INTERHANDEL CASE
(SWITZERLAND v. UNITED STATES OF AMERICA)

ORDER

The President of the International Court of Justice,

having regard to Article 48 of theatute of the Court,
having regard to Article 62 of theles of Court;

Having regard to the Order of October 24th, 1957, in the Inter-
handel case, fixing the time-limits for the filing of the Memorial and
Counter-Memorial (or Preliminary Objections) and reserving the
rest of the procedure for further decision;
Having regard to the Order of January 15th, 1958, whereby, on

the joint request of the Parties, expressed in letters from the Agents
both dated January ~oth, 1958, the time-limits for the filing of the
Memorial and Counter-Memorial (or Preliminary Objections) were
extended to April 1st and June 16th respectively, the subsequent
procedure remaining reserved for further decision;
Whereas within the first of these time-limits, the Govemment of
the Swiss Confederation filed its Memorial and whereas within the
second time-limit the Government of the United States of America
filed a document setting forth certain preliminary objections to the
jurisdiction of the Court;

Whereas accordingly, by virtue of the provisions of Article 62,
paragraph 3 of the Rules of Court, the proceedings on the merits
are suspended and a time-limit should be fixed for the presentationby the other Party of a written statement of its Observations and
Submissionsin regard to the said Preliminary Objections;
Whereas in their letters of January ~oth, 1958, upon which the
Order of January 15th, 1958, was made, the Agents of the Parties
both referred to August 1st as the time-limit for the filing of this
Pleading ;

Whereas however, by a letter dated June 18th, 1958, a copy of
which was transmitted on June 19th to the Agent of the Govern-
ment of the Swiss Confederationrequested that October ~st, 1958,
should be fixed asthe time-limit ;

Whereas, in support of his request, he relied upon the fact that
it was agreed between the Agents that they would consult each
other with a view to reaching an agreement regarding this time-
limit, which agreement was established by an exchange of letters
dated February 7th, 1958,in the case of Switzerland and February
America, copies of which he transmitted to the Registry; whereasf
he also relied upon the complexity of the questions raised in the
Preliminary Objections as well asthe novel character of one of the
Objections ;

Whereas by a letter dated June qth, 1958,the Chargéd'affaires
ad interim of the United States of America to the Netherlands
stated that his Government had agreed to the request of the Agent
of the Government of the Swiss Confederation;
Fixes September 22nd, 1958, as the time-limit within which the
Government of the Swiss Confederation may present a written
statement of its Observations and Submissions in regard to the
Preliminary Objections raised by the Government of the United
States of America.

Done in French and in English, the French text being authorita-
June, one thousand Panine hundred and fifty-eight, in three copies,
one of which will be placed in the archives of the Court and the
others transmitted to the Government of the Swiss Confederation
and to the Government ofthe United States ofAmerica,respectively.

Le Président de la Cour Internationale de Justice,

vu l'artic48 du Statut de la Cour,
vu l'article 62 du Règlement de la Cour;

Vu l'ordonnance du24 octobre1957 en l'affaire de l1Interhandel,
fixant les délaispour le dépôt du mémoireet du contre-mémoire
(ou des exceptions préliminaires) et réservant la suite de la procé-
dure ;

Vu l'ordonnance du 15janvier1958 ,ar laquelle, sur demande
conjointe des Parties formuléepar lettres des agents datées l'une
et l'autre dIO janvier1958 ,a date d'expiration des délaispour
le dépôt du mémoire et du contre-mémoire (ou des exceptions
préliminaires) a étéreportée I~~avril et au16 juin respective-
ment, la suite de la procédurerestant réservée;
Considérant que, dans le premier de ces délais, leGouvernement
de la Confédération suissea déposéson mémoire et que, dans le
second, le Gouvernement des Etats-Unis d'Amérique adéposéun
document énonçant certaines exceptions préliminaires à la compé-
tence de la Cour;

Considérant qu'en conséquence, envertu des dispositions de
l'artic62,paragraphe 3, du Règlement de la Cour, la procéduresur
lefond est suspendue et qu'il échetde fixer un délaidans lequel la INTERNATIONAL COURT OF JUSTICE

ORDER

Considérant que, dans leurs lettres duIO janvier 1958, à la suite
desquelles a étérendue l'ordonnance du 15 janvier 1958, les agents
des Parties avaient l'un et l'autre fait mention du I~~août comme
date d'expiration du délai pour le dépôt decette pièce;
Considérant toutefois que, par lettre du 18 juin 1958,dontcopie
a ététransmise le 19 juin à l'agent du Gouvernement des Etats-

Unis d'Amérique, l'agent du Gouvernement de la Confédération
suisse a demandé que soit fixéela date du ~~roctobre 1958;

Considérant que, pour fonder sa demande, il invoque qu'il a été
convenu entre les agents qu'ils se consulteraient afin d'aboutir à un
accord sur ce délai, accord qui a étéétabli par un échange de
lettres du 7 février 1958 pour la Suisse et du 25 février 1958 pour
l'acceptation des États-unis d'Amérique,lettres dont il transmet
la copie au Greffe; qu'il invoque également la complexité des ques-

tions soulevées dans les exceptions préliminaires, ainsi que le
caractère nouveau pris par l'une de ces exceptions;

Considérant qpe, par lettre du 25 juin 1958, le chargé d'affaires
ad interim des Etats-Unis d'Amériqueaux Pays-Bas a fait savoir
que son gouvernement avait donné son accord à la demande de
l'agent du Gouvernement de la Confédérationsuisse;

Fixe au 22 septembre 1958 la date d'expiration du délai dans
lequel le Gouvernement de la Confédération suissepourra déposer
un exposéécrit contenant ses observations et conclusions syr les
exceptions préliminaires soulevéespar le Gouvernement des Etats-
Unis d'Amérique.

Fait en français et en anglais, le texte français faisant foi, au
Palais de la Paix, à La Haye, le vingt-six juin mil neuf cent cin-
quante-huit, en trois exemplaires, dont l'un restera déposéaux

archives de la Cour et dont les autres seront transmis respective-
ment au Gouvernement de la Confédération suisseet au Gouverne-
ment des Etats-Unis d'Amérique.
