The International Court of Justice,
Composed as above,

After deliberation,
Having regard to Article 48 of the Statute of the Court and to
Article44 of the Rules of Court,
Having regard to the Special Agreement between the two Parties,

which was signed in Kuala Lumpur on 31 May 1997 and entered into
force on 14 May 1998,
Having regard to the Order of 10November 1998,whereby the Court,
having regard to the provisions of Articleragraph 2, of that Special
Agreement, fixed at2 November 1999 and 2 March 2000, respectively,
the time-limits for the filing of a Memorial and of a Counter-Memorial
by each of the Parties;

Whereas, on 18August 1999,the Agents of the two Parties addressed
to the Court a joint letter worded as follows: COUR INTERNATIONALE DE JUSTICE

La Cour internationale de Justice,

Ainsi composée,

Après délibéren chambre du conseil,
Vu l'article 48 du Statut de la Cour et l'article 44 de son Règlement,

Vu le compromis entre les deux Parties, signé a Kuala Lumple
31 mai 1997 et entré (envigueur le 14 mai 1998,

Vu l'ordonnancedi1 10 novembre 1998, par laquelle la Cour, eu égard

aux dispositions du paragrap2de l'artic3edudit compromis, fixé
respectivement au 2 novembre 1999et2amars 2000 les dates d'expira-
tion des délaispour le dépôt d'un mémoire et d'un contre-mémoire par
chacune des Parties;
Considérant que,1.e18 août 1999, les agents des deux Parties ont
adressé à la Cour uni: lettre conjointe ainsi libellée: "It is the Parties' position that the existing four-month time-limit
established in the Special Agreement for the simultaneous filing of
the Counter-Memorials does not leave sufficienttime for the Parties
to address issues which may be raised in each Party's Memorials.
Accordingly, the Parties have agreed to request jointly a four-month
extension for filing their Counter-Memorials until 2 July 2000, thus
modifying the provisions of the Special Agreement. In al1 other
respects, the Special Agreement remains unchanged, including the
date for submission of Memorials.
The Parties would be grateful if the Court would take note of this

joint request and thereby modify the Order for the filing of the
Parties' Counter-Memorials so as to reflect a filing date of 2 July
2000" ;
Taking account of the agreement of the Parties,

Extends until 2 July 2000 the time-limit for the filing of a Counter-
Memorial by each of the Parties; and

Resevves the subsequent procedure for further decision.

Done in English and in French, the English text being authoritative,
at the Peace Palace, The Hague, this fourteenth day of September, one
thousand nine hundred and ninety-nine, in three copies, one of which
will be placed in the archives of the Court and the others transmitted
to the Government of the Republic of Indonesia and the Government of
Malaysia, respectively.

Registrar. ((les Parties estirnent que le délai de quatre mois prévu par [le]
compromis pour le dépôt simultané des contre-mémoires ne leur
laisse pas suffisamment de temps pour traiter des questions qui
peuvent êtresoulevéesdans lesdifférentsmémoires.En conséquence,
les Parties sontclonvenuesde demander conjointement le report de
quatre mois, jusqu'au 2juillet 2000,de la date d'expiration du délai
pour le dépôt des contre-mémoires. Pour le reste, le compromis
demeure inchangé, de mêmeque la date fixéepour le dépôt des
mémoires.
Les Parties seraient reconnaissantes la Cour de bien vouloir
prendre acte de la présentedemandeconjointe et de modifier'ordon-
nance de façon a reporter au 2 juillet 2000 ladate d'expiration du

délaipour le dépôtdes contre-mémoires));
Compte tenu de l'accord des Parties,

Reporte au 2 juillet 2000 la date d'expiration du délaipour le dépôt
d'un contre-mémoire .parchacune des Parties;
Réserve la suite de la procédure.

Fait en anglais et en français, le texte anglais faisant foi, au Palais de la
Paix, a La Haye, le quatorze septembre mil neuf cent quatre-vingt-dix-
neuf, en trois e~ernpl~aire, ont l'un restera déposéaux archives de la
Cour et lesautres seront transmis respectivement au Gouvernement de la
Républiqued'Indonésieet au Gouvernement de la Malaisie.
