MakesthefollowingOrder:

Having regard to Articles 31and 48 of the Statute of the Court and to
Articles7and 35 of the Rules of Court,
Having regard to theecial Agreement concluded on 24 May 1986

between the Republic of El Salvador and the Republic of Honduras for
the submission ofaland, island and maritime frontierdispute between the
two States to aamber of the Court consisting of three Members of the
Court and twojudgesd hocchosen by the Parties,163 DISPUTE (ELSALVADOR/HONDUR (ARS) ER13XII 89)

Havingregard tothe notifications made bythe Parties of the choice by
them ofjudges ad hoc,namely the choiceby El Salvador on 7March 1987
of Mr. Nicolas Valticos, and the choice by Honduras on 8 April 1987of
Mr. Michel Virally,
Havingregard tothe Order madeby the Court on 8May 1987whereby
itdecided to accedeto the request ofthe Governments of El Salvador and
Honduras to form a special chamber of fivejudges to deal with the case,
and further declared that at an electionheld on4 May 1987Judges Oda,

Sette-Camara and Sir Robert Jennings were elected to form, with the
judges ad hoc chosen by the Parties, a chamber to deal with the case, and
that accordinglysuch a Chamber wasdulyconstituted bythe Order, com-
posed ofJudgesOda, Sette-Camara and Sir Robert Jennings, and Judges
ad hoc Valticos and Virally;and

Whereas Judge ad hocVirallydied on 27January 1989;

Whereas by letter dated 9 February 1989 the Agent of Honduras
informed the Court that his Government had chosen Mr. Santiago
Torres Bernardez to sit asjudge ad hocin place of the late Judge ad hoc
Virally;

Whereas pursuant to Article 35, paragraph 3, of the Rules of Court a
copy of the letter of 9 February 1989from the Agent of Honduras was on
13February 1989communicated by the Registrar to the Agent of El Sal-
vador, who wasrequested to furnish such observations asthe Government
of El Salvador might wish to make;
Whereasafter a number of communications had been addressed to the
Court byboth Parties, the Agent of El Salvadorinformed the Court ofthe

final position of his Government by a letter received in the Registry on
30October 1989from which it appearsthat El Salvador has no objection
to the choice of Mr. Torres Bernardez;
Whereas no objection to that choice appears to the Court itself,

Unanimously,

Declaresthat the Chamber formed to deal withthis case iscomposed as
follows :Judge Sette-Camara,President ofthe Chamber; Judges Oda and
Sir RobertJennings; Judges ad hoc Valticosand Torres Bernardez.

Vu l'ordonnance rendue par la Cour le 8 mai 1987par laquelle elle a
décidé d'accéder àla demande des Gouvernements d'El Salvador et du
Honduras tendant à ce que soit constituéeune chambre spécialede cinq
juges pour connaître de l'affaire et a de plus déclaréque, lei 1987,
M. Oda, M. Sette-Camara et sir Robert Jennings, juges, avaient été élus
pour former,avec lesjuges ad hocdésignéspar les Parties, la chambre qui
seraitsaisie de l'affaire etqu'en conséquenceladite chambre étaitdûment

Considérant que M. Virally, juge ad hoc, est décédéle 27 janvier
1989;
Considérant que, par lettre du 9 février1989,l'agent du Honduras a
informéla Cour queson gouvernement avait décidéde désigner M. San-
tiago Torres Bernardez pour siégercommejuge ad hocen remplacement
de M.Virally;

Considérantqu'enapplication du paragraphe 3del'article35du Règle-
ment dela Cour copie delalettredu 9février1989del'agentdu Honduras
a été communiquée le 13février1989par le Greffier àl'agent d'El Sal-
vador, qui a étpriéde présenterles observations que le Gouvernement
d'El Salvadorpourrait vouloir faire;

Considérantqu'après transmission à la Courpar les deux Parties d'un
certain nombre de communications l'agent d'El Salvador a informéla
Cour de la position définitivede son gouvernement, par lettreeque au
Greffe le30octobre 1989d'où ilressort qu'El Salvador ne fait pas objec-
tionà la désignation deM. Torres Bernardez;
Considérant que la Cour elle-même nevoit pas d'objection à cette

désignation,

à l'unanimité,

Déclareque la Chambre constituéepourconnaître delaprésenteaffaire
est composée comme suit: M. Sette-Camara, président de la Chambre;
M.Oda et sir Robert Jennings,juges; MM. Valticos etTorres Bernardez,
juges ad hoc.
