ORDER

The President of the InternationCourt of Justice,

having regard to Article48of the Statute of the Court and to
Article69 of the Rules of Court;
Having regard to the Application, dat19November 1957 and
filed in the Registry of the Cour22oNovember 1957,by which
the Govemment of the United Kingdom of Great Britain and Nor-
them Ireland instituted proceedings before the Court against the
Govemment of the People's Republic of Bulgaria with regard to the
losses sustained by citizens of the United Kingdom and Coloniesby
reason of the destruction,27nJuly1955,by the Bulgarian anti-
aircraft defence forces, of an aircraft belonging to El Al Israel
Airlines Ltd. ;
Having regard to the Order of 26 November 1957, whereby
2 June 1958was fixed as the time-limit for the filingof the Memorial
of the Government of the United Kingdom;

Having regard tothe Order 27January 1958,whereby 9Decem-
ber 1958 was fixed as the time-limit for the filing of the Counter-
Memorial of the Government of Bulgaria;
Having regard to the Order of19 May 1958,whereby, having
regard to a request of the Agent for the Government of the United
Kingdom, the time-limits so fixed were extended, for the Memorial,
to 2September 1958and, for the Counter-Memorial,9June 1959; 265 AERIAL INCIDENT (u.K. v.BULGARIA) (ORDER 3VIII 59)
Having regard to the Memorial filed by the Government of the
United Kingdom within the time-limit fixed;

Having regard to the Order of 27 May 1959, whereby, at the
request of the Agent for the Government of Bulgaria, the time-
limit for the filing of the Counter-Memorial of the Government of
Bulgaria was extended to IO August 1959;
Whereas, in a letter dated 8 July 1959, and addressed to the

Registrar, the Agent for the Government of the United Kingdom
stated :
"By direction of Her Majesty'sPrincipal Secretary of State for
Foreign Affairs,and in accordancewith Article 69 of the Rules of
Court, 1 have the honour to request you to informthe Court of the
decisionof the Govemment of the United Kingdomto discontinue
the proceedings instituted by means of the Application dated
November 19, 1957."
Whereas, by a letter of IO July 1959, the Registrar informed the

Agent ofthe Government of Bulgaria that the President ofthe Court,
pursuant to Article 69, paragraph 2, of the Rules of Court, had
fixed a time-limit expiring on 7 August 1959, within which the
Bulgarian Government was to state whether it opposed the discon-
tinuance of the proceedings, and that if no objections were raised by
that Government within this time-limit, acquiescence would be
presumed ;
Whereas by a letter dated 25 July 1959the Agent for the Govern-
ment of Bulgaria informed the Registrar that his Government did

not oppose the discontinuance of the proceedings;
Places on record the discontinuance by the Government of the
United Kingdom of the proceedings instituted by the Application
filed on22 November 1957;

Orders that the case shall be removed from the Court's list.
Done in English and in French, the English text being authori-
tative, at the Peace Palace, The Hague, this third day of August,
one thousand nine hundred and fifty-nine, in three copies, one of
which will be placed in the archives of the Court and the others
transmitted to the Government of the United Kingdom of Great
Britain and Northern Ireland and to the Government of the People's
Republic of Bulgaria, respectively.

Le Président de la Cour internationale de Justice,

vu l'article duStatut de la Cour et l'ar69cdu Règlement de
la Cour;
Vu la requête introductive d'instance, datée d19 novembre
1957 et enregistrée au Greffe22enovembre 1957, par laquelle le
Gouvernement du Royaume-Uni de Grande-Bretagne et d'Irlande
du Nord a saisi la Cour du différendqui l'opposait au Gouvernement
de la République populaire de Bulgarie au sujet des pertes subies
par des ressortissants du Royaume-Uni et de ses Colonies du fait
de la destruction, lejuillet1955,par les forces de défenseanti-
aérienne bulgares d'un avion appartenant à la El Al Israel
AirlinesLtd;
Vu l'ordonnance du 26 novembre 1957 fixant au2 juin1958 la
date d'expiration du délai pour le dépôt du mémoiredu Gouverne-
ment du Royaume-Uni ;

Vu l'ordonnance du27 janvier1958fixant au9 décembre 1958la
date d'expiration du délai pour le dépôt du contre-mémoire du
Gouvernement bulgare ;
Vu l'ordonnance du 19 mai 1958par laquelle, eu égard à une
demande de l'agent du Gouvernement du Royaume-Uni, les délais
ainsi fixésont étéreportésii2 septembre 1958 pour le mémoire

Having regard to the Memorial filed by the Government of the
United Kingdom within the time-limit fixed;

Having regard to the Order of 27 May 1959, whereby, at the
request of the Agent for the Government of Bulgaria, the time-
limit for the filing of the Counter-Memorial of the Government of
Bulgaria was extended to IO August 1959;
Whereas, in a letter dated 8 July 1959, and addressed to the

Registrar, the Agent for the Government of the United Kingdom
stated :

dans le délai prescrit;
Vu l'ordonnance du 27 mai 1959 par laquelle, à la demande de
l'agent du Gouvernement bulgare, le délai fixépour le dépôt du
contre-mémoire du Gouvernement bulgare a étéreporté au IO août

1959 ;
Considérant que, dans une lettre du 8 juillet 1959 adressée au
Greffier, l'agent du Gouvernement du Royaume-Uni a déclaré:

«Sur l'instruction du secrétaired'État principal de Sa Majesté
aux Affairesétrangèreset conformément àl'article 69du Règlement
de la Cour, j'ai l'honneur de vous demander de bien vouloir faire
connaître à la Cour que le Gouvernement du Royaume-Uni renonce
à poursuivre l'instanceintroduite par la requête datdu 19novem-
bre 1957 )

Considérant que, par une lettre du IO juillet 1959, le Greffier a
informé l'agent du Gouvernement bulgare que le Président de la
Cour, conformément audit article 69, paragraphe 2, du Règlement
de la Cour, avait fixéun délaiexpirant le 7 août 1959 dans lequel le
Gouvernementbulgare devait déclarers'ils'opposait au désistement,
et que, fautepar lui de faire opposition dans ce délai,le désistement
serait réputéacquis;.

Considérant que, par lettre du 25 juillet1959 adresséeau Greffier,
l'agent du Gouvernement bulgare a fait savoir que son Gouverne-
ment ne s'opposait pas au désistement ;
Prend acte du désistement du Gouvernement du Royaume-Uni

de l'instance introduite par la requête enregistrée le 22 novembre
1957;
Ordonne que l'affaire soit rayée du rôle de la Cour.
Fait en anglais et en français, le texte anglaisfaisant foi, au Palais

de la Paix, à La Haye, le trois août mil neuf cent cinquante-neuf,
en trois exemplaires, dont l'un restera déposéaux archives de la
Cour et dont les autres seront transmis respectivement au Gouverne-
ment du Royaume-Uni de Grande-Bretagne et d'Irlande du Nord
et au Gouvernement de la République populaire de Bulgarie.
