CASE CONCERNING

THE BARCELONA TRACTION, LIGHT

AND POWER COMPANY, LIMITED

(BELGIUM v. SPAIN)

The President of the International Court of Justice,

having regard to Article 48 of the Statute of the Court and to
Article37 of the Rules of Court,
having regard to theder of 18 October 1958whereby 18 June
1959 was fixed as the time-limit for the filing of the Memorial of
the Belgian Govemment, and 18February 1960 as the time-limit
for the filing of the Counter-Memorial of the Spanish Govemment,
the subsequent procedure being reserved for further decision,
Whereas, by a letter of 24 November 1959, the Agent for the
Spanish Govemment requested an extension to 18 August 1960of
the time-limit for the filing of the Counter-Memorial, the reasons
given in support of the request being the number and the length of
the documents annexed to the Memorial, which it was necessary
to verify and which were spread over various countries, and the
necessity, for the preparation of the defence, of assembling other
documents and evidence likewise spread over various countries
and drafted in various languages;
Whereas a copy of the above-mentioned letter was on the same
day communicated to the Agent for the Belgian Govemment who
4was invited to make known the views of his Government on the
request thus presented ;

Whereas, by a letter of 2 December 1959, the Agent for the
Belgian Govemment stated that the request gave rise to serious
reservations ;
Decides to extend to 21 May 1960 the time-limit for the filing
of the Counter-Mernorial of the Spanish Government, the subse-
quent procedure remaining reserved for further decision.

Done in English and French, the English text being authoritative,
at the Peace Palace, The Hague, this fifth day of December, one
thousand nine hundred and fifty-nine, in three copies, one of which
willbe placed in the archives ofthe Court and the others transmitted
to the Belgian Govemment and to the Spanish Government,
respectively.

Le Président dela Courinternationale de Justice,

vu l'article 48 du Statut de la Cour et l'article 37 du Règlement
de la Cour,
vu l'ordonnance du8octobre 1958fixant au 18juin 19jg la date
d'expiration du délaipour le dépôtdu mémoiredu Gouvernement
belge et au8 février1960 la date d'expiration du délai pour le
dépôtdu contre-mémoiredu Gouvernement espagnol et réservant
la suite de la procédure,
Considérant que, par lettre 24 novembre I9j9, l'agent du
Gouvernement espagnol a demandéle report au 18 août 1960de la
date d'expiration du délaipour le dépôtdu contre-mémoire,cette
demande étantmotivéepar le nombre et la longueur desdocuments
annexésau mémoire,documents qu'il convient de vérifieret qui
se trouvent disséminés endifférentspays, et par l'obligation pour
y répondre de réunir d'autres documents et preuves également
disséminéen différentspays et rédien différentes langues;

Considérantque copie de la lettre précitée aétécommuniquée
le mêmejour à l'agent du Gouvernement belge, leauété invité

Considérant que, par lettre du 2 décembre 1959, l'agent du
Gouvernement belge a fait savoir que cette demande suscite de
sérieuses réserves;

Décidede reporter au 21 mai 1960 la date d'expiration du délai
pour le dépôt du contre-mémoire du Gouvernement espagnol, la
suite de la procédure restant réservée.
Fait en anglais et en français, le texte anglais faisant foi, au

Palais de la Paix, à La Haye, le cinq décembre mil neuf cent
cinquante-neuf, en trois exemplaires, dont l'un restera déposéaux
archives de la Cour et dont les autres seront transmis respective-
ment au Gouvernement belge et au Gouvernement espagnol.
