greffe de la Cour le 22 décembre 2011, par
laquelle la République du Nicaragua a introduit une instance contre lfa
République du Costa Rica « pour violations de la souveraineté du Nica
ragua et dommages importants à l’environnement sur son territoire », en

se référant à la « construction par le Costa Rica d’une route qui suit un
tracé parallèle à la rive méridionale du fleuve [San Ju» et constitue
«[l]a menace la plus immédiate pour [celui-ci] et son environnement »;
Considérant que, le 22 décembre 2011, une copie certifiée conforme de

la requête a été transmise à la République du Costa Rica ;

Whereas the Republic of Nicaragua has appointed H.E. mr. Carlos J.

Argüello gómez as Agent ; and whereas the Republic of Costa Rica has
appointed H.E. mr. Edgar Ugalde Alvarez as Agent and H.E. mr. Jorge
Urbina Ortega and mr. Sergio Ugalde as Co-Agents ;

Whereas, at a meeting held by the president of the Court with the rep -

Considérant que la République du Nicaragua a désigné comme afgent

S. Exc. m. Carlos J. Argüello gómez; et que la République du Costa Rica
a désigné comme agent S. Exc. m. Edgar Ugalde Alvarez et comme
coagents S. Exc. m. Jorge Urbina Ortega et m. Sergio Ugalde ;

Considérant que, au cours d’une réunion que le président de fla Cour a
tenue avec les représentants des parties le 19 janvier 2012, ceux-ci ont
exposé les vues de leurs gouvernements respectifs quant aux délaisf néces -
saires pour la préparation des premières pièces de la procédure écrite ; que
S. Exc. m. Carlos J. Argüello gómez, agent du Nicaragua, a indiqué que

son gouvernement serait en mesure de déposer son mémoire en l’afffaire à
la fin de l’année 2012 ; et que S. Exc. m. Jorge Urbina Ortega, coagent du
Costa Rica, a exprimé l’accord de son gouvernement quant à un tel déflai,
pour autant qu’un délai égal soit accordé au Costa Rica pour le dépôt de
son contre-mémoire ;

Compte tenu de l’accord des parties,

Fixe comme suit les dates d’expiration des délais pour le dépôt fdes
pièces de la procédure écrite :

pour le mémoire de la République du Nicaragua, le 19 décembre 2012 ;
pour le contre-mémoire de la République du Costa Rica, le 19 dé -

cembre 2013 ;
Réserve la suite de la procédure.

Fait en anglais et en français, le texte anglais faisant foi, au palais de la
paix, à La Haye, le vingt-trois janvier deux mille douze, en trois exem -
plaires, dont l’un restera déposé aux archives de la Cour et lefs autres
seront transmis respectivement au gouvernement de la République du
Nicaragua et au gouvernement de la République du Costa Rica.
