(LIECHTENSTEIN v. GUATEMALA)

ORDER

The President of the International Court of Justice,

having regard to ,4rticle48 of the Statute of the Court

having regard to .Article 37 of theules of Court ;
Whereas on December 17th, 1951, the Government of the Princi-
pality of Liechtenstein caused to be filed in the Registry of the Court
an Application, dated December ~oth, 1951, instituting proceedings

against the Republic of Guatemala concerning measures taken by
the latter Government against the person and the property of
Friedrich Nottebohrn, a citizen of Liechtenstei;
Whereas the Application invokes the Declaration dated
March 29th, 1950, vihereby the Government of the Principality of
Liechtenstein accepted the conditions determined by the General
Assembly of the Uriited Nations and thus became a party to the
Statute of the Court.;

Whereas the Application further invokes the Declarations by
which the Government of the Principality of Liechtenstein and the
Government of the Republic of Guatemala accepted the compulsory
jurisdiction of the Court in accordance with Article 36, paragraph
of the Statute of the Court, thus specifying the provision on which
the Applicant f0und.s the jurisdiction of the Cour; Whereas, by a letter received in the Registry on December 17th,
1951, the Chief of Government of the Principality of Liechtenstein
notified the Court of the appointment as Agent for that Govern-
ment of Dr. Emin H. Loewenfeld, LL.B., Legal Adviser to the
Government of thie Principality, and of his address for service at
the seat of the Caurt ;
Whereas the Application, which bears the signature of the Agent,
duly certified by the Chief of the Princely Government, States the

nature of the clairn and gives a succinct statement of the facts and
grounds on which the claim is based ;
Whereas, theref'ore, the Application fulfils the forma1 conditions
laid down by the .Rulesof Court ;
Whereas, on December 17th, 1951, the Government of the
Republic of Guatemala was duly informed by telegram of the filing

of the Application, of which a certified true copy was despatched to
it on December 18th, 1951 ;
Fixes as follows the time-limits for the filing by the Parties of
the first two pleadings :

for the Memorial of the Government of the Principality of
Liechtenstein : April 2nd, 1952 ;
for the Counter.-Memorial of the Government of the Republic of
Guatemala : July ~zth, 1952 ;

And reserves the rest of the procedure for further decision.

Done in French and English, the French text being authontative,
at the Peace Palace, The Hague, this twenty-sixth day of January,
one thousand nine hundred and fifty-two, in three copies, one of
which will be plalred in the archives of the Court and the others
will be transmitted to the Governments of the Principality of
Liechtenstein and of the Republic of Guatemala, respectively.

ORDONNANCE

Le Président de la Cour internationale de Justice,

vu l'article 48 du Statut de la Cour,

vu l'article 37 du Règlement de la Cour ;
Considérant qu'à la date du17 décembre 1951, le Gouvernement
de la Principauté du Liechtenstein a fait déposer au Greffe de
la Cour une requête, datée du IO décembre 1951, introduisant
contre la République de Guatemala une instance relative aux

mesures prises par ce dernier gouvernement contre la personne
et lesbiens de Friedrich Nottebohm, ressortissant du Liechtenstein
Considérant que la requête invoque la déclaration en date du
29 mars 1950 par laquelle le Gouvernement de la Principauté du
Liechtenstein a accepté les conditions déterminées parI'hssemblée
générale desNations Unies et est devenu ainsi partie au Statut
de la Cour ;

Considérant que la requête invoque, en outre, les déclarations
par lesquelles le Gouvernement de la Principauté du Liechtenstein
et le Gouvernement de la République de Guatemala ont accepté
la juridiction obligatoirede la Cour aux termes de l'article 36,
paragraphe 2, du Statut de la Cour, et que ladite requêtecontient,
par conséquent, la mention de la disposition par laquelle le requé-

de M. Erwin H. Loewenfeld, docteur en droit, LL. B., conseiller
juridique du Gouvernement de la Principauté, ainsi que son
élection de domicile au siège de la Cour ;

Considérant que la requête, qui porte la signature de l'agent,
dûrr:?nt légaliséepar le chef du Gouvernement princier, contient
l'indication de l'objet de la demande et un exposé succinct des
faits et des motifs par lesquels la demande est prétendue justifiée
Considérant que, dans ces conditions, la requête satisfait aux
conditions de forme posées par le Règlement ;
Considérant qu'à la date du 17 décembre 1951 e Gouvernement
de la République de Guatemala a étéavisé télégraphiquementdu
dépôt de ladite requêtè, dont copie certifiée conforme lui a été

adressée le 18 décembre 1951 ;
Fixe comme suit la date d'expiration des délais pour le dépôt
par les Parties des deux premières pièces de la procédure écrite:

pour le mémoire du Gouvernement de la Principauté du Liech-
tenstein :2 avril 1952 ;
pour le contre-mémoire du Gouvernement de la République de
Guatemala : 12 juillet1952 ;

Réserve la suite de la procédure.

Fait en français et en anglais, le texte français faisant foi, au
Palais de la Paix, à La Haye, le vingt-six janvier mil neuf cent
cinquante-deux, en trois exemplaires, dont l'un restera déposé
aux archives de la Cour et dont les autres seront transmis respec-
tivement au Gouvernement de la Principauté du Liechtenstein et
au Gouvernement de la République de Guatemala.
