CASE CONCERNING THE

AERIAL INCIDENT OF

JULY 27th 1955
(ISRAEL v. BGLGARIA)

ORDER

The President of the International Court of Justice,
having regard to Article 48 of thetatute of the Court and to
Article 62 of the Rules of Court;

Having regard to the Application filed in the Registry on
October 16th, 1957, whereby the Government of Israel instituted
proceedings against the Government of the People's Republic of
Bulgaria;
Having regard to the Order of November 26th, 1957, fixing
June and, 1958, as the time-limit for the filing of the Memorial of
the Government of Israel;
Having regard to the Order of January z7th, 1958, fixing
December gth, 1958, as the time-limit for the filing of the Counter-
Memorial of the Government of Bulgaria;

Having regard to the Memorial filed by the Government of
Israel within the time-limit fixed;
Whereas on December 6th, 1958, the Government of Bulgaria
filed a documentsetting forth certain preliminary objections to the
jurisdictionof the Court, contending that the Application isinadmissible and reserving the right to develop other contentions
relating to admissibility and to jurisdiction should the occasion
arise;

Whereas, by a telegram of December 8th, 1958, received in the
Registry on December gth, the Govcrnmcnt of Bulgaria submitted
in the alternative certain additional objections to the jurisdiction
of the Court;
Whereas both these documents reached the Registry within the
time-limit fixed for the filing of the Counter-Memorial;

Whereas, accordingly, by virtue of the provisions of Article 62,
yaragraph 3, of the Rules of Court, the proceedings on the merits
are suspended and a time-limit has to be fixed for the presentation
by the other Party of a written statement of its observations and
submissions on the preliminary objections;

Fixes February 3rd, 1959, as the time-limit within which the
Government of Israel may present a written statement of its obser-
vations and submissions on the objections raised by the Govern-
ment of Bulgaria.
Done in French and in English, the French text being authori-
tative, at the Peace Palace, The Hague, this seventeenth day of

December, one thousand nine hundred and fifty-eight, in three
copies, one of which will be placed in the archives of the Court
and the others transmitted to the Government of Israel and to the
Government of the People's Republic of Bulgaria, respectively.

Le Président de la Cour internationale de Justice,
vu l'article du Statut de la Cour et l'art62ldu Règlement
de la Cour;
Vu la requête introductive d'instance déposée au Greffe le
16 octobre1957 par le Gouvernement d'Israël contre le Gouverne-
ment de la République populaire de Bulgarie;

Vu l'ordonnance du26 novembre 1957 fixant au2juin 1958 la
date d'expiration du délai pour le dépôt du mémoiredu Gouverne-
ment d'Israël;

Vu l'ordonnance du27janvier1958 fixant a9 décembre 1958 la
date d'expiration du délai pour le dépôt du contre-mémoire du
Gouvernement de Bulgarie;
Vu le mémoire déposépar le Gouvernement d'Israël dans le
délaifix;
Considérant que, le 6 décembre 1958, le Gouvernement de
Bulgarie a déposéun document énonçant certaines exceptiopré-

Considérant que, par télégrammedu 8 décembre 1958 parvenu
au Greffe le 9 décembre, le Gouvernement de Bulgarie a soumis à

titre subsidiaire certaines exceptions complémentairesà la compé-
tence de la Cour;
Considérant que ces deux documents sont parvenus au Greffe
dans le délaifixépour le dépôt du contre-mémoire;
Considérant qu'en conséquence, en vertu des dispositions de
l'article 62, paragraphe 3, du Règlement de la Cour, la procédure

sur le fond est suspendue et qu'il échet de fixer un délai dans
lequel la Partie adverse pourra présenter un exposé écritcontenant
ses observations et conclusions sur les exceptions préliminaires;
Fixe au 3 février1959 la date d'expiration du délaidans lequel
le Gouvernement d'Israël pourra présenter un exposé écritconte-
nant ses observations et conclusions sur les exceptions soulevées

par le Gouvernement de Bulgarie.
Fait en français et en anglais, le texte français faisant foi, au
Palais de la Paix, à La Haye, le dix-sept décembre mil neuf cent
cinquante-huit, en trois exemplaires, dont l'un restera déposéaux
archives de la Cour et dont les autres seront transmis respecti-
vement au Gouvernement d'Israël et au Gouvernement de la Répu-
blique populaire de Bulgarie.
