ORDER

The President of the International Court of Justice,

Having regard to Article 48 of theStatute of the Court, and to
Articles1, 44 and 45 of the Rules of Court,
Havingregard to theApplicationby the United States of America filed
in the Registry of the Court on 29 November 1979,institutingproceedings
against the IslamicRepublic of Iran in respect of a disputeconcerningthe
situation in the United States Embassy in Tehran and the seizure and
holding as hostages of members of the United States diplomatic and
consular staff in Iran
Whereas on the day on which the Application was received in the
Registry, the Government of Iran was notified by telegram of the filing
thereof, and of the submissions therein made, and in accordance with

Article 40, paragraph 2, of the Statute, a copy of the Application was the
same day communicated to the Governrnent of Ira;
Having regard to the letter of 9December 1979, transrnitted by tele-
gram,fromtheMinister for Foreign Affairs ofIran, settingout theposition
of the Government of Iran with respect to theproceedings,and maintain-
ing(inter alion various grounds that the Court cannot and should not
take cognizance of the ca;e
Whereas the Government of Iran didnot appoint an agent,and wasnot
represented at the hearing on 10December 1979,on the request by the
United States of America dated 29November 1979for the indication of 24 DIPLOMATIC AND CONSULAR STAFF (ORDER 24 XII 79)

provisionalmeasures, ofwhichhearing it had been notified by telegramsof
29November and 3 December ;

Havingregard to the Order madeby the Courton 15December 1979,by
whch the Court indicated provisional measures in the case, pursuant to
Article 41ofthe Statute, whichindicationin nowayprejudges thequestion
of the jurisdiction of the Court to deal with the merits of the case or any
question relating to the merits themselves ;

Having ascertained the views of the Applicant, and having given the
Respondent an opportunity of stating its views ;
Taking into account the circumstances of the case,

Fixes as follows the time-limits for the written proceedings :

15January 1980for the Memorial of the United States of America ;

18February 1980for the Counter-Memorial of the IslamicRepublic of
Iran, with liberty for the IslamicRepublic, if it appoints an Agent for the
purpose of appearingbefore the Courtand presenting its observations on
the case, to apply for reconsideration of such time-limit ;

And reserves the subsequent procedure for further decision.

Done in English and in French, the English text being authoritative, at
the Peace Palace, The Hague, this twenty-fourth day of December, one
thousand nine hundred and seventy-nine,in three copies,one ofwhichwill
be placed in the archives of the Court, and the others transmitted to the
Government of the United States of America, and to the Government of

the Islamic Republic of Iran, respectively.

Le Présidentde la Cour internationale de Justice,
Vu l'article 48 du Statut de la Cour et les articles 31, 44 et 45 du
Règlement de la Cour,
VularequêteenregistréeauGreffele29novembre 1979,par laquelle les

Etats-Unis d'Amérique ont introduit une instance contre la République
islamique d'Iran au sujet d'un différend concernant la siàul'am-
bassade des Etats-UniàTéhéran ainsiquela prise en otageset la déten-
tion de membres du personnel diplomatique et consulairedes Etats-Unis
en Iran;
Considérant que, lejour où la requête introductive d'instance est par-
venue au Greffe,leGouvernement de l'Iran aavisépar télégrammede
son dépôt et des conclusions qui y figuraient et que, conforméàent
l'article 40, paragraphe 2, du Statut, copie de cette requêtelui a étécom-
muniquée lemêmejour ;

Vu la lettre du 9 décembre1979,transmisepar télégram,ar laquelle
le ministre des affaires étrangères d'Iran a fait connaître la position du
Gouvernement de l'Iran par rapporà l'instance et où il est notamment
affirmé que, pour divers motifs, la Cour ne peut et ne doit se saisir de
l'affaire

s'estpas fait représenteraudience du 10décembre1979consacrée àla

Pour le dépôtdu contre-mémoirede la Républiqueislamique d'Iran, le
18février1980,étantentendu que, si la Républiqueislamique désigneun
agent pour comparaître devant la Cour et présenter des observations
sur l'affaire, il lui sera loisible de demander que cette date soit reconsi-
dérée ;

Réservela suite de la procédure.

Fait en anglais et enfrançais, le texte anglais faisant foi, au palais de la

Paix, àLa Haye,le vingt-quatre décembremilneuf centsoixante-dix-neuf,
en trois exemplaires, dont l'un restera déposéaux archives de la Cour et

Etats-Unis d'Amériqueet au Gouvernement de la Républiqueislamique
d'Iran.
