MakesthefollowingOrder:
Havingregard to Articles40and 48ofthe Statute ofthe Court,

Havingregard to Articles,39,44 and 46of the Rules of Court; and
Whereas on 31August 1990the Government of the SocialistPeople's
Libyan Arab Jamahiriya filed in thestryofthe Court a notification,
under Article40,paragraph 1,ofthe StatuteoftheCourt, ofan agreement
entitled "Framework Agreementonthe Peaceful Settlementofthe Terri-
torial Dispute betweenthe Great SocialistPeople's LibyanArab-
riyaand the RepublicofChad", done intheArabicand French languages
atAlgierson 1August 1989,acopyofwhich wasannexed tothe notifica-
tion; Whereas the FrameworkAgreementprovides,in Article 1,that

"Thetwo Parties undertaketo settlefirst theirterritorialdispute by
al1political means, includingconciliation,within aperiod ofapprox-
imately one year,unless the Heads of State othenvise decide"

and, in Article 2,that

"In the absence of apoliticalsettlement oftheir territorialdispute,
the two Parties undertake :

(a) to submitthedispute tothe International Court ofJustice.. .";

Whereasaccording to the notification
"the question put to the Court may be defined in the following
terms :

'In further implementation of the Accord-Cadre [Framework
Agreement], and taking into account the territorial dispute
between the Parties, to decide upon the limits of their respective
territories in accordance with the rules of international law appli-
cablein the matter' " ;

Whereas it was stated in the notification that Mr. Abdulati Ibrahim
El-Obeidi was appointed as Agent of the Libyan Arab Jamahiriya in the
case ;
Whereas on 31 August 1990a certified copy of the notification and
annex was, in accordance with Article 39, paragraph 1,of the Rules of
Court, communicated by the Deputy-Registrar to the Government of
Chad ;

Whereas on 1September 1990atelefax communication wasreceived in
the Registry of the Court from the Embassy of the Republic of Chad in
Brussels setting out the text of an Application by Chad instituting pro-
ceedingsagainst the SocialistPeople's LibyanArab Jamahiriya; whereas
that Application was based on Article 2 (a)of the "Framework Agree-
ment" and subsidiarily on Article 8of a Franco-Libyan Treaty of Friend-
shipand Good Neighbourliness of 10August 1955;

Whereasby that Application the Republic of Chad
"respectfullyrequests the Court to determine the course of the fron-
tierbetweenthe Republic of Chad and the LibyanArab Jamahiriya,
in accordance with the principles and rules of international law
applicable in the matter asbetween the Parties";

Whereas it was stated in the Application that Mr. Abderahman
Dadi was appointed as Agent of the Republic of Chad in the case, and TERRITORIALDISPUTE (ORDER 26X 90) 151

whereas Mr. Abdoulaye Lamana was subsequently appointed as Co-
Agent ;
Whereason3September 1990the Ambassador oftheRepublic ofChad

to the Netherlands filed in the Registryof the Court the original of the
said Application;
Whereas the same day a certified copy of the Application was, in
accordance with Article 38, paragraph 4, of the Rules of Court, trans-
mitted by the Registrarto the LibyanArabJamahiriya;

Whereas by a letter dated 28 September 1990,received in the Registry
by telefax the same day, and received in original on 5 October 1990,the
Agent of Chad informed the Court (interalia)that his Governmenthad
noted that "its claim coincides with that contained in the notification
addressed to the Court on 31 August 1990 bythe Libyan Arab Jamahi-
riya" and considered that

"those two notifications relate to one single case, referred to the
Court in application oftheAlgiersAgreement,which constitutesthe
SpecialAgreement,the principal basis of the Court's jurisdiction to
deal with the matter";

Whereas a copy of the letter of 28 September 1990was transmitted by
the Deputy-Registrar to the Agentofthe Libyan Arab Jamahiriya;
Whereasata meetingbetweenthe President ofthe Court and represen-

tatives of the Parties held on 24 October 1990it was agreed between the
Agentsofthe Parties that theproceedings inthe present casehad in effect
been instituted by two successive notifications of the Special Agree-
ment constituted bythe "Framework Agreement" of31August 1989,that
filed by the Libyan Arab Jamahiriya on 31 August 1990,and the com-
munication from the Republic of Chad filed on 3 September 1990read
in conjunction with the letter from the Agent of Chad of 28 September
1990,and that the procedure in the case should be determined by the
Court on that basis,pursuant to Article 46,paragraph 2, of the Rules of
Court;

Havingascertainedthe viewsofthe Partiesas to the time-limitsforthe
writtenproceedings;

Decidesthat, as provided in Article 46, paragraph 2, of the Rules of
Court, each Party shall file a Memorial and Counter-Memorial, within
the sametime-limit;
Fixes26August 1991astime-limitforthe Memorials; and

Reservesthe subsequentprocedure for further decision.

que :
«les deux parties s'engagent àréglerd'abord leur différend territo-

rialpar tous lesmoyenspolitiques,ycomprislaconciliation, dansun
délai d'unan, citécommeréférence, àmoins que les chefsd'Etat en
décident autrement»
et,en son article 2,que:

«à défautd'un règlementpolitique à leur différend territorial, les
deuxparties s'engagent :

a) àsoumettreledifférendaujugement delaCour internationale de
Justice..»;

Considérant que,selon la notification,
«la question posée à la Cour peut être définiedans les termes
suivants:

En vue de la poursuite de l'application de l'accord-cadre, et
comptetenu du différendterritorial entrelesParties,statuer surles
limites de leursterritoires respectifsconformémentaux règlesdu
droitinternational applicablesenlamatière» ;

Considérantqu'il estindiqué, dans la notification, que M. Abdulati
Ibrahim El-Obeidi a été désigné comme agen dte la Jamahiriya arabe
libyenneen l'espèce;
Considérant que,le 31 août 1990,une copie certifiée conformede la

notification etdesonannexe a,conformément àl'article39,paragraphe 1,
du Règlementdela Cour, étécommuniquéa eu Gouvernement du Tchad
par le Greffier adjoint;
Considérant que,le le'septembre 1990,le Greffe de la Coura reçu par
télécopiede l'ambassade de la Républiquedu Tchad à Bruxelles une
communication qui reproduisait le texte d'une requêtedu Tchad intro-
ductived'instance contrelaJamahiriya arabe libyennepopulaire etsocia-
liste; quecetterequêteétaitfondée surl'artic2 lea) del'accord-cadre età

titre subsidiaire, sur l'article 8 du traité franco-libyend'amitiéet de bon
voisinagedu 10août 1955 ;
Considérant que,par cetterequête,la République du Tchad

«prie respectueusementlaCour dedéterminerletracédelafrontière
entre la République du Tchad et la Jamahiriya arabe libyenne,
conformément aux principes et règlesde droit international appli-
cablesen la matière entrelesParties» ;

Considérant qu'il est indiqué, dans la requête,que M. Abderah-
man Dadi a été désignc éomme agent de la République du Tchad en Whereas the FrameworkAgreementprovides,in Article 1,that

l'agentdu Tchadanotammentfaitsavoir à laCour queson gouvernement
constataitque «sa demande coïncideaveccellecontenue dans lanotifica-
tion que la Jamahiriya arabe libyenne lui a adresséele 3août 1990»et
considéraitque

«cesdeuxnotifications concernent une affaireunique, dont la Cour
est saisieenapplication del'accordd'Alger,quiconstitue lecompro-
mis,fondement principal de sa compétenceenl'espèce »;

Considérantque leGreffier adjoint atransmisune copie dela lettre du
28septembre 1990 à l'agentde laJamahiriya arabe libyenne;

Considérant que,au cours d'une réunion entrele Présidentde la Cour
et les représentants des Parties tenuele 24 octobre 1990,les agents des
Parties sont convenusqu'en l'espèce l'instanceavaiten fait éintroduite
par deux notifications successivesdu compromis que constitue l'accord-
cadre du 31 août 1989,la notification déposéepar la Jamahiriya arabe
libyenne le31août 1990et la communicationfaite par la Républiquedu
Tchad le3septembre 1990lue àlalumièrede lalettrede l'agentdu Tchad
du 28septembre 1990,etquelaprocédure enl'espècedevaitêtredétermi-
néepar la Coursur cettebase,conformément àl'article46,paragraphe 2,
du Règlementde laCour;

S'étantrenseignéeauprès des Partiessur les délaisde présentation des
piècesde procédure;

Décide,comme prévu àl'article46,paragraphe 2, du Règlementde la
Cour, que chacune des Parties déposera un mémoireet un contre-
mémoiredans lesmêmes délais;

Fixeau 26 août 1991la date d'expiration du délaipour le dépôtdes
mémoires ;
