ORDER

The President of the International Court of Justice,

Having regard to Article 48 of the Statute of the Court and Article 44,
paragraphs 3 and 4, of the Rules of Court,
Having regard to the Order dated 17 December 1997, by which the
Court directed Bosnia and Herzegovina to submit a Reply andYugo-
slavia to submit a Rejoinder relating to the claims of both Parties and,
account having been taken of the views expressed by the Parties, fixed,
respectively, 23 January 1998and 23 July 1998as the time-limit for the
filing of the Reply and of theoinder;
Whereas, by letter dated 12January 1998and received in the Registry
on the same day by facsimile, the Deputy-Agent of Bosnia and Herze-
govina informed the Registrar that Bosnia and Herzegovina would not
be able to finish the preparation of its Reply in the time-limited

and that, at the start of the following week, he would ask the Court to
extend the time-limit as necessary; and whereas the Deputy-Registrar
immediately transmitted copy of that letter to the Agent of Yugoslavia;
Whereas, by a letter dated 20 January 1998and received in the Regis-
try on the same day by facsimile,the Deputy-Agent of Bosnia and Herze-
govina asked the Court to extend to 23 April 1998the time-limit for the
filing of the Reply; and whereas the Deputy-Registrar, referring to
Article 44, paragraph,of the Rules of Court, immediately transmitted

ORDONNANCE

Le présidentde la Cour internationale de Justice,
Vu l'article 48 du Statut de la Cour et les para3et 4 de l'ar-

ticle 44 de son Règlement,
Vu l'ordonnance du17décembre1997,par laquelle la Cour a prescrit
la présentation d'une réplique de la Bosnie-Herzégovine et d'une du-
plique de la Yougoslavie portant sur les demandes soumises par les deux
Parties, et, compte tenu des vues expriméespar celles-ci, a fixé,respec-
tivement, au 23 janvier et au 23 juillet 1998 les dates d'expiration des
délaispour le dépôtde la réplique etde la duplique;
Considérant que, par lettre datéedu 12janvier 1998et parvenue au
Greffe le mêmejour par télécopie,l'agent adjoint de la Bosnie-Herzégo-
vine a fait savoir au greffierque celle-cine serait pas en mesure d'achever
la préparation de sa répliquedans le délai ainsifixéet que, dèsle débutde
la semaine suivante, il prierait la Cour de proroger ce délai selon qu'il
apparaîtrait nécessaire; etconsidérant que le greffier adjoint a immédia-
tement transmis copie de cette lettreent de la Yougoslavie;

Considérant que, par lettre datéedu 20 janvier 1998 et parvenue au
Greffe le mêmejour par télécopie, l'agentadjoint de la Bosnie-Herzégo-
vine a prié laCour de reporter auavril 1998la date d'expiration du
délaipour ledépôtde la réplique;et considérantque le greffieradjoint, se
référantau paragraphe 3 de l'article 44 du Règlement, a immédiatement
transi~iiscopie de cette àel'agent de la Yougoslavie; Whereas, by a letter dated 21 January 1998and received in the Regis-

try on the same day by facsimile, the Agent of Yugoslavia indicated that
his Government consented to the extension of the time-limit requested by
Bosnia and Herzegovina. provided that the tirne-limit fixed for the filing
of the Rejoinder be extended likewise,
Extends to 23 April 1998the time-limit for the filing of the Reply of
Bosnia alid Herzegovina :

Estunrls to 22 January 1999 the time-limit for the filing of the Rejoin-
der of Yugoslavia; and
Reserves the subsequent procedure for further decision.

Done in English and in French, the Englislitext being authoritative, at
the Peace Palace, The Hague, this twenty-second day of January, one
thousand nine hundred and ninety-eight, in three copies, one of which
will be placed in the archives of the Court and the others transmitted to
the Government of Bosnia and Herzegovina and the Government of the
Federal Republic of Yugoslavia, respectively.

Deputy-Registrar. Considérant que. par lettre datée du 21 janvier 1998 et parvenue au
Greffe le mêmejour par télécopie, l'agent dela Yougoslavie a indiqué
que son gouvernement consentait à la prorogation de délai sollicitpar
la Bosnie-Herzégovine,pourvu que le délai fixkpour le dépôtde la du-
plique soit prorogéde la mêmemanière,

Reporte au 23 avril 1998la date d'expiration du délaipour le dépôtde
la répliquede la Bosnie-Herzégovine;
Reporte au 22janvier 1999 la datc d'expiration du délaipour Ic dépôt
de la duplique de la Yougoslavie;

Réservela suite de la procédure.

Fait en anglais et en français, le texte anglais faisant foi, au Palais de la
Paix,à La Haye, le vingt-deuxjanvier milneuf cent quatre-vingt-dix-huit,
en trois exemplaires, dontl'un restera déposéaux archives de la Cour et
les autres seront transmis respectivement au Gouvernetnent de la Bosnie-

Herzégovine etau Gouvernement de la République fédérative deYou-
goslavie.
