WESTERN SAHARA
(REQUEST FOR ADVISORY OPINION)
ORDER
The President of the International Court of Justice,
Having regard to Article 66, paragraph 2, of the Statute of the Court;
Whereas, on 13December 1974,the General Assembly of the United
Nations adopted a resolution requesting the International Court of
Justice to givean advisory opinion on the following questions:
"1. Was Western Sahara (Rio de Oro and Sakiet El Hamra) at the
time of colonization by Spain a territory belonging to no one
(terra nullius)?
If the answer to the first question is in the negative,
II. What werethe legalties betweenthis territory and the Kingdom
of Morocco and the Mauritanian entity?"
Whereas certified true copies of the English and French texts of the
aforesaid resolution of the General Assembly were transmitted to the
Court by a letter of the Secretary-General of the United Nations dated
17December 1974and filedin the Registry on 21 December 1974;
Whereasthe GeneralAssemblyhas requested that the advisory opinion
of the Court be givenat an early date, and having regard to Article 87,
paragraph 2, of the Rules of Court; Fixes 27March 1975 as the time-limit within which written statements
may be submitted in accordance with Article 66, paragraph 2, of the
Statute of the Court;
Reservesthe subsequent.procedure for further decision.
Done in French and in English, the French text being authoritative,
at the Peace Palace, The Hague, this third day of January, one thousand
nine hundred and seventy-five.

Le Présidentde la Cour internationale de Justice,
Vu l'article 66, paragraphe, du Statut de la Cour;
Considérantque le 13décembre1974l'Assembléegénérale des Nations
Unies a adopté une résolution demandant à la Cour internationale de
Justice de donner un avis consultatif sur les questions suivantes:
((1. Le Sahara occidental (Rio de Oro et Sakiet El Hamra) était-il,
au moment de la colonisation par l'Espagne, un territoire sans
maître (terra nullius)?
Si la réponseàla première question est négative,
II. Quels étaientlesliensjuridiques de ceterritoire avecle Royaume
du Marocet l'ensemblemauritanien? ))
Considérantque la copiecertifiéeconforme destextesfrançais et anglais
de la susdite résolution de l'Assemblée généalété transmiseà la Cour
par une lettre du Secrétaire généradle l'organisation des Nations Unies
du 17décembre1974enregistréeau Greffe le 21 décembre 1974;
Considérant que l'Assemblée générala e demandé que l'avis consul-
tatif de la Cour soit donné à une date 'rapprochée, et eu égard à
