Having regard to Article 48of the Statute of theCourt.

Having regard to Articles 31,40,44,48 and 79of the Rules of Court.
Having regard to the Application filed by the Republic of Nicaragua in
the Registry of the Court on 28 July 1986,instituting proceedings against
the Republic of Hondura;

Whereas the Republic of Honduras was on the same day informed by
telegram of the filing of the Application, and of the submissions made
therein. and was immediately sent a copy;of it

Whereas in a letter dated 29 August 1986 the Minister for External
Relations of Honduras informed the Court that in hisGovernment's view

Vu la requête enregistréeau Greffe de la Cour le 28juillet 1986 par
laquelle la Républiquedu Nicaragua a introduit une instance contre la
Républiquedu Honduras;
Considérant que la Républiquedu Honduras a étéle jour avisée
par télégrammedu dépôt de la requête ainsique des conclusioys qui
figuraient. et qu'une copie de cette requêtelui a ététransmise immédiate-
ment :

Considérantquedans une lettre en datedu 29 août 1986le ministre des
relations extérieuresde la Républiquedu Honduras a fàila Courr

expressed thehope that the Court would first confinethe written proceed-
ings to the issuesofjurisdiction and admissibility ;

Whereas the Partieshave appointed as agents their respectiveAmbassa-

dors inThe Hague,namely Mr.Carlos Argüello Gomez for the Republic of
Nicaragua and Mr. Mario Carias for the Republic of Honduras :

Whereas the Parties are agreed that the issuesofjurisdiction and admis-
sibility should be dealt with at a preliminary stage of the proceedings ;

Whereas it is necessary for the Court to be informed at that stage of al1
the contentions and evidence of fact and law on which the Parties rely in
that connection :
Taking into account the agreement concerningtheprocedure expressed
by the Parties,consulted under Article 31 of the Rules ;

Decides that the first pleading shall be a Memorial by the Republic of
Honduras dealing exclusively with the issues ofjurisdiction and admissi-
bility. and that the Republic of Nicaragua shall in reply submit a Counter-
Memorial confined to the same issues ;
Fixes the following time-limits for the filing of those pleadings:

23 February 1987for the Memorial of Honduras ;
22June 1987fortheCounter-Memorial of Nicaragua ;

And reserves thesubsequentprocedurefor further decision.

Done in English and in French, the English text being authoritative, at
the Peace Palace,The Hague, this twenty-second day of October, one thou-
sand nine hundred and eighty-six, in three copies, of which one will be
placed in the archives of the Court. and the others transmitted to the

Government of the Republic of Nicaragua, andto the Government of the
Republic of Honduras, respectively.

compétence et de recevabilitésoient traitéesà un stade préliminaire de la

procédure ;
Considérant qu'il est nécessaireque la Cour soit informéeà cestade de
tous les moyens de fait et de droit sur lesquels les Parties se fondent à ce

sujet ;
Compte tenu de l'accord intervenu entre les Parties. consultéesen vertu
de l'article 31 du Règlement, au sujet de la procédure ;

Décideque la Répiibliquedu Honduras présentera.en tant que première
piècede la procédure écrite,un mémoireconsacréaux seules questions de
compétence et de recevabilitéet que la République du Nicaragua présen-

tera en réponseun contre-mémoire limitéaux mêmesquestions ;
Fixe comme suit la date d'expiration des délais pour le dépôt de ces
pièces :

Pour le mémoirede la République du Honduras. le 23 février 1987 :
Pour le contre-mkmoire de la République du Nicaragua, le 22 juin

1987 ;
Réservela suite de la procédure.

Fait en anglais et en français, le texte anglais faisant foi, au palais de la
Paix. à La Haye, le vingt-deux octobre mil neuf cent quatre-vingt-six. en
trois exemplaires, dont l'un restera déposéaux archives de la Cour et les
autres seront transmis respectivement au Gouvernement de la République
du Nicaragua et au Ciouvernement de la République du Honduras.
