ORDER
The President of the InternationalCourt of Justice,
having regard to Article48 of the Statute of the Court and to
Article62 of the Rules of Court;
Having regard to the Application filed in the Registry on
28 October 1957 whereby the Government of the United States of
America instituted proceedings against the Government of the
People's Republic of Bulgaria;
Having regard to the Order of26 November 1957 fixing2 June
1958 as the time-limit for the filing of the Memorial of the Govem-
ment of the United States of America;
Having regard to theOrder of27January 1958 fixing9December
1958 as the time-limit for the filing of the Counter-Memorial of the
Government of the People's Republic of Bulgaria;
Having regard to the Order of19 May 1958 extending to2 Sep-
tember 1958 the time-limit fixed for the filing of the Memorial of
the Government of the United States of America and toune 1959
the time-limit for the filing of the Counter-Memorial of the Govem-
ment of the People's Republic of Bulgaria;
Having regard to the Order of 12 August 1958,whereby the
time-limit previously fixed for the nlemorial of the Government of
the United States of America at2 September 1958 was extended
4to 2 December 1958, the time-limit for the Counter-Memorial of
the Government of the People's Republic of Bulgaria remaining
fixed at 9 June 1959;
Having regard to the Memorial filed by the Government of the
United States of America within the time-limit fixed;
Having regard to the Order of 8 October 1958 extending to
g September 1959 the time-limit fixed for the filing of the Counter-
Memorial of the Government of the People's Republic of Bulgaria;
Whereas, within the time-limit so fixed, the Government of the
People's Republic of Bulgaria filed a document setting forth certain
Preliminary Objectionsand asking the Court to adjudge and declare
that the Court is without jurisdiction in the case concerning the
Aerial incident of 27 July 1955 and that the Application of the
Government of the United States of America, filed in the Registry
of the Court on 28 October 1957, is inadmissible;
Whereas, accordingly, by virtue of the provisions of Article62,
paragraph 3, of the Rules of Court, the proceedings on the merits
are suspended and a time-limit has to be fixed for the presentation
by the other Party of a written statement of its Observations and
Submissions on the Preliminary Objections;
Fixes 9 November 1959 as the time-limit within which the
Government of the United States of America may present a written
statement of its Observations and Submissions on the Objections
raised by the Government of the People's Republic of Bulgaria.
Done in French and in English, the French text being authori-
tative, at the Peace Palace, The Hague, this ninth day of September
one thousand nine hundred and fifty-nine, in three copies, one of
which will be placed in the archives of the Court and the others
transmitted to the Government of the United States of America and
to the Government ofthe People's Republic of Bulgariarespectively.

Le Président de la Cour internationale de Justice,
vu l'artic48du Statut de la Cour et l'art62ldu Règle~nent
de la Cour;
Vu la requête introductived'instance déposée au Greffe le
28 octobre1957 par le Gouvernement des Etats-Unis d'Amérique
contre le Gouvernement de la République populaire de Bulgarie;
Vu l'ordonnance du26 novembre 1957 fixant au2juin 1958 la
date d'expjration du délaipour le dépôtdu mémoiredu Gouverne-
ment des Etats-Unis d'Amérique;
Vu l'ordonnance du27 janvier1958fixant aug décembre 1958
la date d'expiration du délaipour le dépôt du contre-mémoire du
Gouvernement de la République populaire de Bulgarie;
Vu l'ordonnance du19 mai 1958 qui a prorogé au2septembre

Considhant que dans le délai ainsi fixé le Gouvernement de
la République populaire de Bulgarie a déposéun document énon-
çant certaines exceptions préliminaires et priant la Cour de dire
et juger que la Cour est incompétente en l'affairerelative àl'incident
aériendu 27juillet1955,respectivement que la requêtedu Gouverne-
ment des États-Unis enregistrée au Greffe de la Cour28eoctobre
1957 est irrecevable;
Considérant qu'en conséquence, en vertu des dispositions de
l'article2,paragraphe 3, du Règlement de la Cour, la procédure
sur le fond est suspendue et qu'il échet de fixer un délai dans
lequel la Partie adverse pourra présenter un exposéécrit contenant
ses observations et conclusions sur les exceptions préliminaires;
Fixe au 9 novembre 1959 la date d'expiration du délai dans
lequel le Gouvernement des Etats-Unis d'Amérique pourra pré-
senter un exposé écrit contenant ses observations et conclusions
sur les exceptions soulevéespar le Gouvernement de la République
populaire de Bulgarie.
Fait en français et en anglais, le texte français faisant foi, au
Palais de la Paix, à La Haye, le neuf septembre mil neuf cent
cinquante neuf, en trois exemplaires, dont l'un restera déposéaux
archives de la Cour et dont-les autreseront transmis respective-
ment au Gouvernement des Etats-Unis d'Amériqueet au Gouverne-
ment de la République populaire de Bulgarie.
