ORDONNANCE

Le Présidentde la Cour internationale de Justice,

Vu l'article48 du Statut de la Cour et les articles 31 et 44 de son Règle-
ment,
Vu l'arrêten date du le'juillet 1994,au paragraphe 39 duquel la Cour
s'est expriméedans les termes suivants:

«Une fois l'ensembledu différend soumiàla Cour, celle-cifixera
les délaisdans lesquels il sera procédéau dépôt simultanédes pièces
de la procédureécrite,chaque Partie déposant dans lesmêmesdélais
un mémoire,puis un contre-mémoire)),

Vu l'arrêten date du 15 février 1995, aux termes duquel la Cour a
notamment constaté qu'elle était désormaissaisie de l'ensembledu diffé-
rend, et dont le paragraphe 49 précisece qui suit:
«Dans le cadre ainsi défini,il appartientar de présenteà la
Cour ses propres conclusions comme il appartientahreïn de pré-
senter les siennes. A cet effet, la Cour fixera par voie d'ordonnance,
après s'êtrerenseignéeauprès des Parties, les délaisdans lesquels il

sera procédéau dépôt simultanédes piècesde la procédure écrite,
conformémentau paragraphe 39 de l'arrêt dule'juillet 1994»,

ORDER

The President of the International Court of Justice,

Having regard to Article 48 of the Statute of the Court and to Ar-
ticles 31 and 44 of the Rules of Court,
Having regard to the Judgment of 1 July 1994, in paragraph 39 of
which the Court expressed itself in the following terms:

"On the completion thus of the reference of the whole dispute to
the Court, the Court will fixtime-limits for the simultaneous filingof
pleadings,Le., each Party will file a Memorial and then a Counter-
Memorial within the same time-limits",

Having regard to the Judgment of 15 February 1995,in the terms of
which the Court noted,interalia, that it was now seised of the whole of
the dispute, and paragraph 49 of whichtatesthat:
"Within the framework thus defined,it falls to Qatar to present its
submissions to the Court, as it falls to Bahrain to present its own. To
this end, after it has ascertained the views of the Parties, the Court
will issue an Order fixing the time-limits for the simultaneous filing
of the written pleadings, in accordance with paragraph 39 of the

Judgment of 1 July1994",
Having regard to the Order of 28 April 1995, by which the Court,rant auxdits arrêts, afixéau 29 février1996la date d'expiration du délai
pour le dépôtpar chacune des Parties d'un mémoiresur le fond,

Vu l'ordonnance en date du le' février1996, par laquelle la Cour a
reportéau 30 septembre 1996la date d'expiration du délaipour le dépôt
par chacune des Parties d'un mémoiresur le fond;
Considérant que chacune des Parties a dûment déposé son mémoire
sur le fond dans le délai ainsiprorogé;

Considérantqu'il convienta présent defixerun délaipour le dépôtpar
chacune des Parties d'un contre-mémoiresur le fond;
Compte tenu des vues expriméespar les agents des Parties lors d'une
réunionque le Président de laCour a tenue avec eux le 28octobre 1996,

Fixe au 31 décembre1997la date d'expiration du délaipour le dépôt
par chacune des Parties d'un contre-mémoiresur le fond;
Réservela suite de la procédure.

Fait en français et en anglais, le texte français faisant foi, au Palais de
la Paix,à La Haye, le trente octobre mil neuf cent quatre-vingt-seize, en
trois exemplaires, dont l'un restera déposaux archives de la Cour et les
autres seront transmis respectivement au Gouvernement de 1'Etat de
Qatar et au Gouvernement de 1'Etatde Bahreïn.

for the filing by each of the Parties of a Memorial on the merits,

Having regard to the Order of 1 February 1996, by which the Court
extended to 30 September 1996the time-limit for the filing by each of the
Parties of a Memorial on the merits;
Whereas each of the Parties duly filed its Memorial on the merits
within the time-limitthus extended;

Whereas a time-limit now has to be fixed for the filing by each of the
Parties of a Counter-Memorial on the merits;
Taking into account the viewsexpressed by the Agents of the Parties at
a meeting which the President of the Court held with them on 28 Octo-
ber 1996,

Fixes 31 December 1997as the time-limit for the filing by each of the
Parties of a Counter-Memorial on the merits; and
Reserves the subsequent procedure for further decision.

Done in French and in English, the French text being authoritative, at
the Peace Palace, The Hague, this thirtieth day of October, one thousand
nine hundred and ninety-six, in three copies, one of which will beplaced
in the archives of the Court and the others transmitted to the Govern-
ment of the State of Qatar and the Government of the State of Bahrain,
respectively.
