AGAINST THE UNITED NATIONS EDUCATIONAL,
SCIENTIFIC AND CULTURAL ORGANIZATION
(REQUEST FOR ADVISORY OPINION)

ORDER

The President of the International Court of Justice,

having regard to Article 66, paragra2,of the Statute of the
Court ;

Whereas, on December 14th, 1946, the General Assembly of the
United Nations approved the agreement entered into by the
Economic and Social Council with the United Nations Educational,
Scientific and Cultural Organization, Article XI of whichdes
that this Organization is authonzed to request advisory opinicns
of the InternationalCourt of Justice on legal questions arising
within the scope of its activities, such request being addressed to
the Court by the General Conference or by the Executive Board
acting in pursuance of an authonzation by the Confere;ce
Whereas the Constitution of the United Nations Educational,
Scientific and Cultural Organization provides in Article V, para-
graph II, that, between sessions of the General Conference, the
Executive Board may request advisory opinions from the Court

Whereas the United Nations Educational, Scientific and Cultural
Organization has recognized the jurisdiction of the Administrative
Tribunal of the International Labour Organisation and its Rules ofprocedure in accordancewith Article II, paragraph 5, ofthe Statute
of the said Tribunal, and whereas the Governing Body of the
International Labour Organisation approved on May 3oth, 1953,
the application to the United Nations Educational, Scientific and
Cultural Organization of the said Statute ;
Whereas on November 25th, 1955, the Executive Board of the
United Nations Educational, Scientific and Cultural Organization
adopted a resolution requesting the International' Court of Justice
to give an advisory opinion on the following questions :

"1.-Was the Administrative Tribunal competent, under Arti-
cle II of its Statute, to hear the complaints introduced
against the United Nations Educational, Scientific and
Cultural Organization on 5 February 1955 by Messrs.
Duberg and Leff and Mrs. Wilcox, and on 28 June 1955
by Mrs. Bernstein ?
II.-In the case of an affirmativeanswer to question 1 :

(a) Was the Administrative Tribunal competent to deter-
mine whether the power of the Director-General not
to renew fixed-term appointments has been exercised
for the good of the service and in the interest of the
Organization ?
(b) Was the Administrative Tribunal competent to pro-
nounce on the attitude which the Director-General,
under the terms of the Constitution of the United
Nations Educational, Scientificand Cultural Organiza-
tion, ought to maintain in his relations with a Member
State, particularly as regards the execution ofthe policy
of the Government authorities of that Member State ?
III.-In any case, what is the validity of the decisions given by
the Administrative Tribunal in its Judgments Nos. 17, 18,
19 and 21 ?"

Whereas certified true copies of the aforesaid Resolution of the
Executive Board of the United Nations Educational, Scientificand
Cultural Organization were transmitted to the Court by a letter of
the Director-General of the United Nations Educational, Scientific
and Cultural Organization, dated November 3oth, 1955, and filed
in the Registry on December znd, 1955 ;

Fixes April 3oth, 1956, as the time-lirnit within which written
statements may be submitted by any State entitled to appear
before the Court, or any international organization, considered by
the President as likely to be able to furnish information on the
questions referred to the Court ;
Reserves the rest of the procedure for further decision.

ORDONNANCE

Le Président de la Cour internationale de Justice,

vu l'articl66,paragraphe 2,du Statut ;

Considérant que le 14 décembre 1946 l'Assembléegénérale des
Nations Unies a approuvél'accord conclu par le Conseiléconomique
et social avec l'organisation des Nations Unies pour l'Éducation, la
Science et la Culture, dont l'artXIleprévoit que cette Organisa-
tion est autorisée demander des avis consultatifà la Cour inter-
nationale de Justice sur des questions juridiques qui se poseraient
dans le cadre de son activité, ces demandes pouvant êtreadressées
à la Cour par la Conférence généraleou par le Conseil exécutif
autorisé par la Conférence
Considérant, que la Constitution de l'organisation des Nations

Unies pour l'Education, la Science et la Culture prévoit dans son
article V, paragrapheII, que, dans l'intervalle des sessions de la
Conférence générale,le Conseil exécutif peut demander des avis
consultatifà la Cour ;
Considérant que l'organisation des Nations Unies pour l'Éduca-
tion, la Science et la Culture a reconnu la compétence du Tribunal
administratif de l'organisation internationale du Travail, de même

1953 le Conseil d'administration de l'Organisation internationale du
Travail a approuvé l'a plication de ce Statut l'organisation des
Nations Unies pour 1'Pducation, la Science et la Culture ;

Considérant que le 25 novembre 1955, le Conseil exécutif de
l'organisation des Nations Unies pour l'Éducation, la Science et la
Culture a adopté une résolution demandantàla Cour internationale
de Justice de donner un avis consultatif sur les questions suivantes :
1. - Le Tribunal administratif était-il compétent, aux termes
de l'article II de son Statut, pour connaître des requêtes

introduites contre l'organisation des Nations Unies pour
l'Éducation, la Science et la Culture, en date 5ufévrier
1955 p,ar MM. Duberg et Leff et la Dame Wilcox, et, en
date du 28 juin1955 ,ar la Dame Bernstein ?
II. - Dans le cas d'une réponse affirmativeà la question 1:

a) Le Tribunal administratif tait-il compétent pour véri-
fier si le pouvoir conféréau Directeur généralde ne pas
renouvelerdesengagements de duréedéfiniea étéexercé
pour le bien du service et l'intérêtde l'Organisation ?

b) Le Tribunal administratif était-il compétent pour se
prononcer sur l'attitude qu'aux termes de l'Acte consti-
tutif de l'Organisation des Nations Unies pour l'Éduca-
tion, la Science et'la Culture, le Directeur général doit
observer dans ses relations avec un État Membre,
notamment en ce qui concerne la mise en Œuvre de la
politique gouvernementale de cet État Membre ?

III. - En tout état de cause, quelle est la validité des décisions
rendues par le Tribunal administratif dans ses jugements
nOB17, 18 1,9et 21 ?))

Considérant que des copies certifiêesconformes de cette résolu-
tion du Conseil exécutif de l'organisation des Nations Unies pour
l'Éducation, la Science et la Culture ont étéadresséesà la Cour par
lettre du Directeur général de l'Organisation des NationsUnies
pour l'Éducation, la Science et la Culture, en date du 30 novembre
1955 et déposéeau Greffe le2 décembre 1955 ;

Fixe au 30 avril 1956 la date d'expiration du délai dans lequel
des exposés écrits peuvent êtreprésentéspar tout État admis à
ester devant la Cour ou par toute organisation internationale jugés
par le Président susceptibles de fournir des renseignements sur les
questions soumisesà la Cour;
