Having regard to Article48 of the Statute of the Court, and to Articl44 and 45,
paragraph 2, of the Rules of Court,
Having regard to the Applicationled in the Registry of the Court on 9 December2002,
whereby the Republic of the Congo,efemng to Article38, paragraph 5, of the Rules of Court,
sought to institute proceedings againstthe French Republic in respect of a dispute arising out of
certaincriminalproceedingsin France,
Having regard to theetter dated 8April2003 from the Minister for Foreign Affairs of
France whereby France expressly consented to theurisdiction of the Court to entertain the
Application, Having regardto the Orderof 17June 2003wherebythe Court adjudicatedupon the request
for the indication of a provisional measure submitted by the Republic of the Congo on
9 December2002,
Having regard to the Order of 11July 2003 whereby the President of the Court fixed
11December2003 and 11May2004 asrespectivetime-limitsfor the Memorial of the Republicof
the Congo andthe Counter-Memorialof the French Republic,
Having regardto the Memorial and the Counter-Memorialduly filed by the Parties within
thosetime-limits;
Whereas, at ameetingon 11June 2004betweenthe Presidentof the Court andthe Agentsof
the Parties, the Agent of the Congo requested that his Governrnentbe authorizedby the Court to
file a Reply by the end of 2004, and the Agent of France indicatedthat his Govemment had no
objection to that request being granted, onthe understanding that France would havethe same
amountof time for the filing oa Rejoinder;
Taking account of the agreement ofthe Parties and of the particular circumstancesof the
case,
Authorizesthe filing of a Replybythe Congoand a Rejoinder by France;
Fixesthe followingtime-limitsfor the filingof thosepleadings:
10December2004 forthe Replyof the Republicof the Congo;
10June 2005 for the Rejoinderof the French Republic; and
Resewes the subsequentprocedurefor further decision.
