REQUEST FOR THE INDICATION OF PROVISIONAL
MEASURES

ORDER

The President of the International Court of Justice,
Havingregard to Articles 41 and 48of the Statute of the Court,

Havingregard to Articles 73 and 74of theles of Court,
Havingregard to the Application filed bythe Republic of Nicaragua in
the Registry of the Court on 28July 1986,instituting proceedings against
the Republic of Honduras,

Having regard to theOrder made by the Court on 22 October 1986by
which the Court,taking note that the Government of Honduras had in-
formed the Court that in its view the Court had no jurisdiction overthe
matters raised by the Application, decided that the first pleading should
be a Memorial by Honduras dealing exclusively with the issues ofs-
diction and admissibility, and that Nicaragua should in reply submit a
Counter-Memorial confined to the same issues;
Whereas a Memorial and Counter-Memorial onthe issues of jurisdic-
tion and admissibility were duly filed within the time-limits fixed by the
Court therefor, and the case became ready for hearing onJune 1987,

but the opening ofthe oralproceedingshasbeendjourned, byagreement
between the Parties with the approval of the Court;10 ARMED ACTIONS (ORDER 31III 88)

Having regard to the request dated 21 March 1988,and filed in the
Registry the same day, whereby the Republic of Nicaragua, relying on
Article 41 of theStatute and Article 73 of the Rules of Court, requested
the Court to indicate "the interim measures of protection appropriate
in the circumstances resulting from the recent actions of the Honduran

Government directed against the armed forces and territorial sovereignty
of Nicaragua", and specified, in accordance with Article 73,paragraph 2,
of the Rules of Court, the measures requested;
Whereas a certified copy of thesaid request was forthwith transmitted
by the Registrar to the Government of Honduras, and on 24 March 1988
the Registrar informed the Parties that the President of the Court would
hold a meeting with the Agents, on 29 March 1988(subsequently post-
poned to 1 April 1988),in order to ascertain their viewson the procedure,
and recalled that the decision on such arequest wasrequired tobereached

asa matter ofurgency, and that the Court orthe President wasrequired by
the Rules of Court to fixa date forahearing on the request;
Whereas by a letter dated 3 1March 1988,and receivedin the Registry
the same day, a copy of which was forthwith transmitted by the Registrar
to the Agent of Honduras, the Agent of Nicaragua informed the Court
that,for the reasonsset out in histter,the Government of Nicaragua had
instructed him to withdraw the request for the indication of provisional
measures ;

Places onrecordthe withdrawal by the Republic of Nicaragua of its
request forthe indication of provisional measures.

Done in English and in French, the Englishtext being authoritative, at

the PeacePalace, The Hague,this thirty-first day of March, onethousand
nine hundred and eighty-eight,inthreecopies, one ofwhichwillbeplaced
inthe archives ofthe Courtand the otherstransmitted to the Government
of the Republic of Nicaragua, and the Government of the Republic of
Honduras, respectively.

qu'a son avis elle n'avait pas compétencepour connaître des questions

laquelle la République du Nicaragua, sefondant sur l'article41du Statut
et l'article3 du Règlement de la Cour, a prié la Cour d'indiquer «les
mesures conservatoires appropriées aux circonstances crééespar les ré-
centes actions du Gouvernement du Honduras dirigées contreles forces
arméeset la souverainetéterritoriale du Nicaraguaet a précisé,confor-
mément àl'article 73, paragraphe 2, du Règlement de la Cour, quelles
mesureselle demandait;
Considérant qu'une copie certifiée conformede ladite demande a été
immédiatementtransmisepar leGreffier au Gouvernement du Honduras

etque, le24mars 1988,leGreffier ainformélesParties que lePrésidentde
la Cour seréunirait avecleursagentsle29mars 1988(datereportéepar la
suite aule'/ri1 1988)pour serenseigner auprèsd'euxsur laprocédure, et
qu'il arappelé quela décisionsur la demande devait êtreprise d'urgence
et que le Règlementde la Cour prescrivaitla Cour ou àson Présidentde
fixerla date de laprocédureorale sur la demande;
Considérantque,par une lettredatéedu 3 1mars 1988etreçue au Greffe
lemême jour, dont copie aétéimmédiatementtransmise à l'agentdu Hon-
duras par leGreffier,l'agent du Nicaragua ainformélaCourque, pour les

raisons exposéesdans sa lettre, son gouvernement lui avait donnépour
instructions de retirer la demande en indication de mesures conserva-
toires;
Donneacte à la République du Nicaragua du retrait de sa demande en
indication de mesures conservatoires.

Fait en anglais et en français, letexte anglais faisant foi, au palais de la
Paix, àLa Haye, le trente et un mars mil neuf cent quatre-vingt-huit, en
trois exemplaires, dont l'un restera déposéaux archives de la Cour et les
autres seront transmis respectivement au Gouvernement de la Répu-
blique du Nicaragua et au Gouvernement dela Républiquedu Honduras.
