The International Court of Justice,
composed asabove,
after deliberation,
having regard to Articles 3648nof the Statute of the Court,
Makes the following O:der
Whereas on7 July1959 the Ambassador of the United States of
America to the Netherlands filed in the Registry an Application
dated8 June 1959and signedbythe Agent for the Govemment ofthe United States of America instituting proceedings before the
Court against the Union of Soviet Socialist Republics "on account
of the destruction on November 7, 1954, of a United States Air
Force B-29 aircraft in the Japanese territorial air space over
Hokkaido, Japan" ;
Whereas the Application was duly communicated by the Registry
on 7 July 1959 to the Ambassador of the Union of Soviet Socialist
Republics to the Netherlands ;
Whereas the Application was also communicated by the Registry
to the Members of the United Nations, through the Secretary-
General of the United Nations, and to the other States entitled to
appear before the Court;
Whereas the Application contains the following paragraphs:
"The United States Government, filing this application with the
Court, has submitted to the Court's jurisdiction fcr the purposes of
this case. The Soviet Government appears not to have filed any
declaration with the Court thus far. It was invited to do so by the
United States Government as to the present dispute in the note of
June 19, 1958. The Soviet Government has sent a negative reply
thereto. The Soviet Government is, however, qualified to submit to
the Court in this matter and may, upon notification of this appli-
cation by the Registrar, in accordance with the Rules of the Court,
take the necessary steps to enable the Court's jurisdiction over
both Parties to the dispute to be confirmed.
The United States Govemment thus founds the jurisdiction of
this Court on the foregoing considerations and on Article 36 (1)
of the Statute."
Whereas in a letter in Russian, dated 31 August 1959, from the
Chargé d'affaires of the Union of Soviet Socialist Republics in the
Netherlands to the Registrar, accompanied by an unofficial English
translation, it was stated that :
"The Government of the USSR in its note of March 4 1959 to
the Government of the USA o~ithis question asin its previous notes
of November 7 and December II 1954 and of August 19, 1957,
pointed out that the violation of the Soviet State border by the
American plane which was the first to fire the Soviet fighter-planes
is an indisputable fact and that the responsibility for the incident
is completely on the American side.
In the same note of March 4,1959, the Govemment of the USSR,
in response to the proposa1 of the Government of the USA to refer
this case to the International Court of Justice stated that they did
not see bases for it.
The Soviet Government draws your attention to the fact that
they repeatedly protested against violations by American planes
of the USSR state borders situated many thousand kilornetres
5 away from the American territory and warned that all the responsi-
bility for such violations and their consequences would be com-
pletely on the American side. But the American side ignored this
kind of warnings and did not prohibit their military air-forces to

USSR considers as before that in this case there are no questions
which are in need to be solved by the International Court of Justice
and do not see bases for the filing of this case with the Court."
Whereas a true copy of the above-mentioned letter was com-
municated to the Agent for the Government of the United States
of America on 3 September 1959;
Whereas, in these circumstances, the Court finds that it has not
before it any acceptance by the Government of the Union of Soviet
Socialist Republics of the jurisdiction of the Court to deal with
the dispute which is the subject of the Application submitted to it
by the Govemment of the United States of America and that there-
fore itcan take no further steps upon this Application;
orders that the case be removed from the list.
Done in English and in French, the English text being author-
itative, at the Peace Palace, The Hague, this seventh day of Octo-
ber, one thousand nine hundred and fifty-nine, in three copies,
one of which will be placed in the archives of the Court and the
others transmitted to the Government of the United States of
America and to the Govemment of the Union of Soviet Socialist
Republics, respectively.

Considérant que7juille1959l'ambassadeur des États-unis
d'Amérique aux Pays-Bas adéposéau Greffe une requête,
datée du 8 jui1959signée par l'agent du Gouvernement des

of the destruction on November 7, 1954, of a United States Air
Force B-29 aircraft in the Japanese territorial air space over
Hokkaido, Japan" ;
Whereas the Application was duly communicated by the Registry
on 7 July 1959 to the Ambassador of the Union of Soviet Socialist
Republics to the Netherlands ;
Whereas the Application was also communicated by the Registry
to the Members of the United Nations, through the Secretary-
General of the United Nations, and to the other States entitled to

Considérant que la requête a étédûment communiquée par le
Greffe le 7 juillet 1959 à l'ambassadeur de l'Union des Républiques
socialistes soviétiques aux Pays-Bas ;
Considérant que la requête a en outre été dûment communiquée
par le Greffe aux Membres des Nations Unies par l'entremise du
Secrétaire général des Nations Unies ainsi qu'aux autres Etats
admis à ester en justice devant la Cour;
Considérant que la requête contient les alinéas suivants:
« Le Gouvernement des États-unis, en déposant la présente
requête auprès dela Cour, a accepté sa juridiction aux fins de la
présente affaire. Il ne semble pas qu'à ce jour le Gouvernement
soviétique ait déposéune déclaration aupres de la Cour. Il a été
invitéà le faire par le Gouvernement des Etats-Unis, à l'occasion
du présent différend, dans la note du 19 juin 1958. Le Goiiverne-
ment soviétique a répondu de manière négative.Le Gouvernement
soviétique a cependant qualité pour reconnaître la juridiction de
la Cour en cette affaire et il lui est loisible, lorsque la présente
requête lui seranotifiéepar le Greffier,conformémentau Règlement
de la Cour, de prendre les dispositions nécessaires afin que soit
confirméela juridiction de la Cour à l'égard des deux Parties au
différend.
Le Gouvernement des États-Unis fonde donc la compétence de
la Cour sur les considérations qui précèdent, ainsi que sur l'arti-
cle 36(1) du Statut. 1)
Considérant que, dans une lettre en russe adressée au Greffier
le 31 août 1959 par le chargé d'affaires de l'Union des Républiques
socialistes soviétiques aux Pays-Bas et accompagnée d'une tra-
duction non officielle en anglais, il est dit:
((Dans la note adressée sur cette question le 4 mars 195.9au
Gouvernement desEtats-Unis .parle Gouvernement de 1'U.R. S. S.,
ainsi que dans ses précédentesnotesdes 7novembre et II décembre
1954et du 19août 1957,le Gouvernem~nt de 1'U.R. S. S. a signalé
que la violation de la frontière de 1'Eta.t soviétique par l'avion
américainqui a ouvert le feu le premier sur les chasseurs soviétiques
est un fait incontestable et qpe la responsabilité de l'incident est
entièrement à la charge des Etats-Unis.
Danslamêmenotedu 4mars 19591eGouvernement de 1'U.R. S.S.,
en réponse à la proposition par les Etats-Unis de soumettre cette
affaireà la Cour internationale de Justice, a déclaréne voir aucune
base pour cela.
Le Gouvernement soviétique signale à votre attention qu'il a

violations et leurs conséqiiencesseraient entièremenà la charge du
côté américain.Mais le côté américain n'a pas tenu compte des
avertissements et n'a interdit à ses forces aériennesmilitaires ni
d'envoyer des avions vers les frontièresterritoriales de 1'U.R. S. S.
ni de violer ces frontières.
A raison de ce qui précède le Gouvernement de 1'U.R. S.S.
estime comme par le passéqu'il n'existe dans cette affaire aucune
question à résoudre par la Cour internationale de Justice et ne
voit aucune base pour soumettre l'affaire à la Cour. ))
Considérant que, le 3 septembre 1959, copie certifiée conforme
de cette lettre a étécommuniquée à l'agent du Gouvernement des
États-unis d'Amérique ;
Considérant que, dans ces conditions, la Cour doit constater
qu'elle ne se trouve en présenced'aucune acceptation par le Gouver-
nement de l'Union des Républiques socialistes soviétiques de la
juridiction de la Cour pour connaître du différend faisant l'objet
de la requête dont elle a étésaisie par le Gouvernement des États-
Unis d'Amérique, et qu'en conséquence elle ne peut donner suite
à cette requête;
ordonne que l'affaire soit rayée du rôle.
Fait en anglais et en. français, le texte anglais faisant foi, au
Palais de la Paix, à La Haye, le sept octobre mil neuf cent cin-
quante-neuf, entrois exemplaires, dont l'un restera déposéaux archi-
ves de la Cour et dont les autres seront transmis respectivement au
Gouvernement des États-unis d'Amérique et au Gouvernement de
l'Union des Républiques socialistes soviétiques.
