Vu le paragraphe 2 de l'article 66du Statut de la Cour,

Considérant que, le 14 mai 1993, la quarante-sixième Assemblée
mondiale de la Santéa adopté sarésolutionWHA46.40,par laquelle elle
a décidé,

conformément àl'article 96.2 de la Charte des Nations ànies,
I'article76de la Constitution de l'organisation mondiale de la Santé
etàI'article X de l'accord entre l'Organisation des Nations Unies
et l'organisation mondiale de la Santé approuvépar l'Assemblée
générale des Nations Unies le15 novembre 1947 dans sa résolu-
tion 124 (II), de demandera Cour internationale de Justice de

Composed as above,

After deliberation,
Having regard to Article 66,paragraphf the Statute of the Court,
Whereas on 14May 1993the Forty-sixth World Health Assemblyofthe
World Health Organization adopted resolution WHA46.40by which the

Assembly decided,
"in accordance with Article 96 (2) of the Charter of the United
Nations, Article 76of the Constitution of the World Health
zation and Article X of the Agreementbetween the United Nations
and the World Health Organization approved bythe General
bly of the United Nations on 15 November 1947 in its resolu-

tion 124(II), to request the International Court of Justice to give an
advisory opinion on the followingque:tion «Compte tenu des effets des armes nucléaires surla santéet
l'environnement,leurutilisationparun Etat au coursd'une guerre
ou d'un autre conflit armé constituerait-elleune violation de ses
obligationsauregarddu droitinternational, ycomprislaConstitu-
tiondel'OMS? );

Considérantque copiecertifiéeconformedesversionsanglaiseet fran-
çaise de la résolutionWHA46.40a été transmise à la Cour par une lettre
du Directeur généralde l'organisation mondiale de la Santédu 27 août
1993,reçue au Greffele 3septembre 1993,

Fixe au 10 juin 1994la date d'expiration du délai dans lequel des
exposésécritspourrontêtreprésentés àla Cour par l'organisation mon-
diale de la Santé etpar les Etats membres de cette organisation admià
esterdevant la Cour,conformémentauparagraphe 2del'article66deson
Statut;

Réservela suite de la procédure.

those ofits member Stateswho areentitledto appear beforethe Court, in
accordance with Article 66,paragraph 2,ofthe Statute of the Court;and

Reservesthe subsequentprocedure for further decision.
