CONSTITUTION OF THE
MARITIME SAFETY COMMITTEE
(REQUEST FOR ADVISORY OPINION)
ORDER
The President of the International Court of Justice,
having regard to Article, paragraph 2, of the Statute of the
Court ;
Whereas a letter from the Secretary-General of the Inter-Govern-
mental Maritime Consultative Organizatidated 23 March 1959
and received in the Registry on 25 March 1959, transmitted
certified true copies of a Resolution adopted by the First Assembly
of that Organization on 19 Jânuary 1959, requesting the Court to
give an advisory opinion on the following question:
"1s the Maritime Safety Committee of the Inter-Governmental
MaritimeConsultative Organization,which was elected on-
Establishment of the Organization?";ith the Convention forthe
Whereas the establishment of the said Organization was provided
for by a Convention annexed to the Final Act of the United Nations
Maritime Conference signed at Geneva6oMarch 1948;
Whereas, on 18 November 1948, the General Assembly of the
United Nations approved by Resolution 204 (III) a draft Agreement
entered into between the Economic and Social Council and the
Preparatory Committee of the Inter-Governmental MaritimeConsultative Organization, Article IX of which provides that this
Organization shall be authorized to request advisory opinions of
the International Court of Justice on legal questions arising within
the scope of its activities,h requests being addressed to the Court
by the Assembly of the said dqanization or by its Council acting
in pursuance of an authorization of the Assembly;
Whereas the conditions laid down in Article 60 of the Convention
on the Inter-Governmental Maritime Consultative Organization for
the entry into force of that Convention were satisfied on 17 March
1958;
Whereas, on 13 January 1959, the First Assembly of the Inter-
Governmental Maritime Consultative Organization approved the
Agreement on relationship with the United Nations which, pursuant
to Article XIX thereof, came into force on that date;
Whereas, in accordance with Article 65, paragraph 2, of the
Statute of the Court, al1documents likely to throw light upon the
question on which the advisory opinion of the Court is requested
shall accompany the request ;
Whereas such documents were filed with the Registry on
27 JU~Y 1959;
Fixes 5 December 1959 as the time-limit within which written
statements may be submitted by any State entitled to appear
before the Court or any international organization considered as
likely to be able to furnish information on the question submitted
to the Court;
Reserves the subsequent procedure for further decision.
Done in English and French, the English text being authorita-
tive, at the Peace Palace, The Hague, this fifth day of August,
one thousand nine hundred and fifty-nine.

ORDONNANCE
Le Président de la Cour internationale de Justice,
vu l'article6,paragraphe 2 du Statut de la Cour;
Considérant que, le5 mars 1959,a étéreçue au Greffe une lettre
du Secrétaire général de l'organisation intergouvernementale
consultative de la Navigation maritime,datée du 23 mars 1959,
transmettant des copies certifiées conformes d'une résolution
adoptée par la Première Assemblée de cette Organisation, le
19janvier 1959,et demandant à la Cour de donner un avis consul-
tatif sur la question suivante:
gouvernementale consultative de la Navigation maritime, élule
15 janvier1959,a-t-il été établiconformémenà la Convention
portant créationde l'organisation?
Considérant que la création de ladite Organisation a étéprévue
par une Convention annexée à l'Acte final de la Conférencemari-
time des Nations Unies, signé Genève le 6 mars1948;
Considérant que, l18 novembre 1948, l'Assemblée généraledes

Acting Registrar.de la Navigation maritime, accord dont l'article IX prévoit que
cette Organisation est autoriséeà demander des avis consultatifs
à la Cour internationale de Justice sur des questions juridiques
qui se poseraient dans le cadre de son activité, ces demandes pou-
vant êtreadressées à la Cour par l'Assembléede ladite Organisation
ou par son Conseil agissant en vertu d'une autorisationde 1'Assem-
blée;
Considérant que les conditions énoncéesà l'article 60 de la
Convention sur l'organisation intergouvernementale consultative
de la Navigation maritime pour l'entrée en vigueur de cette Conven-
tion ont étéremplies le17 mars 1958;
Considérant que la première Assembléede l'organisation inter-
gouvernementale consultative de la Navigation maritime a, le
13 janvier 1959, approuvé l'Accord régissant les relations avec les
Nations Unies et que cet Accord est entré en vigueur àcette date,
en vertu des dispositions de son articleXIX;
Considérant que, conformément à l'article65, paragraphe 2
du Statut de la Cour, il est joint à la requête tout document
pouvant servir à élucider la question sur laquelle l'avis consultatif
de la Cour est demandé;
Considérant que ces documents ont étédéposésau Greffe le
27 juillet1959;
Fixe au 5 décembre 1959 la date d'expiration du délai dans
lequel des exposésécrits peuvent êtreprésentéspar tout État admis
à ester devant la Cour ou par toute organisation internationale
jugés susceptibles de fournir des renseignements sur la question
soumise à la Cour;
Réservela suite de la procédure.
Fait en anglais et en français, le texte anglais faisant foi, au
Palais de la Paix,à La Haye, le cinq août mil neuf cent cinquante-
neuf.
