ORDER
The President of the International Court of Justice,
Havingregard to Article 48ofthe Statute oftheCourt, andto Article 89
of theRules of Court,
Havingregard to the Application filed bythe Republicof Nicaragua on
9 April 1984by which the proceedings in this casewere instituted against
the United States of America,
Having regardtothe Judgment delivered bythe Court on 27June 1986,
by which it found (interajthat the United States of America was under
an obligation to make reparation to the Republic of Nicaragua for al1
injury caused to Nicaragua by certain breaches of obligations under cus-
tomary international law and treaty-law committed by the United States
of America; decided thatthe form andount of such reparation, failing
agreement between the Parties,would be settled by the Court, and
reserved, forthat purpose, the subsequent procedure in the case,
Having regard to the Order made bythe Court on 18November 1987 by
which it fixed time-limits for written proceedings on the question of the
form and amount of reparation to be made in the case, and having regard
tothe Memorial on that question filed by Nicaragua on 29 March 1988;
Whereas on 15June 1990a letter was addressedtoeach ofthe Parties by
the Registrar enquiring as to their views on the date to be fixed for the48 MILITARY AND PARAMILITARY ACTIVITIES (ORDER 26 IX 91)
opening oftheoral proceedings on the question ofreparation; whereas no
reply tothat letter was received from the United States, and the Agent of
Nicaragua, in his reply, indicated the special circumstances that would
make it extremelyinconvenient forthe Government of Nicaragua to take
a decision on what procedure to follow in this case during the ensuing
months; and whereas therefore it was decided not to fix any date forthe
oral proceedings;
Whereas by a letter dated 12September 1991the Agent of Nicaragua
informedthe Courtthat his Governmenthad decided to renounce al1fur-
ther right of action based on the case and did not wish to go on with the
proceedings, and requested thatan Order be made officially recording the
discontinuance of the proceedings and directing the removal of the case
from the list;
Whereas a copy of that letter was forthwith transmitted to the Govern-
ment of the United States of America, which was at the same time
informed that the President had fixed 25September 1991asthe time-limit
within which the United States might statewhether it opposedthe discon-
tinuance of the proceedings, in accordance with Article 89, paragraph 2,
of the Rules of Court;
Whereas by a letter dated 25 September 1991,received in the Registry
by facsimile thesame day,the Legal Adviser of the United States Depart-
ment of State informed the Court that the United States welcomed the
Nicaraguan request fordiscontinuance of the proceedings,
Placeson record the discontinuance by the Republic of Nicaragua of
the proceedings instituted by the Application filed on 9 April 1984;and
Ordersthat the casebe removed from the list.
Done in English and in French, the English text being authoritative, at
the Peace Palace, The Hague, this twenty-sixth day of September, one
thousand nine hundred and ninety-one, in three copies, one of which will
be placed in the archives of the Court and the others transmitted to the
Government of the Republic of Nicaragua and the Government of the
United States of America, respectively.

ORDONNANCE
Le Présidentde la Cour internationale de Justice,
Vu l'article 48 du Statut de la Cour et l'article 89de son Règlement,
Vu la requête déposépar la République du Nicaragua le 9 avril 1984
par laquelle la présente instance a étéintroduite contre les Etats-Unis
d'Amérique,
Vul'arrêtrendu par la Cour lejuin 1986,par lequel la Cour a dit no-
tamment que les Etats-Unisd'Amérique sont tenus envers la République
du Nicaragua de réparertout préjudice causéelle-ci par certaines vio-
lations d'obligations imposéespar le droit international coutumier et le
droit conventionnel, commises par les Etats-Unis d'Amérique; décidé
que lesformes et le montant de cette réparation seraienpar la Cour
au casoù les Partiesne pourraient se mettre d'accordjet, et résàrvé
cet effet la suite de la procédure,
Vu l'ordonnance dlu 18novembre 1987par laquelle la Cour a fixédes
délaispour la procédure écritesur laquestiondesformeset du montant de
la réparation due en l'espèce,et vu le mémoire relàtcette question
déposéparle Nicaragua le29 mars 1988;
Considérant que, le 15juin 1990,une lettreadresséea chacune des
Parties par le Greffier afinde s'informer de leur opinionquantte a48 MILITARY AND PARAMILITARY ACTIVITIES (ORDER 26 IX 91)
opening oftheoral proceedings on the question ofreparation; whereas no
reply tothat letter was received from the United States, and the Agent of
Nicaragua, in his reply, indicated the special circumstances that would
make it extremelyinconvenient forthe Government of Nicaragua to take
a decision on what procedure to follow in this case during the ensuing
months; and whereas therefore it was decided not to fix any date forthe
oral proceedings;

réparation; considérantqu'aucune réponse àcette lettre n'a éreçue des
Etats-Unis, et que l'agent du Nicaragua, dans sa réponse,a indiqué les
circonstances particulières en raison desquelles il serait extrêmement
difficile au Gouvernement du Nicaragua de prendre une décisionsur la
procédure àsuivre eril'espèceaucoursdesprochains mois etconsidérant
qu'il a étédécidé,en conséquence,de ne pas fixer de datepour la procé-
dure orale;
Considérant que, par une lettre datéedu 12septembre 1991,l'agent du
Nicaragua a informé la Cour que son gouvernement avait décidéde
renoncer à faire valoir tous autres droits fondés sur cette affaire et ne
souhaitait pas poursiiivrela procédure, et a demandéqu'une ordonnance
prenne acte du désistementet prescrive la radiation de l'affaire du rôle;
Considérant que copie de ladite lettre a été communiquéeaussitôt au
Gouvernement des Etats-Unis, qui a étéen mêmetemps informé que le
Présidentavaitfixéau 25septembre 1991l'expiration du délaidans lequel
les Etats-Unis pouvaient déclarer s'ils s'opposaient au désistement,
conformément à l'article 89,paragraphe 2, du Règlementde la Cour;
Considérant que, par une lettre datée du 25 septembre 1991,reçue au
Greffe lemêmejour par télécopie,leconseillerjuridique du département
d'Etat des Etats-Unis a fait savoià la Courque les Etats-Unis se félici-
taient de la demande en désistementdu Nicaragua,
Prendacte du désistementde la Républiquedu Nicaragua de l'instance
introduite par la requête enregistréele 9 avril 1984;et
Ordonneque l'affaire soit rayéedu rôle.
Fait en anglais et en français, letexte anglais faisant foi, au Palais de la
Paix,à La Haye, levingt-sixseptembre milneuf centquatre-vingt-onze,en
trois exemplaires, dont l'un restera déposéaux archives de la Cour et les
autres seront transniis respectivement au Gouvernement de la Répu-
blique du Nicaragua et au Gouvernementdes Etats-Unis d'Amérique.
