ORDER

The President of the International Court of Justice,

Having regard to Article 48 of the Statute of the Court and to
Article 44, paragraphs 3 and 4, of the Rules of Court,
Having regard to the Order of 17 June 2004, whereby the Court fixed
10 December 2004 and 10 June 2005 respectively as the time-limits for the
filing of the Reply of the Republic of the Congo and the Rejoinder of the

French Republic;
Whereas, in a letter dated 2 December 2004 and received in the
Registry on the same day by facsimile, the Agent of the Republic of the
Congo referred to a decision of the First Prosecution Chamber of the

Court of Appeal of Paris, handed down on 22 November 2004, of which
he supplied a copy, and asked the Court, for the reasons explained in that
letter, to postpone until 10 January 2005 the time-limit for the filing of
the Reply of the Republic of the Congo; and whereas, on receipt of that
letter, the Registrar transmitted a copy thereof to the Agent of France;

Whereas, by a letter dated 6 December 2004 and received in the
Registry on 7 December 2004 by facsimile, the Agent of France indicated
that his Government did not object to the extension of the time-limit
sought by the Republic of the Congo;
Taking account of the reasons given by the Republic of the Congo and

of the agreement of the Parties,

ORDONNANCE

Le président de la Cour internationale de Justice,
Vu l’article 48 du Statut de la Cour et les paragraphes 3 et 4 de l’ar-

ticle 44 de son Règlement,
Vu l’ordonnance du 17 juin 2004, par laquelle la Cour a fixé au
10 décembre 2004 et au 10 juin 2005, respectivement, les dates d’expira-
tion des délais pour le dépôt de la réplique de la République du Congo et
de la duplique de la République française;

Considérant que, dans une lettre datée du 2 décembre 2004 et reçue au
Greffe le même jour par télécopie, l’agent de la République du Congo
s’est référé à un arrêt de la première chambre d’instruction de la cour
d’appel de Paris, rendu le 22 novembre 2004, dont il a fourni la copie, et
a prié la Cour, pour les raisons exposées dans ladite lettre, de reporter au
10 janvier 2005 le délai pour le dépôt de la réplique de la République du

Congo; et considérant que, dès réception de cette lettre, le greffier en a
fait tenir copie à l’agent de la République française;
Considérant que, par lettre datée du 6 décembre 2004 et reçue au
Greffe le 7 décembre 2004 par télécopie, l’agent de la République fran-
çaise a indiqué que son gouvernement ne s’opposait pas à la prorogation

de délai sollicitée par la République du Congo;
Compte tenu des raisons invoquées par la République du Congo et de
l’accord des Parties,

Extends to 10 January 2005 the time-limit for the filing of the Reply of

the Republic of the Congo;
Extends to 10 August 2005 the time-limit for the filing of the Rejoinder
of the French Republic; and

Reserves the subsequent procedure for further decision.

Done in English and in French, the English text being authoritative, at
the Peace Palace, The Hague, this eighth day of December, two thousand
and four, in three copies, one of which will be placed in the archives of

the Court and the others transmitted to the Government of the Republic
of the Congo and the Government of the French Republic, respectively.

Reporte au 10 janvier 2005 la date d’expiration du délai pour le dépôt

de la réplique de la République du Congo;
Reporte au 10 août 2005 la date d’expiration du délai pour le dépôt de
la duplique de la République française;

Réserve la suite de la procédure.

Fait en anglais et en français, le texte anglais faisant foi, au Palais de la
Paix, à La Haye, le huit décembre deux mille quatre, en trois exemplaires,
dont l’un restera déposé aux archives de la Cour et les autres seront

transmis respectivement au Gouvernement de la République du Congo et
au Gouvernement de la République française.
