The International Court of Justice,

Composed as above,
After deliberation,

Having regard to Article48 of the Statute of the Court and to
Articles 31 an79 of the Rules of Court,

Having regard to the Order of 26 February 2002, whereby the Court
fixed 28 April 2003 an28 June 2004 as the time-limits for the filing,
respectively, of a Memorial by the Republic of Nicaragua and a Counter-
Memorial bythe Republic of Colombia,

Having regard to the Memorial of Nicaragua, which was filed within
the time-limit thus fixed;
Whereas on 21 July 2003 the Republic of Colombia filed certain pre-
liminary objections to jurisdiction;

Whereas accordingly, by virtue of Article 79, pa5,of the Rules
of Court, the proceedings on the merits are suspended and a time-limithas to be fixed for the presentation by the other Party of a written state-

ment of its observations and submissions on the preliminary objections;

Whereas, at a meeting between the President of the Court and the
Agents of the Parties held on 17 September 2003, Nicaragua stated that

it desired a period of four months, from the date of the Order to be
adopted, for the preparation of its written statement; and whereas Colom-
bia indicated its agreement to such a time-limit:
Taking account of the agreement of the Parties,

Fixes 26 January 2004 as the time-limit within which the Republic of
Nicaragua may present a written statement of its observations and sub-
missions on the preliminary objections made by the Republic of Colom-

bia; and
Reseriles the subsequent procedure for further decision.

Done in English and in French, the English text being authoritative, at
the Peace Palace, The Hague, this twenty-fourth day of September, two
thousand and three, in three copies, one of which will be placed in the
archives of the Court and the others transmitted to the Government of
the Republic of Nicaragua and the Government of the Republic of
Colombia, respectively.

28 avril 2003 et au 28 juin 2004 les dates d'expiration des délaispour le
dépot. respectivement. d'un mémoire de la République du Nicaragua et
d'un contre-mémoire de la République de Colombie,
Vu le mémoire du Nicaragua déposédans le deldi afixé;

Considérant que, 'le 21 juillet 2003, la République de Colombie a
déposé certainesexceptions préliminaires d'incompétence;
Considérant qu'en conséquence. en vertu des dispositions du para-

pourra présenter un exposé écritcontenant ses o1)servations et conclu-
sions sur les exceptioiîs préliminaires;
Considérant que, au cours d'une réunion que le président de la Cour a
tenue avec les agents des Parties le17 septembre 2003, le Nicaragua a

déclaréqu'il souhaitait disposer d'un délai dequatre mois, à compter de
la date de l'ordonnailce a adopter, pour la préparation de son exposé
écrit; et que la Colombie a marqué son accord sur un tel délai;
Compte tenu de l'accord des Parties,

Fixe au 26 janvier 2004 la date d'expiration du délai dans lequel la
République du Nicaragua pourra présenter un exposé écritcontenant ses
observations et concli~sionssur les exceptions préliminaires soulevéespar
la République de Colombie;

Riserve la suite de la procédure.

Fait en anglais etn français, le texte anglais faisant foi, au Palais de la

Paix. à La Haye, le vingt-quatre septembre deus mille trois, en trois
exemplaires, dont I'urirestera déposéaux archives (le la Cour et les autres
seront transmis respectivement au Gouvernement de la République du
Nicaragua et au Gouvernement de la République de Colombie.
