The InternationalCourt of Justice,
having regard to Article 48 of theatute of the Court,
having regard to Article 37 of the Rules of Cou;t
,llakes the following Od:r
Having regard to the Application dated December ~oth, 1951,
and filed in the Registry of the Court on December7th, 1951, by
which the Principality of Liechtenstein instituted proceedings in
the Nottebohm case against the Republic of Guatemala,
Having regard to the Orders of January 26th and March 7th,
1952, fixing time-limits for the filing of the Memorial and the
Counter-Memorial in that case, and reserving the rest of thece-
dure for further decision,
Whereas the Government of the Principality of Liechtenstein
filed their Memorial with the Registry on Juned, 1952, within the
tiine-limit fixed by the Court,
Whereas within the time-limit fixed for thisrpose the Govern-
ment of Guatemala has not filed a Counter-Memorial, but before the
expiry of this time-limit, the Minister for Foreign Affairs of Guate-
mala, by a communication (No. 12580) dated September gth, 1952,filed in the Registry on September Ijth, stated that by reason of the
expiry on January 26th, 1952, of the declaration of acceptance of
the compulsory jurisdiction of the Court,his Government considered
that the Court had no jurisdiction to deal with a case affecting
Guatemala, andthat consequently the said Government was unable,
for the moment, to appear before the Court,
Whereas, in that communication, the Government of the Republic
of Guatemala declared their readiness to begin negotiations with the
Government of the Principality of Liechtenstein "with a view to
arriving at an amicable solution, either in the sense of a direct
settlement, an arbitration or judicial settlement, with a preference
for the last mentioned by means of" the International Court of
Justice,
Whereas the President, having been informed of the common
desire of the Parties to settle their dispute by negotiation, abstained
from ordering any steps relating to the continuation of the proceed-
ings ; but the Court, having received no information concerning
the conclusion of any agreement,cannot refrain from availing itself
of the pawers conferred upon it by Article 48 of the Statute ;
Fixes May z~st, 1953, as the time-limit within which the Govern-
ment of the Principality of Liechtenstein may present a written
statement of their observations in regard to the communication
(No. 12j80) of the Government of the Republic of Guatemala of
September gth, 1952 ;
And reserves the rest of the procedure for further decision.
Done in English and French, the English text being authoritative,
at thc Peace Palace, The Hague, this twentyfirst day of March, one
thousand nine hundred and fifty-three,in three copies, one of which
will be placed in the archives of the Court and the others will be
transmitted to the Governments of the Principality of Liechtenstein
and of the Republic of Guatemala, respectively.

Rend l'ordonnancesuivante:
Vu la requêtedatée duIO décembre 1951 et déposéeau Greffe de
la Cour le 17décembre 1951,par laquelle la Principautéduhtcn-
stein a introduit contre la République du Guatemala une instance.
relative l'affaire Nottebohm,
Vu les ordonnances du 26 janvier et du 7 mars 19j2 fixant les
délais pour le dépôt du mémoire et du contre-mémoire en ladite
affaire et réservant la suite de la procédure,
Considérant que le Gouvernement de la I'rincipauté du Liechten-
stein a déposéau Greffe son mémoire le juin 19j2, dans le délai
fixépar la Cour,
Considérant que dans le délaiqui lui était impartit effet, le
Gouvernement du Guatemala n'a pas présenté de contre-mémoire,
mais que, avant l'expiration de ce délai, le ministre des Affaires

Registrar.date du 9 septembre 19j2, enregistrée au Greffe l15 septembre, a
fait connaître qu'en raison de la caducité, survenue le 26 janvier
1952, de la déclaration portant acceptation de la juridiction obli-
gatoire de la Cour, son gouvernement estimait que la Cour n'avait
aucune juridiction pour examiner une affaire affectant le Guatemala
et qu'en conséquenceledit gouvernement se trouvait dans l'impossi-
bilité pour le moment de comparaître devant la Cour,
Considérant que dans cette communication le Gouvernement de
la République du Guatemala s'est déclaréprêt à entamer des négo-
ciations avec le Gouvernement de la Principauté du Liechtenstein
((afin d'arriveà une solution amiable par voie de règlement direct,
d'arbitrage ou de règlement judiciaire, de préférence ence cas par
l'intermédiaire de»la Cour internâtionale de Justice,
Considérant que le Président, informé du désir commun des
Parties de réglerleur différendpar voie denégociations, s'est abstenu
alors d:ordonner aucune mesure touchant la suite de la procédure,,
mais que la Cour n'ayant reçu aucune information conccrnarit la
conclusion d'un accord à ce sujet ne peut se dispenser d'user cles
pouvoirs que lui confère l'articl48 du Statut ;
Fixe au 21 mai 1953 la date d'expiration du délai dans lequel le
Gouvernement de la Principauté du Liechtenstein pourra déposer
un exposé écrit contenant ses observations sur la communication
(no 12580) du 9septembre 1952 du Gouvernement de la République
du Guatemala ;
Réserve la suite de la procédure.
Fait en anglais et en français, le texte anglais faisantfoi, au
Palais de la Paix, à La Haye, le vingt et un mars mil neuf cent
cinquante-trois, en trois exemplaires, dont l'un restera déposéux
archives de la Cour et dont les autres seront transmis respecti1.e-
ment au Gouvernement de la Principauti: du Liechtenstein et au
Gouvernement de la République du Guatemala.
