ORDER
Present: President Owada; Vice‑President Tomka; Judges Koroma,
Al-Khasawneh, Simma, Abrahafm, Keith, Sepúlveda-Amor,
Skotnikov, Cançado Trindade, Yusuf, Greenwofod, Xue,
Donoghu e; Registrar Couvreur.
The International Court of Justice,
Composed as above,
After deliberation,
Having regard to Article 48 of the Statute of the Court and to Arti
cles 31, 44, 45, paragraph 1, 48 and 49 of the Rules of Court,
Having regard to the Application filed in the Registry of the Court on
18 November 2010, whereby the Republic of Costa Rica instituted pro
ceedings against the Republic of Nicaragua in respect of a dispute-con
cerning certain activities carried out by Nicaragua in the border area,
Having regard to the request for the indication of provisional measures f
submitted by Costa Rica on the same date, and the Order by which the
Court indicated provisional measures on 8 March 2011;
Whereas, at a meeting held by the President of the Court with the rep
resentatives of the Parties on 29 March 2011, the latter expressed the
4346 certain activities (ofrder 5 IV 11)
views of their respective Governments regarding the time-limits that were
necessary to prepare the first round of written pleadings; whereas the
Co-Agent of Costa Rica requested a time-limit for the preparation of the
Memorial of six months, starting from the date of the Court’s decisiofn;
and whereas the Agent of Nicaragua indicated that his Government
requested a period of twelve months from the filing of the Memorial for f
the preparation of its Counter-Memorial, but was ready to accept that a f
shorter time-limit be fixed for the filing of each Party’s written pleading,
provided that the period be more than six months;
Taking account of the views of the Parties,
Fixes the following time-limits for the filing of the written pleadings:
5 December 2011 for the Memorial of the Republic of Costa Rica;
6 August 2012 for the Counter-Memorial of the Republic of Nicara -
gua; and
Reserves the subsequent procedure for further decision.
Done in English and in French, the English text being authoritative, at f
the Peace Palace, The Hague, this fifth day of April, two thousand and
eleven, in three copies, one of which will be placed in the archives of fthe
Court and the others transmitted to the Government of the Republic of
Costa Rica and the Government of the Republic of Nicaragua, respec -
tively.

Après délibéré en chambre du conseil,
Vu l’article 48 du Statut de la Cour et les articles 31, 44, 45, para
graphe 1, 48 et 49 de son Règlement,
Vu la requête enregistrée au Greffe de la Cour le 18 novemb2010,
par laquelle la République du Costa Rica a introduit une instance conftre
la République du Nicaragua au sujet d’un différend relatif àf certaines
activités menées par le Nicaragua dans la région frontalièref,
Vu la demande en indication de mesures conservatoires présentée pafr le

Costa Rica à la même date, et l’ordonnance par laquelle la Cour a indi
qué des mesures conservatoires le 8 mars 2011 ;
Considérant que, au cours d’une réunion que le président de fla Cour a
tenue avec les représentants des Parties le mars 2011, ceux-ci ont

exposé les vues de leurs gouvernements respectifs quant aux délaisf néces-
saires pour la préparation des premières pièces de la procédure écrite ; que
le coagent du Costa Rica a sollicité, aux fins de la préparation dfu mémoire,
un délai de six mois à compter de la décision de la Cour ; et que l’agent du
Nicaragua a indiqué que son gouvernement souhaitait pouvoir disposer
d’un délai de douze mois à compter du dépôt du mémoiref pour la prépa -
ration de son contre-mémoire, mais était prêt à accepter qu’fun délai plus
court, mais supérieur à six mois, soit fixé pour le dépôtf par chacune des
Parties de ses écritures ;
Compte tenu des vues des Parties,
Fixe comme suit les dates d’expiration des délais pour le dépôt fdes
pièces de la procédure écrite :
Pour le mémoire de la République du Costa Rica, le 5 décembre 2011 ;
Pour le contre-mémoire de la République du Nicaragua, le 6 août 2012 ;
Réserve la suite de la procédure.
Fait en anglais et en français, le texte anglais faisant foi, au Palafis de la
Paix, à La Haye, le cinq avril deux mille onze, en trois exemplaires, dont
l’un restera déposé aux archives de la Cour et les autres seronft transmis
respectivement au Gouvernement de la République du Costa Rica et au
Gouvernement de la République du Nicaragua.
