ORDER

The President of the International Court of Justice,

Having regard toArticle48of thetatute of the Court and to Article 88
of theRules of Court,
Havingregard to theApplicationby the United States ofAmericafiled
in the Registry of the Court on 29November 1979instituting proceedings
againstthe IslamicRepublic of Iranin respectof adispute concerningthe
seizure and holding asostages of members of the United States diplo-
matic and consular staff in Iran,

Havingregard totheJudgment givenbytheCourt on24May 1980in the
proceedingsthus instituted, by whichthe Court decided inter aliathat the
Government of the Islamic Republic of Iran wasder an obligation to
make reparation to the Government of the United States of America for
theinjury caused to the latter in the circumstancesdescribedin the Judg-
ment, and that the form and amount of suchreparation, failingagreement
between the Parties,ould be settledby the Court, and reservedfor that
purpose the subsequent procedure in the case,
Whereas no requesthas been made to the Court to settle the form and
amount of such reparation;

Whereasby a letter dated 6April 1981the Deputy Agent of the United
States informed the Court "Effective 19January 1981the United Statesand Iran entered into
certain mutual commitments in order to resolve the cnsis arising out
of the detention of the fifty-twoUnited Statesnationals, and for the

settlement of claimsbetweenthe United States and Iran, as reflected
in two declarations issued on that date by the Government of the
Democratic and Popular Republic of Algeria. Those declarations
provide that upon thecertificationby theGovernment of Algena that
the fifty-two U.S. nationals had safely departed from Iran, 'the
United States willpromptly withdraw al1claimsnowpendingagainst
Iran before the International Court of Justice. ..' " ;

Whereas certified copiesof the two Declarations of the Govemment of
the Democratic and Popular Republic of Algeria dated 19January 1981,
referred to in thesaid letter, originals of whichwereonthat date initialled
by duly authorized representatives of theGovernment of theUnited States
of Arnerica and the Government of the Islamic Republic of Iran, have
since been furnished to the Court by the Deputy Agent of the United
States ;

Whereas in the said letter of 6 April 1981 the Deputy Agent of the
United States,referring to Article 88,paragraph 1,of the Rules of Court,
requested on behalf ofhisGovernmentthat al1proceedingspending before
the Court relating to United States claims against Iran for reparation be
discontinued ;
Whereas in the said letter the Deputy Agent of the United States
nevertheless went on to state -

"The United States reservesthe right, however, to reinstitute such
proceedings if the Government of Iran fails to live up to its commit-
ments under the foregoingdeclarations. Independently of the fore-
going, theUnited States reservestheright to seekredressin the Court
if Iran fails to return promptly the premises, property, archives and
documents of the United StatesEmbassyin Tehran and of its Con-

sulates in Iran." ;

Whereas in response to a letter from the President of the Court dated
15April 1981,in which itwas observed that a discontinuance subject to a
right to reinstitute andpursue the proceedings could not be consideredby
the Court as fallingwithinthe termsofArticle 88of theRulesof Court, the
Deputy Agent of the United States,by letter of 1May 1981,gave certain
explanations and informed the Court that

"In seekinga discontinuance, weintend that al1currentlypending
proceedings relating to the United States claims against Iran for
reparation be discontinued,and that the Court issue an order record-
ingthediscontinuanceanddirecting theremovalof thoseproceedings
from the list",and that the statement in the letter of 6 April quoted above

"was not meant to condition or qualifythe normal procedural effect
of a discontinuance" ;

Whereascopiesof the letters of 6 and 15April and 1May 1981,recited
above,weretransmitted by theRegistrar to the Governmentof Iran ;and
whereas no communication has been receivedfrom the Govemment of
Iran ;

Whereas the Court has thus been notified separately by one of the
Parties of a commitment by that Party, the Applicant in the case,in the
contextof an agreedsettlementarrivedat betweenthe twoParties,that al1
its claimsbefore the Court shouldbe withdrawn ;and whereasthe other
Party, havingbeeninformed of suchnotification,has not addressedto the
Court any observation ;
Havingregardto theadherencebythePartiestothe twoDeclarationsof
the Government of Algena dated 19 January 1981 ;

Being satisfied that it is the common intention of the Parties that the
proceedingsbefore the Court should now be brought to an end by their
unconditional discontinuance, and being satisfied that the case should
accordinglybe removed from the list ;

Places on record the discontinuance of the proceedings in the case,
followingupon an agreementbetween the Parties ;and
Directsthat the case be removedfrom the list.

Done in Englishand in French, the English textbeing authoritative, at
the PeacePalace,The Hague, this twelfthday of May, one thousand nine

hundred and eighty-one,in threecopies,oneofwhich willbeplacedin the
archivesof theCourt,and theotherstransmitted to theGovernment ofthe
United Statesof Americaand the Government of the IslamicRepublicof
Iran, respectively.

Le Présidentde la Cour internationale de Justice,
Vu l'article48 du Statut et l'article 88 du Règlementde la Cour,

Vula requêteenregistréeauGreffe29novembre 1979,par laquelleles
Etats-Unis d'Amériqueont introduit une instance contre la République
islamiqued'Iran au sujetd'un différendconcernantla priseenotageset la
détention demembres du personneldiplomatique et consulairedesEtats-
Unis en Iran,
Vu I'arrêrtendu par la Courle 24mai 1980enl'instance ainsiintroduite,
par lequel la Cour a décidé en particulier que le Gouvernement de la
Républiqueislamiqued'Iran était tenuenversleGouvernementdesEtats-
Unis d'Amériquede l'obligation de réparerle préjudice causéui-ci
dans lescirconstancesexposéesdans l'arrêtet quelesformes et lemontant
de cette réparation seraient régléspar la Cour au cas où les Parties ne

pourraient semettre d'accordsujet,et aréseràcet effetla suitede la
procédure,
Considérantqu'il n'apasétédemandàla Courde réglerlesformesetle
montant de cette réparati;n
Considérant que,par lettre du 6 avril 1981,l'agent adjoint des Etats-
Unis a porté ce qui suita connaissance de la C:ur "Effective 19January 1981the United Statesand Iran entered into

Considérantque l'agent adjoint desEtats-Unis a depuislors fait tenir à
la Cour des copiescertifiéesconformesdesdeux déclarationsdu Gouver-
nement de la République populaireet démocratiqued'Algérieen date du
19janvier 1981,mentionnéesdans ladite lettre, dont lesoriginaux ont été
paraphés àcette date par des représentants dûment autorisésdu Gouver-

nement desEtats-Unis d'Amériqueet du Gouvernementde la République
islamique d'Iran ;
Considérantque dans la lettre susmentionnéedu 6 avril 1981l'agent
adjoint des Etats-Unis, se référantà l'article88,paragraphe 1,du Règle-
ment, demande au nom de son gouvernement qu'il soit mis fin à toutes
instances pendantes devant la Cour au sujet de réparations réclamées à
l'Iran par les Etats-Unis ;

Considérantquedans ladite lettre l'agent adjoint desEtats-Unis ajoute
néanmoins :

Les Etats-Unis se réservent toutefois le droit de réintroduire
lesditesinstances au cas où le Gouvernement de l'Iran ne remplirait
pas les obligations auxquelles il a souscrit en vertu des déclarations
susdites.Indépendamment de cequi précède,lesEtats-Unis seréser-
vent le droit de recourirà la Cour au cas où l'Iran ne restituerait pas
promptement leslocaux,biens, archivesetdocumentsdel'ambassade

des Etats-Unis à Téhéran et de leurs consulats enIran )),

Considérant que,enréponse à unelettre du 15avril 1981,dans laquelle
le Président dela Cour faisait observerqu'un désistementsubordonné au
droit de réintroduireet de poursuivre l'instance ne pouvait êtreconsidéré
par laCour commerépondantaux termesdel'article88desonRèglement,
l'agentadjointdesEtats-Unis, par lettre du ler mai 1981,afourni certaines
explications et précisé à la Cour que :

(<En nous désistant, nous demandons qu'il soit mis fin à toutes
instances en cours concernant les réparationsréclamées à l'Iran par
les Etats-Unis d'Amérique et que la Cour, par une ordonnance,
prenne acte de ce désistementetprescrive que l'affaire soit rayéedu
