COLOMBIAN-PERUVIAN
ASYLUM CASE
The Acting President of the International Court of Justice,
Having regard to Articles 35, 3640 and 48 of the Statute of
the Court,
Havingregard to Articles32,3538 and 41 of the Rules of Court,
Makes the following Order:
Whereason October 15th, 1949,the Governments of the Republic
of Colombia and of the Republic of Peru filed with the Registry of
the Court the text of an Agreement ofgust 31st, 1949,whereby
they agreed to refer to the Court the dispute which has arisen
between them on account of the request of the Colombian Govern-
ment that the Peruvian ,Government issue a safe-conduct to a
Peruvian citizen wh6 had been granted asylum in the Colombian
Embassy at Lima ;
Whereas by said Agreement the proceedings before the Court
may be instituted on the application of either ofthe Parties, without
this being regarded as an unfriendly act toward the other
Whereas the Parties have respectively designated as Agents,
for Colombia, Professor J. M. Yepes, and for Peru, Mr. Carlos
Sayan Alvarez, who have elected domicile at The Hague
Whereas on October 15th, 1949,the Government of the Repdblic
of Colombia fîled with the Registry of the Court an Application
asking the Court to decide whether: (a) within the limits of the obligations resulting in particular
from the Bolivarian Agreement on Extradition of July 18th, 1911,
and the Convention on the Right of Asylum of February zoth, 1928,
both in force between Colombia and Peru, and, in general, from
American international law, Colombia was competent as the
country granting asylum to qualify the offencefor the purposes of
such asylum ;
(b) in the specific case under examination, Peru, as the terri-
torial State, was bound to give the guaranties necessary for the
departure of the refugee, with due regard to the inviolability of
his person, from the country ;
Whereas the Application, whichbears the signature of Mr. Yepes,
Agent of the Colombian Government, duly certified by the Colom-
bian Chargé d'Affairesat The Hague, refers :
(a) to Article 7 of the Protocol of Friendship and Co operation
between the Republic of Colombia and the Republic of
Peru, signed at Rio de Janeiro on May ~4th~1934,and which
came into force in both States on September 27th, 1935 ;
(b) to Article 36, paragraph 1, of the Statute of the Court ;
(c) to Article 40 of said Statute and Article 32 of the Rules of
Court,
thus specifying the provision on which the Applicant founds the
juiisdiction of the Court ;
Whereas the Application also States the nature of the claim and
gives a succinct statement of the facts and grounds on which the
claim is based ;
Whereas, therefore, the Application fulfils the formal conditions
laid down by the Rules of Court ;
Whereas on October 17th, 1949,the Government of the Republic
of Peru was duly informed of the filingof the Application, of which
a certified true copy was despatched to it on the same date, and
whereas on October 19th the Government of the Republic of
Peru has acknowledged receipt of the Application ;
The Acting President of the Court, as the Court is not sitting,
after ascertaining the views of the Parties with regard to questions
of procedure, fixes as follows the time-limits for the presentation
by the Parties of the written proceedings :
for the Memorialof the Government of the Republic of Colombia,
Friday, the 30th of December, 1949 ;
for the Counter-Memorial of the Republic of Peru, Friday, the
10th of Marêh,1950 ; for the Reply of the Government of the Republic of Colombia,
Thursday, the 20th of Apnl, 1950 ;
for the Rejoinder of the Govemment of the Republic of Peru,
Tuesday, the 30th of May, 1950.
at the Peace Palace, The Hague, this twentieth day of October,ve,
one thousand nine hundred and forty-nine, in three copies, one of
which will be placed in the archives of the Court and the others
transmitted to the Govemments of the Republic of Colombia and
of the Republic of Peru respectively.

RELATIVE A.U DROIT D'ASILE
Le Président en exercice de la Cour internationale de Justice,
Vu les articles 336,40 et 48 du Statut de la Cour,
Vu les articles 32, 35, 38 et 41 du Règlement de la Cour,
Rend l'ordonnance suivante:
Considérant qu'à la date 15 octobre 1949, les Gouvernements
de la République de Colombie et de la République du Pérou ont
déposéau Greffe de la Cour le texte d'un Accord, du 31 août 1949,
aux termes duquel ils sont convenus de soumettre à la décisionde
la Cour le différend existant entre eux, à la suite de la demande
présentéepar le Gouvernement de Colombie en vue d'obtenir de
la part du Gouvernement du Pérouun sauf-conduit en faveur d'un
ressortissant péruvien réfuà l'ambassade de Colombie à Lima;
Considérant qu'aux termesdudit Accord, la procédure devant
la Cour pourra êtreengagéeà la demande de n'importe laquelle
des deux Parties, sans que cela constitue un acte inamical envers
l'autre Partie ;
Considérant que les deux Parties ont respectivement désigné
comme agents, la Colombie, M. le professeurJ. M. Yepes, et le
Pérou,M. Carlos Sayan Alvarez, lesquels ont élu domicile à La
Haye ;
Considérant qu'à la date du 15 octobre 1949, le Gouvernement
de la République de Colombie a déposéau Greffe de la Cour une

du droit international américain, ilappartient ou non à la Colombie,
en tant que pays accordant l'asile, de qualifier la nature du délit
aux fins du susdit asile;
b) dans le cas concret matière du litige, le Pérou, en sa qualité
d'État territorial, est ou non obligéd'accorder les garanties néces-
saires pour que le réfugiésorte du pays, l'inviolabilitéde sa per-
sonne étant respectée ;
Considérant quela requête,qui porte la signature de M. Yepes,
agent du Gouvernement de Colombie, dûment légaliséepar le
chargé d'affairesde Colombie à La Haye, invoque :
a) l'afticle 7 du Protocole d'amitié et de coopération entre la
République de Colombie et la République du Pérouqui fut
signé à Rio-de-Janeiro le 24 mai 1934 et entra en vigueur
pour les deux États le 27 septembre 1935 ;
b) l'article 36, alinéa 1, du Statut de la Cour;
c) l'article 40 de ce mêmeStatut et l'article 32 du Règlement
de la Cour,
et que, par conséquent,la requêtecontient la mention de la disposi-
tion par laquelle le requérant prétend établirla compétence dela .
Cour ;
Considérant, en outre, que la requêtecontient l'indication de
l'objet de la demande et un exposésuccinct des faits et motifs par
lesquels la demande est prétendue justifiée ;
Considérant que, dans ces conditions, la requête satisfait aux
conditions de forme poséespar le Règlement ;
Considérant que, le 17 octobre 1949, le Gouvernement de la
République du Pérou a étéavisé du dépôt de la requête, dont
copie certifiée conformelui a étéexpédiéele même jour,et qu'il
a, le rg octobre, accuséréception decette requête ;
Le Président en exercice de la Cour, celle-ci ne siégeant pas,
aprèss'êtrerenseignéauprès desParties sur les questions de procé-
dure, fixe comme il suit les délais pour la présentation, par les
Parties, des pièces de la procédure écrite :
pour le Mémoire du Gouvernement de la République de
Colombie : le vendredi 30 décembre 1949 ;
pour 'le Contre-Mémoirede la République du Pérou: le ven-
dredi IO mars 1950 ;
