ORDER

The Judge discharging the duties of President of the International

Court of Justicender Article 12of the Rules of Court,
Having regard to Articles 40 and 48 of the Statute of the Court and
to Articles 32 and 37 of thees of Court,
Whereas, by a letter of 16 February 1967, received in the Registry
on 20 February 1967,the Minister of Foreign Affairs of thengdom
of the Netherlands transmitted to the Registrar an original copy, signed
at Bonn on2 February 1967for the Government of the Federal Republic

of Germany and the Government of the Netherlands, of a Special
Agreement for the submission to the International Court of Justice of a
differencebetweenthe Federal Republic of Germany and the Netherlands
concerningthe delimitation, as betweenthe Federal Republic of Germany
and the Netherlands, of the continentallf in the North Sea;
Whereas the Netherlands Minister of Foreign Affairs also attachea
to his letter an original copy, signed at Bonn on 2 February 1967,of a
Protocol to which the Governments of the Federal Republic of Germany
and the Netherlands are parties, in which provision is made for the

notification by the Netherlands Government of theid Special Agree-
ment to the International Court of Justice;

Whereas Article 3 of the Special Agreement provides for its entry
into force on the day of signature thereof;
Whereas, by his said letter of 16 February 1967, the Netherlands
Minister of Foreign Affairs informed the Registrar of the appointment
of Professor W. Riphagen, Legal Adviser to the Ministry of Foreign
Affairs, as Agent of the Netherlands;

Whereas, by a letter dated 20 February 1967,the Government of the
Federal Republic of Germany was duly informed of the notification of
the Special Agreement;
Whereas, by a letter of 1 March 1967,the Ambassador of the Federal
Republic of Germany to the Netherlands informed the Registrar of the
appointment of Professor Dr. Günther Jaenicke, oftheJohann Wolfgang

Goethe University, as Agent of the Federal Republic of Germany;

Whereas Article 2 of the Special Agreement recites the agreement of
the Parties that, without prejudiceto any question of burden of proof
which might arise, written pleadings should be presented to the Court
in the order stated below:
(1) a Memorial of the Federal Republic of Germany to be submitted

within six months from the notification of the Special Agreement;
(2) a Counter-Memorial of the Netherlands to be submitted within
six months from the delivery of the German Memorial;
(3) a German Reply followed by a Netherlands Rejoinder to be
delivered within such time-limits as the Court may order;

Taking this agreement into account, as provided for by paragraph 3
of Article 37 of the Rules of Court,
Fixes 21 August 1967as the time-limit for the filing of the Memorial
of the Federal Republic of Germany and 20 February 1968as the time-
limit for the filing of the Counter-Memorial of the Netherlands;

Reserves the subsequent procedure for further decision.
Done in English and in French, the English text being authoritative,
at the PeacePalace, The Hague, this eighth day of March, one thousand
nine hundred and sixty-seven,in three copies, one of which willbe placed
in the archives of the Court and the others transmitted to theGovern-
ment of the Federal Republic of Germany and to the Government of
the Kingdom of the Netherlands respectively.

ORDONNANCE

Le juge faisant fonction de Président de la Cour internationale de
Justice en vertu de l'article 12du Règlement dela Cour,
Vu les articles 40 et 48 du Statut de la Cour et les articles 32 et 37 du
Règlement dela Cour,
Considérant que, par lettre du 16 février 1967, reçue au Greffe le
20 février 1967, le ministre des Affaires étrangères du Royaume des
Pays-Bas a adressé auGreffier un exemplaire original d'un compromis,
signéàBonn le 2 février1967pour le Gouvernement de la République
fédérald'Allemagneet le Gouvernement des Pays-Bas, soumettant

Cour internationale de Justice un différendentre la République fédérale
d'Allemagne et les Pays-Bas relatifélimitation du plateau conti-
nental de la mer du Nord entre la République d'Allemagne et
les Pays-Bas;
Considérant que le ministre des Affaires étrangères desPays-Bas a
égalementjoinà sa lettre un exemplaire original d'un protocole, signé
à Bonn le 2 février 1967, auquel le Gouvernement de la République
fédérale d'Allemaet le Gouvernement des Pays-Bas sont parties, où
il est prévuque ledit compromis sera notifiépar le Gouvernement des
Pays-Basàla Cour internationale de Justice;

Whereas Article 3 of the Special Agreement provides for its entry

Registrar. Considérant qu'en vertu de son article 3, le compromis entre en
vigueur lejour de sa signature;
Considérant que, dans ladite lettre du 16 février1967, le ministre des
Affaires étrangères desPays-Bas a informéle Greffier que M. W. Rip-
hagen, jurisconsulte du ministère des Affaires étrangères, avait été

désignécomme agent des Pays-Bas;
Considérant que, par lettre du 20 février1967, le Gouvernement de la
Répubiique fédérald e'Allemagne a étédûment informéde la notification
du compromis;
Considérant que, par lettre du ler mars 1967, l'ambassadeur de la
République fédéraled'Allemagne aux Pays-Bas a informé le Greffier

que M. Günther Jaenicke, professeur à l'université Johann Wolfgang
GŒthe, avait étédésigné comme agent de la République fédérale
d'Allemagne ;
Considérant que, dans son article 2, le compromis fait état d'un
accord des Parties selon lequel, sans que cela préjugeen rien la charge
de la preuve, les piècesde la procédure écrite seraient déposéesevant
la Cour dans l'ordre suivant:

1. Mémoire dela Républiquefédérale d'Allemagnedevant êtresoumis
dans les six mois qui suivront la notification du compromis;
2. Contre-mémoiredes Pays-Bas devant êtresoumis dans les six mois
qui suivront la remise duniémoireallemand;
3. Réplique allemandesuivie d'une duplique néerlandaise,devant être
soumises dans des délaisà fixer par la Cour;

Tenant compte de cet accord, comme il est indiqué à l'article 37,
paragraphe 3, du Règlement de la Cour,
Fixe au 21 août 1967 la date d'expiration du délaipour le dépôt du
mémoirede la République fédéraled'Allemagne et au 20 février 1968
la date d'expiration du délai pour le dépôt du contre-mémoire des
Pays-Bas ;

Réservela suite de la procédure.
Fait en anglais et en français, le texte anglais faisant foi, au palais de
la Paix,à La Haye, le huit mars mil neuf cent soixante-sept, en trois
exemplaires, dont l'un restera déposéaux archives de la Cour et dont les
autres seronttransmis respectivement au Gouvernement dela République
fédéraled'Allemagne et au Gouvernement du Royaume des Pays-Bas.
