Le Présidentde la Cour internationale de Justice,

Vu l'article 48 du Statut de la Cour et les articles 31, 44 et 79 de son
Règlement,
Vu la requête enregistau Greffe de la Cour le 20 mars 1993,par
laquelle la Républiquede Bosnie-Herzégovinea introduit une instance
contre la République fédérative de Yougosleu sujet d'un différend
concernant d'une part une sériede violations allde la convention
pour la prévention et la répressiondu crime de génocide,adoptéepar
l'Assembléegénérale desNations Unies le 9 décembre1948,et d'autre
part diverses questions qui, selon la Bosnie-Herzégovine,seraientliées
ces violations,

Vu l'ordonnance en date du 16avril 1993,par laquelle le Président de
la Cour a notamment fixéau 15avril 1994la date d'expiration du délai
pour le dépôtdu contre-mémoire de la Yougoslavie, etles ordonnances
en date des octobre 1993et 21 mars 1995,par lesquellesce délaia été
reporté,successivement,au 15avril puis au 30juin 1995,
Vu les exceptions préliminaires,portant respectivement sur la receva-
bilité dela requête etsur la compétence de laCour pour connaître de
l'affaire, qui ont été présear le Gouvernement yougoslave dans le
délaifixépour le dépôtdu contre-mémoire,tel que prorogé en dernier

(BOSNIA AND HERZEGOVINA v.YUGOSLAVIA)

ORDER

The President of the International Court of Justice,
Having regard to Article 48 of the Statute of the Court and to
Articles 31, 44 and 79 of theles of Court,

Having regard to the Application filed in the Registry on March
1993, whereby the Republic of Bosnia and Herzegovina institutepro-
ceedings against the Federal Republic of Yugoslavia in respect of a dis-
pute concerning a series of alleged violations of the Convention on the
Prevention and Punishment of the Crime of Genocide, adopted by the
General Assembly of the United Nations on 9 December 1948,as well as
various matters which Bosnia and Herzegovina claims are connected
therewith,
Having regard to the Order made by the President of the Court on
16April 1993, fixing(interalia) 15April 1994as the time-limit for the

filing of the Counter-Memorial of Yugoslavia, and the Orders dated
7 October 1993 and 21 March 1995, whereby that time-limit was suc-
cessivelyextended to 15 April and then to 30 June 1995,
Having regard to the preliminary objections concerning, respectively,
the admissibility of the Application and theisdiction of the Court to
entertain the case, which were raised by the Government of Yugoslavia
within the time-limit fixed for the filing of the Counter-Mernorial, as
finally extended; Considérant que la Cour, par son arrêten date du Il juillet 1996,a dit
qu'elle a compétence,sur la base de l'article IX de la convention pour la

prévention et la répressiondu crime de génocide,pour statuer sur le dif-
férendet que la requête est recevable;
Considérant qu'aux fins de se renseigner auprèsdes Parties sur la suite
de la procédurele Présidenta reçu leurs représentants le 23juillet 1996,

Fixe au 23 juillet 1997la date d'expiration du délaipour le dépôtdu
contre-mémoire de la République fédérative de Yougoslavie;
Réservela suite de la procédure.

Fait en français et en anglais, le texte français faisant foi, au Palais de
la Paix,à La Haye, le vingt-trois juillet mil neuf cent quatre-vingt-seize,
en trois exemplaires, dont l'un restera déposéaux archives de la Cour et
les autres seront transmis respectivement au Gouvernement de la Répu-
blique de Bosnie-Herzégovine et au Gouvernement de la République
fédérative de Yougoslavie.

the basis of Article IX of the Convention on the Prevention and Punish-
ment of the Crime of Genocide, it has jurisdiction to adjudicate upon the
dispute and that the Application is admissible;
Whereas in order to ascertain the views of the Parties on the subse-
quent procedure, the President received their representatives on 23 July
1996,

Fixes 23 July 1997as the time-limit for the Counter-Memorial of the
Federal Republic of Yugoslavia; and
Reserves the subsequent procedure for further decision.

Done in French and in English, the French text being authoritative, at
the Peace Palace, The Hague, this twenty-third day of July, one thousand
nine hundred and ninety-six, in three copies, one of which will be placed
in the archives of the Court and the others transmitted to the Govern-
ment of the Republic of Bosnia and Herzegovina and the Government of
the Federal Republic of Yugoslavia, respectively.
