ORDER

The Judge discharging the duties of President of the International
Court of Justice under Article 12 of the Rules of Court,

Having regard to Articles 40 and 48 of the Statute of the Court and
to Articles2 and 37 of the Rules of Court,
Whereas, by a letter of 16February 1967, receivedin the Registry on
20 February 1967,the Minister of Foreign Affairs of the Kingdom of the
Netherlands transmitted to the Registrar an original copy, signed at
Bonn on 2 February 1967for the Government of the Kingdom of Den-
mark and the Government of the Federal Republic of Germany, of a
Special Agreement for the submission to the International Courtof

Justice of a difference betweenenmark and the Federal Republic of
Germany concerning the delimitation, as between Denmark and the
Federal Republic of Germany, of the continental shelf in the North Sea;
Whereas the Netherlands Minister of Foreign Affairs also attached to
his letter an original copy, signed at Bonn on 2 February 1967for the
Governments of Denmark, the Federal Republic of Germany and the
Netherlands, of a Protocol in which provision ismade for the notification
by the Netherlands Government of thesaid Special Agreement to the
International Court of Justice;

Whereas Article3 of the Special Agreement provides for its entry into
force on the day of signature thereof;

Whereas, by letters dated 20 February 1967, the Governments of
Denmark and the Federal Republic of Germany were duly informed of
the notification of the Special Agreement;
Whereas, by a letter of 22 February 1967,the Danish Ambassador to
the Netherlands informed the Registrar of the appointment of Mr. Bent
Jacobsen, barrister at the Supreme Court of Denmark, as Agent of
Denmark ;

Whereas, by a letter of 1 March 1967,the Ambassador of the Federal
Republic of Germany to the Netherlands infonned the Registrar of the
appointment of Professor Dr. Günther Jaenicke, of the Johann Wolfgang
Goethe University, as Agent of the Federal Republic of Germany;
Whereas Article 2 of the Special Agreement recites the agreement of
the Parties that, without prejudice to any question of burden of proof
which might arise, written pleadings should be presented to the Court in
the order stated below :

(1) a Memorial of the Federal Republic of Germany to be submitted
within six months from the notification of the Special Agreement;
(2) a Counter-Mernorial ofDenmark to besubmitted within sixmonths
from the delivery ofthe German Memorial;

(3) a German Reply followed by a Danish Rejoinder to be delivered
within such time-limits as the Court may order;
Taking this agreement into account, as provided for by paragraph 3
of Article 37 of the Rules of Court,
Fixes 21 August 1967as the time-limit for the filing of the Memorial
of the Federal Republic of Germany and 20 February 1968as the time-

limit for the filing of the Counter-Mernorial of Denmark:

Resewes the subsequent procedure for further decision.
Done in English and in French, the English text being authoritative,
at the Peace Palace, The Hague, this eighth day of March, one thousand
nine hundred and sixty-seven,in three copies, one of which willbe placed
in the archives of the Court and the others transmitted to the Govern-

ment of the Kingdom of Denmark and to the Government of the Federal
Republic of Germany respectively.

ORDONNANCE

Le juge faisant fonction de Président de la Cour internationale de
Justice en vertu de l'article 12du Règlementde la Cour,
Vu les articles 40 et 48 du Statut de la Cour et les articles 32 et 37 du
Règlementde la Cour,

Considérant que, par lettre du 16 février 1967, reçue au Greffe le
20 février 1967, le ministre des Affaires étrangèresdu Royaume des
Pays-Bas a adresséau Greffier un exemplaire original d'un compromis,
signéà Bonn le 2 février1967pour le Gouvernement du Royaume du
Danemark et le Gniivernement de la Républiquefédérale d'Allemagne,
soumettant à la Cour internationale de Justice un différendentre le
Danemark et la République fédérale d'Allemagne relatàfla délimi-
tation du plateau continental de la mer du Nord entre le Danemark et
la Républiquefédéraled'Allemagne;

Considérant que le ministre des Affaires étrangèresdes Pays-Bas a
égalementjointà sa lettre un exemplaire original d'un protocole, signé
à Bonn le 2 février1967pour le Gouvernement du Danemark, le Gouver-
nement de la Républiquefédérale d'Allemagnet le Gouvernement des
Pays-Bas, où il est prévuque ledit compromis sera notifiépar le Gouver-
nement des Pays-Basà la Cour internationale de Justice;
Considérant qu'en vertu de son article 3 le compromis entre en

vigueur lejour de sa signature;

Whereas, by letters dated 20 February 1967, the Governments of

Considérant que, par lettres du 20 février1967,le Gouvernement du
Danemark et le Gouvernement de la République fédérale d'Allemagne
ont étédûment informésde la notification du compromis;
Considérant que, par lettre du 22 février 1967, l'ambassadeur du
Danemark aux Pays-Bas a informéle Greffier que M. Bent Jacobsen,
avocat à la Cour suprêmedu Danemark, avait étédésigné comme agent

du Danemark;
Considérant que, par lettre du le' mars 1967, l'ambassadeur de la
République fédéraled'Allemagneaux Pays-Bas a informéle Greffierque
M. Günther Jaenicke,professeur à l'université JohannWolfgang Goethe,
avait étédésignécomme agent de la République fédérale d'Allemagne;
Considérant que, dans son article 2, le compromis fait état d'un

accord des Parties selon lequel, sans que cela préjugeen rien la charge
de la preuve, les piècesde la procédure écrite seraient déposées devant
la Cour dans l'ordre suivant:
1. Mémoiredela République fédérald e'Allemagnedevant être soumis
dans les six mois qui suivront la notification du compromis;
2. Contre-mémoire du Danemark devant être soumis dans les six

mois qui suivront la remise du mémoireallemand;
3. Réplique allemande suivie d'une duplique danoise, devant être
soumises dans des délaisà fixer par la Cour;
Tenant compte de cet accord, comme il est indiqué à l'article 37,
paragraphe 3, du Règlement de la Cour,

Fixe au 21 août 1967la date d'expiration du délaipour le dépôt du
mémoire dela République fédérale d'Allemagne et au20 février1968la
date d'expiration du délaipour le dépôt du contre-mémoire du Dane-
mark;
Réservela suite de la procédure.

Fait en anglais et en français, le texte anglais faisant foi, au palais de
la Paix,à La Haye, le huit mars mil neuf cent soixante-sept, en trois
exempIaires, dont l'un restera déposé auxarchives de la Cour et dont les
autres seront transmis respectivement au Gouvernement du Royaume
du Danemark et au Gouvernement de la République fédéraled'Alle-
magne.
