ORDER

The Vice-President of the International Court of Justice,

Having regard to Article 48 oftheStatute of the Court and to Articles
13,44 and 46 of the Rules of Court,
Whereas by a letter dated 25 November 1978, filedin the Registry of
the Court on 1 December 1978,the Minister for Foreign Affairs of the
Republic of Tunisia transmitted to the Registrar a certifiedtrue copy of a
Special Agreement drawn up in the Arabic language between the
Republic of Tunisia and the Socialist People's Libyan Arab Jamahiriya

and signed at Tunis on 10 June 1977, by which they agreed to have
recourse to the Court concerning the question of the continental shelf
betweenthe two countries,together with a translation thereof into French
certifiedas accurate;
Whereas the Minister for Foreign Affairs of Tunisia also enclosed with
his letter the procès-verbal of the exchange of instruments of ratification
of the Special Agreement, which took place at Tripoli on 27 February
1978;
Whereas by Article 5 the SpecialAgreement provided for its entry into
force on the date on which the instruments of its ratification were ex-
changed and for its notification to the Court by both Parties or by either
of them ;
Whereas in the said letter the Miriister for Foreign Affairs of Tunisia

stated that Mr. SlimBenghazi,Ambassador of Tunisia in The Hague, had
been appointed Agent, and Mr. Sadok Belaid, Professor in the Faculty of
Law of Tunis, had been appointed Co-Agent and counsel for the purposes
of the case;
Whereas, in accordance with Article 39, paragraph 1, of the Rules of 4 CONTINENTAL SHELF(ORDER 20 1179)

Court, by a telegram and letter of 1 December 1978, the Registrar
informed the Government of the Libyan Arab Jamahiriya of the ~otifica-
tion of the Special Agreement and recalled the provisions of Article 40,
paragraphs 1and 3, of the Rules regarding the appointment of an Agent;
Whereas by a letter dated 14February 1979,filedin the Registry of the
Court on 19 February 1979, the Secretary for Foreign Affairs of the
Socialist People's Libyan Arab Jamahiriya transmitted to the Registrar a
certified true copy inArabic of the aforementioned Special Agreement of
10June 1977,together with a translation thereof into English certified as
accurate ;
Whereas in the said letter the Secretary for Foreign Affairs of the
Socialist People'sLibyan Arab Jamahiriya stated that Ambassador Kamel

H. El Maghur and Mr. Suleiman A. Ateiga, Minister Plenipotentiary in
the Permanent Mission of the Jamahiriya in Geneva, had been appoiilted
Agent and Co-Agent forthe purposes of the case;
Whereas the views ofthe Parties with regard to questions of procedure
are set out in Article 4 of the SpecialAgreement, in paragraph B of which
they recorded their agreement that without prejudice to any question that
may arise relating to the means of proof, the written pleadings shall
consist of the following documents:

"(1) Memorials to be submitted to the Court and exchanged
between the two Parties within a period not exceeding eighteen (18)
months from the date of the notification of the present Special
Agreement to the Registrar of the Court.
(2) Counter-Memorials to be submitted by both Parties to the
Court and exchanged between them as follows: The Republic of
Tunisia shall submit its Counter-Memorial within a period of six (6)
months from the date on which it receivesfromthe Court notification
of the Memorial; the Socialist People's LibyanArab Jamahiriya shall
submit its Counter-Memorial within a period of eight (8) months
from the date on which it receivesfrom the Court notification of the
Memorial.

(3) If necessary, additional written pleadings to be submitted to
the Court and exchanged within periods to be fixed by the Court at
the request of either Party or, if the Court soecides, after consulta-
tion between the two Parties";
Taking this agreement into account, as provided by paragraph 2 of
Article 44 of theRules of Court ;

Fixes 30 May 1980as the time-limit for the filing of the Memorials of
the Republic of Tunisia and the Socialist People's Libyan Arab
Jamahiriya;

Done in English and in French, the English text being authoritative, at
the PeacePalace, The Hague, this twentieth day of February onethousand
nine hundred and seventy-nine, in three copies, one of which will beplaced in the archives of the Court, and the others transmitted to the
Government of the Republic of Tunisia and to the Government of the
Socialist People's Libyan Arab Jamahiriya respectively.

The Vice-President of the International Court of Justice,

Le Vice-Présidentde la Cour internationale de Justice,

Vu l'article 48 du Statut de la Cour et les articles3, 44 et 46 du
Règlementde la Cour,
Considérant que,par lettre du25 novembre 1978déposéeau Greffe de
la Cour le 1" décembre 1978, le ministre des affaires étrangèresde la
République tunisienne a transmis au Greffier la copie certifiéeconforme

d'un compromis rédigé enlangue arabe entre la Républiquetunisienne et
la Jamahiriya arabe libyenne populaire et socialiste, signà Tunis le
IOjuin 1977,par lequel cesdeux Etatssont convenus de recouràrla Cour
au sujet de la question du plateau continental entre les deux pays, ainsi
qu'une traduction certifiéeexacte en français de ce compromis;

Considérant que le ministre des affaires étrangèresde Tunisie a égale-
ment jointà salettre leprocès-verbalde l'échange desinstruments de rati-
fication du compromis, échange qui a eu lieàTripoli le 27 février1978;

Considérant que l'article du compromis prévoitque celui-ci entrera
en vigueur àcompter de la date de l'échangedes instruments de ratifica-
tion et sera notifiéau Greffier par les deux Parties ou par l'une ou l'autre

d'entre elles;
Considérantque dans sa lettre précitée leministre desaffaétrangères
de Tunisie a indiqué que M. Slim Benghazi, ambassadeur de la Républi-
que tunisienneà La Haye, avait étédésigncommeagent et que M. Sadok
Belaid, professeuà la facultéde droit de Tunis, avait étédésigné comme
coagent et conseil aux fins de l'affaire;
Considérant que, conformément à l'article 39, paragraphe 1,du Règle- 4 CONTINENTAL SHELF(ORDER 20 1179)

ainsi qu'une traduction certifiéeexacte en anglais de ce compromis;

Considérant que dans ladite lettre le secrétaireaux affaires étrangères
de la Jamahiriya arabe libyenne populaire et socialiste a indiqué que
l'ambassadeur Kamel H. El Maghur et M. Suleiman A. Ateiga, ministre

plénipotentiaire à la mission permanente de la Jamahiriya à Genève,
avaient étédésignés comme agent et coagent aux fins de l'affaire;
Considérantque lesvuesdes Parties sur lesquestions de procéduresont
énoncées àI'article4 du compromis, àl'alinéaB duquel ellesconviennent
que, sans préjuger aucune question pouvant survenir relativement aux
moyens de preuve, lesplaidoiries écritesseront constituéesdes documents
suivants :

1) Des mémoires à soumettre àla Cour et à échangerentre les
deux Parties dans une période n'excédantpas dix-huit mois (18) à
partir de la date de notification du présentcompromis au Greffier de
la Cour.
2) Des contre-mémoires àsoumettre à la Courpar les deux Parties
età échangerentre elles conformément à ce qui suit: la République
tunisienne soumettra son contre-mémoiredans les six mois (6) après
la dateàlaquelle elleaura reçu notification du mémoirede la part de
la Cour; la Jamahiriya arabe libyenne populaire et socialiste sou-
mettra son contre-mémoiredans les huit rnois (8)à partir de la date

à laquelle elle aura reçu notification du mémoirede la part de la
Cour.
3) En cas de nécessité, des mémoires écritdsditionnelssoumettre
àla Cour et dont l'échangedoit s'effectuerdans les délaisqui seront
fixéspar la Courà lademande de l'une ou l'autre Partie ou lorsquela
Cour en décide ainsiaprèsconsultation entre les deux Parties »;

Tenant compte de cet accord ainsi que le prévoit I'article 44, para-
graphe 2, du Règlement;
Fixe au 30 mai 1980 la date d'expiration du délaipour le dépôt des
mémoires dela Républiquetunisienne et de la Jamahiriya arabe libyenne

populaire et socialiste.

Fait en anglais eten français, le texte anglais faisant foi, au palais de la
Paix, àLa Haye, le vingt févriermil neuf cent soixante-dix-neuf, en trois
exemplaires, dont l'un restera déposé auxarchives de la Cour et dont lesplaced in the archives of the Court, and the others transmitted to the
Government of the Republic of Tunisia and to the Government of the
Socialist People's Libyan Arab Jamahiriya respectively.
