CONCERNING SOVEREIGNTY

OVER CERTAIN FRONTIER LAND

ORDER

The President of the InternationCourt of Justice,

having regard to Articles 40 and 48 of theatute of the Court,

having regard to Articles 30 and 37 of thees of Court,
Whereas by a letter of November 26th, 1957, received in the
Registry on November 27th, the Minister for Foreign Affaia.i.
of the Netherlands transmitted to the Registry a certified true
copy of a Special Agreement concluded between the Government
of the Kingdom of Belgium and the Government of the Kingdom of

the Netherlands and signed at The Hague on March 7th, 1957, by
which the Courtis requested to determine whether the sovereignty
over the parcels of land shown in the survey and known from 1836
to 1843 as Nos.91 and 92, Section A, Zondereygen, belongs to the
Kingdom of Belgium or the Kingdom of the Netherlands;
Whereas the Minister for Foreign Affaia.;.of the Netherlands
also attached to histter a certified true copy of the Certificate of
the exchange of instruments of ratification of the Special Agree-
ment which took place at Brussels on November ~gth, 1957;
Whereas, by his said letter, the Minister for Foreign Afa.i.s
of the Netherlands stated that Mr. W. Riphagen, Legal Adviser

to the Ministry for Foreign Affairs, had been appointed as Agent
for the Government of the Netherlands for the purposes of this case;
Whereas Article III of the Special Agreement provides that it

shall be notified to the Court by the Kingdom of the Netherlands;
Whereas, by a letter of November Ath, 1957, the Government
of the Kingdom of Relgium was duly informed of the notification
to the Registry of the Special Agreement;

Whereas, by a letter of December 5th, 1957,the Belgian Ambas-
sador to the Netherlands notified the Court of the appointment by
his Government of M. Y. Devadder, Legal Adviser to the Ministry
for Foreign Affairs, as its Agent for theurposes of this case;
Whereas Article II of the Special Agreement recites the agree-
ment of the Parties that, without prejudice to any question as to
the burden of proof and having regard to Article 37 of the Rules of
Court, the written proceedings should consist of

(1)a Memorial of the Kingdom of Belgium to be submitted to the
Court within three months of the notification of the Agree-
ment ;
(2)a Counter-Memorial of the Kingdom of the Netherlands to be
submitted within three months of delivery of the Memorial
of the Kingdom of Belgium;

(3) a Reply of theKingdom of Belgium followed by a Rejoinder
of the Kingdom of the Netherlands to be delivered within
such times as the Court may order;

Whereas there is no objection to taking this agreement into
account ;
Fixes February 27th, 1958, as the time-limit for the filing of the
Memorial of the Government of the Kingdom of Belgium, and May
29th, 1958, as the time-limit for the filing of the Counter-Memorial
of the Government of the Kingdom of the Netherlands;

And reserves the subsequent procedure for further decision.
Done in French and English, the French text being authoritative,
at the Peace Palace, The Hague, this twelfth day of December,
one thousand nine hundred and fifty-seven, in three copies, one of
which will be placed in the archives of the Court and the others
transmitted to the Government of the Kingdom of Belgium and to
the Government of the Kingdom of the Netherlands, respectively.

ORDONNANCE

Le Président de la Cour internationale de Justice,

vu les articles 4048tdu Statut de la Cour,
vu les articles et37 du Règlement de la Cour,

Considérant que, par lettre d26 novembre 1957 parvenue au
Greffe l27 novembre, le ministre des Affaires étrangères a. i. des
Pays-Bas a transmis au Greffe la copie certifiée conforme d'un com-
promis conclu entre le Gouvernement du Royaume de Belgique
et le Gouvernement du Royaume des Pays-Bas et signéà La Haye
le7 mars 1957, aux termes duquel la Cour est priéede déterminer
si la souveraineté sur les parcelles cadastrales connues de6
à 1843 sous les nos91et 92, Section A, Zondereygen, appartient
au Royaume de Belgique ou au Royaume des Pays-Bas;

Considérant que le ministre des Affaires étrangères. i. des
Pays-Bas a également jointà sa lettre la copie certifiée conforme
du procès-verbal d'échange des instruments de ratificationdu
compromis, échan.e -ui a eu lieuBruxelles l19 novembre 1957;
Considérant que, par sa lettre précitée,le ministre des Affaires

Considérant que l'article III du compromis énonce que celui-ci
sera notifié à la Cour par les soins du Royaume des Pays-Bas;
Considérant que, par lettre du 28 novembre 1957,le Gouverne-
ment du Royaume de Belgique a été dûment informé que le
compromis avait éténotifié au Greffe;

Considérant que, par lettre du 5 décembre 1957, l'ambassadeur
de Belgique aux Pays-Bas a notifiéla désignation par son Gouver-
nement de M. Y. Devadder, jurisconsulte du ministère des Affaires
étrangères, en qualité d'agent aux fins de l'affaire;
Considérant que, dans son article II, le compromis fait état d'un
accord des Parties selon lequel, sans préjuger en rien la charge de
la preuve, elles sont convenues, se référantà l'arti37edu Règle-
ment de la Cour, que la procédure écrite consisterait en:

I. un mémoire du Royaume de Belgique devant être soumis à
la Cour dans les trois 'moissuivant la notification de l'accord;

2. un contre-mémoire du Royaume des Pays-Bas devant être
soumis dans les trois mois suivant la remise du mémoire du
Royaume de Belgique ;
3. une réplique du Royaume de Belgique, suivie d'une duplique

du Royaume des Pays-Bas, devant être soumises l'une et
l'autre dans un délaià fixer par la Cour;
Considérant que rien ne s'oppose à tenir compte de cet accord;

Fixe la date d'expiration des délaispour le dépôt du mémoiredu
Gouvernement du Rbyaume de Belgique au 27 février1958 et pour
le dépôt du contre-mémoire du Gouvernement du Royaume des
Pays-Bas au 29 mai 1958;
Réserve la suite de la procédure.

Fait en français et en anglais, le texte français faisant foi, au
Palais de la Paix, à La Haye, le douze décembre mil neuf cent
cinquante-sept, en trois exemplaires, dont l'un restera déposéaux
archives de la Cour et dont les autres seront transmis respective-
ment au Gouvernement du Royaume de Belgique et au Gouverne-
ment du Royaume des Pays-Bas.
