CASE CONCERNING

ORDER
The President of the InternationCourt of Justice,
having regard to Articl48 of the Statute of the Court and to
Article 62 of the Rules of Court;
Having regard to the Order of5 December 1959 extending to
21 May 1960 the time-limit fixed for the filing of the Counter-
Memorial of the Spanish Government;
Whereas, within the time-limit so extended, the Spanish Govern-
ment filed certain PreliminaObjections and asked the Court to
adjudge and declare that it is without jurisdiction to entertain the
Application of the Belgian Governmenî and that the Application
is inadmissible
Whereas, accordingly, by virtue of the provisions of Article 62,
paragraph 3, of the Rules of Court, the proceedings on the merits
are suspended and a time-limit has to be fixed for the presentation
by the other Party of a written statement of its Observations and
Submissions on the Preliminary Objections Whereas, with reference to the fixing of a time-limit for the
presentation of such a written statement, the Agent for the Belgian
Government, by letter of 3 June 1960, stated that "The number,
the importance and the complexity of the questions raised both in
the historical part and in the part devoted to the preliminary
objections in the document in question, will involve considerable
work requiring the bringing together of numerous documents and
the undertaking of thorough research"; and that "In these
circumstances, the Belgian Government deems it essential to have
a period equal to that which was necessary for the Spanish Govern-
ment for the preparation of the document which it has filed, namely
eleven months" ;
Whereas the Agent for the Spanish Government, to whom a copy
of the said letter was communicated on IO June 1960, indicated
by letter of17 June 1960 that "the Spanish Government considers
that the eleven months desired by the Belgian Government might
have given rise to some reservations"; but that "Nevertheless it
raises no objections and places itself entirely in the hands of the
Court as to the fixing of the time-limit";
Fixes 5December 1960asthe time-limit within which the Belgian
Government may present a written statement of its Observations
and Submissions on the Objections raised by the Spanish Govern-
ment.
Done in French and in English, the French text being author-
itative, at the Peace Palace, The Hague, this twentieth day of June,
one thousand nine hundred and sixty, in three copies, one of which
will be placed in the archives of the Court and the others trans-
mitted to the Belgian Government and to the Spanish Government,
respectively.

ORDONNANCE
Le Président de la Cour internationale de Justice,
vu l'artic48 du Statut de la Cour et l'article 6Règlement
de la Cour;
Vu l'ordonnance du5 décembre 1959 prorogeant au21 mai 1960
le délai fixépour le dépôt du contre-mémoire du Gouvernement
espagnol;
Considérant que, dans le délai ainsi prorogé, le Gouvernement
espagnol a déposécertaines exceptions préliminaires et priéla Cour
de dire et juger qu'elle est incompétente pour connaître dla
requêtedu Gouvernement belge et que cette requête estirrecevable;
Considérant qu'en conséquence, en vertu des dispositions de
l'article 62, paragraphe du Règlement de la Cour, la procédure
sur le fond est suspendue et qu'il échetde fixer un délaidans lequel
la Partie adverse pourra présenter un exposé écrit contenant ses
observations et conclusions sur les exceptions préliminaires;

du délaipour la présentation de cet exposé,l'agent du Gouverne-
ment belge a, par lettre du 3 juin 1960, énoncéque «Le nombre,
l'importance et la complexité des questions soulevées tant dans
l'exposé historique que dans la partie consacrée aux exceptions
préliminaires dans le document en question, entraîneront un travail
considérable qui suppose la réunion de documents multiples et
l'élaboration d'études approfondies »;et que «Dans ces conditions,
le Gouvernement belge estime qu'il lui serait indispensable de
disposer d'un délaiégal à celui qui a éténécessaireau Gouvernement
espagnol pour l'établissement du document qu'il a déposé,soit
onze mois );
Considérant que l'agent du Gouvernement espagnol, auquel la
copie de cette lettre a étécommuniquéele IO juin 1960, a fait savoir
par lettre du 17juin 1960que (le Gouvernement espagnol considère
que les onze mois souhaités par le Gouvernement belge auraient pu
éventuellement susciter des réserves D; mais que « Cependant il ne
formule pas d'objections et se remet entièrement à la Cour pour la
fixation du délai »;
Fixe au 5 décembre 1960 la date 'd'expiration du dClai dans
lequel le Gouvernement belge pourra présenter un exposé écrit
contenant ses observations et conclusions sur les exceptions sou-
levéespar le Gouvernement espagnol.
Fait en français et en anglais, le texte français faisant foi, au
Palais de la Paix, à La Haye, le vingt juin mil neuf cent soixante,
en trois exemplaires, dont l'un restera déposéaux archives de la
Cour et dont les autres seront transmis respectivement au Gou-
vernement belge et au Gouvernement espagnol.
