After deliberation,

Having regard to Articlesparagraph 2,3 1and 48 of the Statute of
the Court, and to Articles 17,,44,91 and 92 ofthe Rules of Court,
MakesthefollowingOrder:

1. Whereas, by an Application filed in the Registry of the Court on
6 February 1987,the United States of America instituted proceedings
againstthe RepublicofItalyinrespectofadisputeingoutofthe requi-
sitionbytheGovernment ofItalyoftheplant and related assetsofElettro-

nica SiculaS.P.A.(ELSI),an Italian Companywhichisstatedto havebeen
100per cent owned by two United Statescorpora;ions
2. Whereasbylettersdated 6February 1987the United StatesSecretary
ofStateand the Chargéd'affairesnterimofthe United StatesofArner-
ica accredited to the Kingdom of the Netherlands informed the Court
that the Honorable Abraham D. Sofaer was appointed Agent of the4 ELETTRONICA SICULA (ORDER 2 III 87)

United States, and that the Government of the United States requested,
pursuant to Article 26, paragraph 3, of the Statute of the Court, that a
Chamber be formed, composed offivejudges, to hear and determine the
case ;
3. Whereas by a telegram dated 13 February 1987the Minister for

Foreign Affairs of Italy informed the Court that Professor Luigi Ferrari
Bravo was appointed Agent of Italy and that the Government of Italy
accepted the proposa1 put forward by the Government of the United
States, that the case be heard by a Chamber composed in accordance
with Article 26 of the Statute, and this acceptance was confirmed by a
letter dated 13February 1987from the Agent ofItaly ;
4. Whereasthe Court thus hasbeforeitarequestbythetwoPartiesthat
the case be heard and determined by a Chamber formed to deal with the
case ;and whereasthe Partieshavebeen dulyconsulted astothe composi-
tion oftheproposed Chamber ofthe Court in accordance withArticle26,
paragraph 2, of the Statute and Article 17,paragraph 2, of the Rules of

Court ;
5. Whereas the Parties, consulted with regard to questions of proce-
dure pursuant to Article31ofthe RulesofCourt, haveindicated that they
are in agreement ona period oftwomonths beingfixed forthe Memonal
ofthe United StatesofAmericaand sixmonths forthe Counter-Memorial
of Italy;

Unanimously,
1. Decidesto accede to the request of the Governments of the United
States of America and Italy to form a special Chamber of fivejudges to

deal withthe present case ;
2. Declaresthat at an election held on 2 March 1987the following
Members ofthe Court wereelectedtothe Chamber :
President Nagendra Singh,
Judges Oda,

Aga,
Schwebel,
SirRobert Jennings ;
3. Declaresa Chamber to deal with this caseto have been duly consti-
tuted bythe present Order, withthe composition indicated above ;

4. Fixesthe following time-limitsfor the initial pleadings in the case :

15May 1987forthe Memorial ofthe United Statesof America ;
16 November 1987 for the Counter-Memorial of the Republic of
Italy ;

selon eux contrôléeà 100pour cent par deux socses Etats-Uni;
2. Considérant que,par lettres datéesdu 6 février1987,le secrétaire
d'Etat des Etats-Unis d'Amérique et le chargé d'asar intérimdes
Etats-Unis d'Amérique accrédiauprès du Royaume des Pays-Basont

United States, and that the Government of the United States requested,
pursuant to Article 26, paragraph 3, of the Statute of the Court, that a
Chamber be formed, composed offivejudges, to hear and determine the
case ;

chambre composée de cinq juges soit constituée pour statuer en l'es-
pèce ;
3. Considérant que,par télégramme datédu 13février1987,leministre
des affaires étrangères d'Italie a fait savoirà la Cour que M. Luigi
Ferrari Bravo avait étédésigné comme agentde l'Italie et que le Gou-
vernement italien acceptait la proposition du Gouvernement des Etats-
Unis tendant à ce que I'affairesoit portéedevant une chambre composée
conformément à l'article 26 du Statut, et que cette acceptation a été
confirméepar lettrede l'agentde l'Italie en date du 13février1987;
4. Considérant que la Cour est ainsi saisie d'une demande des deux
Partiesvisant àceque I'affairesoitportéedevant une chambreconstituée

à cet effet; et considérant queles Parties ont étédûment consultéesau
sujet de la composition de ladite chambre de la Cour conformément à
l'article 26,paragraphe 2, du Statut eàl'article 17,paragraphe 2, du Rè-
glement de la Cour ;
5.Considérantque les Parties, consultées surles questions de procé-
dure conformément àl'article 31 du Règlementde la Cour, ont indiqué
qu'elles étaient d'accordpour que soient fixésun délaide deux mois
pour le dépôt dumémoire des Etats-Unis d'Amériqueet un délaide six
mois pour le dépôtdu contre-mémoirede l'Itali;

àl'unanimité,

1. Décide d'accéder àla demande des Gouvernements des Etats-Unis
d'Amériqueet de l'Italie tendant à ce que soit constituéeune chambre
spécialede cinqjuges pour connaître de la présente affaire;
2. Déclarq eue,lorsd'une électiontenuele2mars 1987,lesmembresde
la Cour dont les noms suivent ont été élums embres de la Chambre :
