The International Court of Justice,

Composed as above,
After deliberation,

Having regard to Article 48 of the Statute of the Court,
Having regard to Article 37 of the Rules of Court,

Makes tlzefollowing Order:
Having regard to the Application by the United Kingdom of Great
Britain and Northernreland filed in the Registry of the Court on
14April 1972,instituting proceedings against the Republic of Iceland inthe dispute which has arisen between the two Governments relating to
the proposed extension by the Government of lceland of its fisheries
jurisdiction around Iceland;
Whereas the Government of Iceland was notified imniediately of the
filing of the Application, and a copy thereof was transmitted to it by air
mail ;
Having regard to the letter dated 29 May 1972from the Minister for
Foreign Affairs of Iceland, received in the Registry on 31 May 1972,the
telegram from the said Minister dated 28 July 1972 received in the
Registry on 29 July 1972, the telegram from the said Minister dated 11
August 1972, received in the Registry the same day, and repeated and
confirmed by letter from the said Minister of 1I August 1972,in each of
which communications it was asserted that there was no basis under the
Statute of the Court for exercising jurisdiction in the case;

Having regard to the refusal by the Government of Iceland, in its
letter of 29 May 1972, to appoint an Agent, and to the fact that the
Government of Iceland, which had been duly notified by telegram and
letter of 19 July 1972that the Court would hold hearings, opening on
1 August 1972, to give the Parties the opportunity of presenting their
observations on the request for the indication of provisional nieasures,
was not represented at the hearing held on that date;
Having regard to the Order of 17 August 1972, by which, following
the request of the Government of the United Kingdom dated 19July 1972,
the Court indicated interim measures of protection in the case, which in-
dication in no way prejudges the jurisdiction of the Court toconsider the
merits of the dispute;
Whereas, in these circumstances, it is necessary to resolve first of al1
the question of the Court's jurisdiction,

Decides, by 9 votes to 6, that the firstpleadings shall beaddressed to the
question of the jurisdiction of the Court to entertain the dispute;

Fixes as follows the time-limits for the written proceedings:

13 October 1972for the Memorial of the Government of the United
Kingdom,
8 December 1972 for the Counter-Memorial of the Government of
Iceland;

And reserves the subsequent procedure for further decision.

Done in English and in French, the English text being authoritative,
at the Peace Palace, The Hague, this eighteenth day of August, one
thousand nine hundred and seventy-two, in three copies, one of which
will be placed in the archives of the Court, and the others transmittedto theGovernmentof theUnitedKingdomof GreatBritain andNorthern
Ireland,and to the Governmentof Iceland, respectively.

Rend l'ordonnance .suivante:

Vu la requête enregistréeau Greffe de la Cour le 14 avril 1972, par
laquelle le Royaume-Uni de Grande-Bretagne et d'Irlande du Nord a
introduit une instance contre la République d'Islande au sujet d'unthe dispute which has arisen between the two Governments relating to
the proposed extension by the Government of lceland of its fisheries
jurisdiction around Iceland;
Whereas the Government of Iceland was notified imniediately of the
filing of the Application, and a copy thereof was transmitted to it by air
mail ;
Having regard to the letter dated 29 May 1972from the Minister for
Foreign Affairs of Iceland, received in the Registry on 31 May 1972,the
telegram from the said Minister dated 28 July 1972 received in the
Registry on 29 July 1972, the telegram from the said Minister dated 11
August 1972, received in the Registry the same day, and repeated and

Vu la lettre du ministre des Affaires étrangèresd'Islande datée du
29 mai 1972 et reçiie au Greffe le 31 mai 1972, le télégrammedudit
ministre datédu 28 juillet 1972et reçu au Greffe le 29 juillet 1972,son

télégrammedu 11 août 1972 reçu au Greffe le mêmejour, répétéet
confirmé par sa lettre du 11 août 1972, toutes communications où il
est affirméque la Cour ne peut trouver dans son Statut aucun fondement
pour l'exercicede sa compétenceen l'affaire;

Vu le refus du Gouvernement islandais de désignerun agent, énoncé
dans sa lettre du 29 mai 1972,et le fait que le Gouvernement islandais,
qui avait été avisépar télégrammeet par lettre du 19juillet 1972que la
Cour ouvrirait la pr~océdureorale le 1" août 1972en vue de donner aux
Parties l'occasion de formuler leurs observations sur la demande en
indication de mesures conservatoires, ne s'est pas fait représenter à
l'audience tenue à cette date;
Vu l'ordonnance du 17 août 1972,par laquelle, statuant sur la demande
présentéepar le Gouvernement du Royaume-Uni le 19juillet 1972, la
Cour a indiquédes mesures conservatoires en l'affaire, ce qui ne préjuge
en rien la compétence de la Cour pour connaitre du fond du différend;

Considérant que, dans ces conditions, il est nécessaire de régler en
premier lieu la question de la compétencede la Cour,

Décide, par neuf voix contre six, que les premières pièces écrites
porteront sur la question de la compétence dela Cour pour connaitre du
différend;

Fixe comme suit la date d'expiration des délais pour la procédure
écrite:
Pour le dépôt du mémoire du Gouvernement du Royaume-Uni, le
13octobre 1972,
Pour le dépôt du contre-mémoire du Gouvernement islandais, le
8 décembre 1972;

Réservela suite de la procédiire.

Paix, a La Haye, le dix-huit août mil neuf cent soixante-douze, en trois
