ORDER
The Vice-President of the International Court of Justice, Acting
President under Article 13 of the Rules of Court,
Having regard to Articles 40and 48 of theatute of the Court and to
Articles 32, 37 and 67 of theles of Court,
Whereas on 30 August 1971Mr. J. N. Dhamija, Ambassador of India
at The Hague, filed in the Registry of the International Court of Justice
an Application on behalf of the Government ofdia appealing fromthe
decision rendered on 29 July 1971 by the Council of the International
Civil Aviation Organization on preliminary objections raised bydia
in proceedings instituted by Pakistan against India before the Council;
Whereas the Application stated that Mr. J. N. Dhamija had been
appointed by the Government of India as its Agent for the purpose of
the Application andal1proceedings thereon;
Whereas the Application founds the jurisdiction of the Court on
Article 84 of the Convention on International Civil Aviation, 1944,
Article IJ of the International Air Services Transit Agreement, 1944,
and Articles 36and 37of the Statute oftheInternational Court ofJustice; Whereas on 30August 1971a copy of the Application was transmitted
to the Minister for Foreign Affairs of Pakistan;
Whereas by a letter dated 1 September 1971the Additional Foreign
Secretary of Pakistan informed the Registry that Mr. R. S. Chhatari,
Ambassador of Pakistan to the Netherlands, had been appointed as
Agent for Pakistan and Mr. S. T. Joshua, Third Secretary, Embassy of
Pakistan, The Hague, had been appointed as Deputy Agent for Pakistan
in this case;
Having ascertained the view of the Parties,
Fixes 16December 1971asthe time limit forthe filingof the Memorial
of the Government of India;
Reserves the subsequent procedure for further decision.
Done in French and in English, the French text being authoritative,
at the Peace Palace, The Hague, this sixteenth day of September, one
thousand nine hundred and seventy-one, in three copies, one of which
will be placed in the Archives of the Court and the others transmitted
to the Government of India and the Government ofPakistan, respectively.

ORDONNANCE
Le Vice-Présidentde la Cour internationale de Justice, faisant fonction
de Présidenten vertu de l'article 13du Règlementde la Cour,
Vu les articles 40 et 48 du Statut de la Cour et les articles 32, 37 et 67
du Règlementde la Cour,
Considérantque, le 30 août 1971, J. N. Dhamija, ambassadeur de
l'IndeàLa Haye, a déposé auGreffe de la Cour internationale de Justice
une requêtedu Gouvernement indien faisant appel de la décisionrendue
le 29 juillet 1971 par le Conseil de l'organisation de l'aviation civile
internationale sur des exceptions préliminairessoulevéespar dans
une procédureengagéecontre elle devant le Conseil par le Pakistan;
Considérantque la requête indiqueque J. N. Dhamija a étédésigné
par le Gouvernement indien comme agent aux fins de la requêteet de
toute procédure y faisant suite;
Considérant que, pour établir la compétence de la Cour, la requête
invoque l'article 84 de la Convention de 1944relativeiation civile
internationale, l'article II decord de 1944 relatif au transit des
services aériens internationaux et les articles 36 et 37 du Statut de la

Considérantque, par lettre du1" septembre 1971, le ministre adjoint
des Affaires étrangèresdu Pakistan a fait connaître au Greffe que
M. R. S. Chhatari, ambassadeur du Pakistan à La Haye, était
désignécomme agent du Pakistan en l'affaireet S.T. Joshua, troisième
secrétairà l'ambassade du Pakistan, comme agent adjoint;
Après s'être renseignauprès des Parties,
Fixe au 16décembre1971la date d'expiration du délaipour le dépôt
du mémoiredu Gouvernement indien;
Réserve lasuite de la procédure.
Fait en français et en anglais, le texte français faisant foi, au palais de
la Paix,àLa Haye, le seize septembre mil neuf cent soixante et onze en
trois exemplaires, dont l'un restera déposé auxarchives de la Cour et
dont les autres seront transmis respectivement au Gouvernement indien
