SOUTH WEST AFRICA CASE
(LIBERIA v. UNION OF SOUTH AFRICA)

ORDER

The President of the InternationaCourt of Justice,

having regard to Article 48 of the Statute of the Court and to
Article 37 of theules of Court;

Whereas, by letter dated 4 November 1960received inthe Regis-
try on the same date, the Liberian Ambassador tothe Netherlands
forwarded to the Registrar a letter transmitting on behalf of the
Government of Liberia an Application institutingproceedings
and relating to a dispute between Liberia and the Union of South
Africa concerning theinterpretation and application of the Mandate
for South West Africa;

Whereas, in his letter, the Liberian Ambassador stated that
Mr. JosephW. Garber, Attorney General of Liberia, and Mr.Ernest
A. Gross had been appointed Agents by his Government ;

'I'vhereasthe Application refers to Article 80, paragraph 1, of the
Charter of the United Nations and founds the jurisdiction of the
Court on Article 7 of the Mandate for South West Africa made at
Geneva on 17December 1920,and on Article 37 ofthe Statute of the
International Court of Justice;

Whereas, on 4 November 1960, a copy of the Application was
communicated to the Chargé d'affairesa.i.of the Union of South

Whereas, on 15 December 1960, the Chargé d'affaires a.;.of the
Union of South Africa handed over to the Registrar a letter from the
Minister of External Affairs of the Union of South Africa dated
3 December 1960 notifying the appointment of Dr. Joan Philip

Verloren van Themaat as Agent;
Having ascertained the views of the Parties,
fixes as follows the time-limits for the filing of Pleadings:

for the Memorial of the Liberian Government, 15 April 1961;
for the Counter-Mernorial ofthe Government ofthe Union of South
Africa, 15 December 1961;

Reserves the subsequent procedure for further decision.

Done in English and in French, the English text being author-
itative, at the Peace Palace, The Hague, this thirteenth day of
January, one thousand nine hundred and sixty-one, in three copies,
one of which will be placed in the archives of the Court and the
others transmitted to the Government of Liberia and to the Gov-
ernment of the Union of South Africa, respectively.

ORDONNANCE

Le Président de la Cour internationale de Justice,

vu l'article8 du Statut de la Cour et l'article 37 du Règlement
de la Cour;

Considérant que, par lettre du 4 novembre 1960 reçue au Greffe
le mêmejour, l'ambassadeur du Libéria aux Pays-Bas a adressé
au Greffier une lettre transmettant nom du Gouvernement du
Libéria une requête introductive d'instance relative différend
entre le Libéria et l'Union sud-africaine concernal'interpréta-
tion et l'application du Mandat pour le Sud-Ouest africain;

Considérant que, par sa lettre, l'ambassadeur du Libéria a fait
connaître queMM. Joseph W. Garber, Attorney Generuidu Libéria,
et Ernest A. Gross avaient été désignés commeagents par son
Gouvernement ;

Considérant que la requête,se référàl'article 80,paragraphe 1,
de la Charte des Nations Unies, prétend établir la compétence de
la Cour sur l'arti7ldu Mandat pour le Sud-Ouest africain établi
à Genève le 17 décembre 1920 ainsi que sur l'ar37du Statut de
la Cour internationale de Justice;
Considérant que, le4novembre 1960, copie de la requête aété
communiquée au chargé d'affaires a. i. de l'rnion sud-africaine aux

Affaires étrangères de l'Union sud-africaine en date du 3 décembre
1960 faisant connaître que XI. Joan Philip Verloren van Themaat
avait étédésigné commeagent ;

Après s'êtrerenseignéauprès des Parties,
fixe comme suit la date d'expiration des délaispour le dépôt des
pièces de la procédure écrite:
pour le mémoire du Gouvernement du Libéria, le 15 avril 1961;

pour le contre-mémoire du Gouvernement de l'Union sud-afri-
caine, le15 décembre 1961;
Réservela suite de la procédure

Fait en anglais et en français, le texte anglais faisant foi, au
Palais de la Paix,à La Haye, le treize janvier mil neuf cent soixante
et un, en trois exemplaires, dont l'un restera déposéaux archives
de la Cour et dont les autres seront transmis respectivement au
Gouvernement du Libéria et au Gouvernement de l'Union sud-
africaine.
